Storm aftermath not likely to delay election

Could the vast disruption caused by Sandy prompt a delay in the Nov. 6 presidential election?  Voting may be extensively disrupted in some of the swing states, including Virginia and Ohio.

MSNBC's Chris Jansing talks with NBC's Pete Williams about the impact Superstorm Sandy may have on the election, and the issues that would surround a possible postponement of the presidential election.

The answer is, yes, it could undoubtedly be delayed.  But it almost certainly won't be.

The Constitution gives Congress the authority to establish the day for presidential elections, and since 1845, a federal law has set the date as "the Tuesday after the first Monday in November." Congress could change the date, just as it could change any federal statute. But it would have to act quickly.

And of course, it's the states, not the federal government, that run elections in America.  Many states in areas not affected by Sandy's wrath would be likely to oppose a delay and its attendant costs. They could choose to go ahead with their elections for all but president and have a separate election for president later.  But such a move would undoubtedly suppress the turnout. 

Past disasters, including weather emergencies, have forced postponement of state and local elections.  New York state suspended its primary election in 2001 -- on September 11th, the day of the suicide hijack attacks. But few states have a regular procedure for doing it.  Florida, with its long experience in dealing with hurricanes, is one of the few with specific procedures in place, allowing the governor to suspend or delay elections.

John Fortier, a nationally respected expert on presidential elections, points out additional problems, writing on a blog sponsored by the Moritz School of Law at Ohio State University. 

"If voting were disrupted and postponed in one state," Fortier says, "then we will likely know the results in all the other states before voting can resume in the affected state. If the affected state or states are determinative of the electoral college outcome, the pressure and focus on that one state would be enormous."

Among other questions, he says, are what to do with votes already cast.

Finally, consider the fact that never before the U.S. history has a presidential election been postponed or canceled, not even during the Civil War.

In an extremely close Presidential Election that may already last until early the next day before we have a preliminary result it may be days given the possibility of several recounts and millions of contingency ballots that will need to be counted before we have a final result.

In the case of a tie (269/269) we won't have a "President Elect" until after the new Congress meets in Jan.

Every expert, including thousands of former Republicans said Mitt Romney's approach would have destroyed millions of US jobs. It would have taken 2-4 years to go through the privately funded bankruptcy (if there was money available) that Mitt Romney wanted. That's 2-4 years of GM and Chrysler workers without jobs.

Electoral College Model Predicts Romney Will Win Even Bigger Than Previously Thought in 2012

University of Colorado Professors Ken Bickers and Michael Berry and their highly-accurate Electoral College prediction model. As you may recall, Bickers and Berry, using their metrics, are able to retroactively predict every presidential win since 1980.

Their 2012 model made headlines two months ago because, despite polling, it found that Republican presidential candidate Romney would win 320 Electoral Votes, stealing the White House away from President Barack Obama. Now, an updated version of their study has come to the same conclusion — but it intensifies the numbers behind a predicted Romney win.

Despite the fact that polls still show a dead-heat race (Obama is currently at 48.2 percent, with Romney capturing 47.3 percent of likely voters in the most recent Real Clear Politics average), an updated election model shows an even larger gap between the Electoral College votes that Romney and Obama are projected to win. According to Bickers and Berry, the Republican challenger is projected to take 330 of the 558 votes, while Obama is expected to capture only 208 of them.

While many election forecast models are based on the popular vote, the model developed by Bickers and Berry is based on the Electoral College and is the only one of its type to include more than one state-level measure of economic conditions. They included economic data from all 50 states and the District of Columbia.

Would Romney Gut FEMA?

Getting a clear policy statement from the Romney campaign is pretty hopeless, and his statements on the Federal Emergency Management Agency are no exception. Yesterday the Huffington Post dug up a clip from a Republican primary debate in which Mitt Romney agreed it was a good idea to turn all of FEMA’s disaster response functions over to the states. Coming in the teeth of Hurricane Sandy, this was inconvenient, so today the Romney campaign has backpedaled a bit:

“Gov. Romney believes that states should be in charge of emergency management in responding to storms and other natural disasters in their jurisdictions,” Romney spokesman Ryan Williams said in a statement. “As the first responders, states are in the best position to aid affected individuals and communities, and to direct resources and assistance to where they are needed most. This includes help from the federal government and FEMA.”

Alas, this says nothing. It is a boilerplate statement of FEMA’s existing mission. FEMA is set up to coordinate disaster response between federal, state, and local governments and private entities. State governments are always in the driver’s seat in disasters, backed up by federal resources.

So, that’s good, right? Well, only in the sense that abolishing FEMA is not an official Romney position. In effect, there is no Romney position on FEMA and disasters at all. Which is, in an era of mega-disasters, President Romney will quickly find not a good thing.

When I wrote a book about Hurricane Katrina and read various post-mortems of the terrible disaster response, one thing became clear: today’ disasters do not respect geographical boundaries. As the scale of a disaster grows, states cannot mount sufficient resources on their own to respond effectively. Nor can they coordinate amongst themselves and the hundreds of different entities trying to help. That is FEMA’s job. If FEMA does that job well, the disaster response will be effective.

But FEMA is an agency with a short history and relatively little bureaucratic power in the federal government. That means its performance depends heavily on the administration that happens to run the government at any given time. And sadly, Republicans have tended to treat FEMA with indifference, and the agency has stumbled. During the 1992 presidential campaign, FEMA’s plodding response to Hurricane Andrew undermined the campaign of President George H.W. Bush.

George W. Bush essentially treated the FEMA director’s position as a patronage slot, and then saw it stripped of resources as it was caught up in the messy, confusing government-wide reorganization that accompanied the creation of the Department of Homeland Security. There’s been some suggestion that FEMA would be a logical candidate for the chopping block in any Romney-Ryan mass discretionary budget cuts – but that, like other elements of the Romney plan, is impossible to pin down. Not that FEMA, with an annual budget of $14 billion, would save much money.

(The White House has suggested that FEMA might also lose $900 million in the automatic “sequester” cuts scheduled to take place later this year. That’s unlikely to happen. What will happen, though, we also don’t know.)

Democrats have been kinder to FEMA, naming professionals to run it. Bill Clinton appointed his emergency director from Arkansas, James Lee Witt, to run it, with solid results. Obama’s FEMA director, Craig Fugate, was previously Florida’s emergency chief, and has done some work to rebuild the agency’s tattered infrastructure and reputation – though there is still a ways to go.

Mitt Romney, the consummate organization man, should note this. Because all it takes is one huge disaster screw-up to wound a presidency.

For Obama to win re-election, the least complex route appears to be through maintaining his current lead in the four toss-up states in which his existing margins are widest, PA, MI, NV, and WI, together with OH where his lead has been hovering at a vulnerable 2.0% for the past few days. Doing so would bring his electoral vote total on Election Day to 271. In this scenario, Obama could still surpass 270 while failing to hold either IO or NH.

However, should Obama fail to hold OH, the loss could effectively be neutralized by any of the following combination of wins from states where FiveThirtyEight is currently predicting Obama victories:

Path #1: Obama loses OH but wins IO, NH, and CO resulting in 272 electoral votes.

Path #2: Obama loses OH but wins IO and VA resulting in 272 electoral votes.

Path #3: Obama loses OH but wins CO and VA resulting in 275 electoral votes.

However, regarding Path #1, there is some question as to the accuracy of the RCP polling numbers in NH which still include in their average a recent 'outlier' finding from UNH which had Obama leading by a questionable 9.0%.

For Romney to unseat Obama, he not only would have to hold the two states in which he presently leads, FL and NC, bringing his electoral vote total to 235, but also steal victories in CO where his lead fell from 0.4% on
Friday to that of dead heat, in VA where his lead fell from 1.0% on Saturday to another dead heat, and finally with OH where Obama's lead this morning is 1.9%. By so doing, Romney's electoral vote total would reach 275.

Should Romney take CO and VA but fail to take OH, he could overcome this shortfall by stealing WI and either IO or NH, resulting respectively in an electoral vote total of 273 or 271.

FiveThirtyEight, at present, estimates the chance of Election Day victory for each candidate as follows: Obama 72.9% - Romney 27.1%.

FiveThirtyEight also projects that on Election Day the final electoral tally will be as follows: Obama 295 -Romney 243.

Lastly, although it makes no difference in terms of the final result which can only be determined by the Electoral College, FiveThirtyEight also projects a national popular vote distribution on Election Day as follows: Obama 50.3% - Romney 48.8%.

With only 157 hours of campaigning left, this one may come down to the wire….and to the October jobs report which because of Hurricane Sandy may be delayed from a scheduled Friday release to the following Monday, one day before the election.

Let's hope that Election Day is free of both voter fraud and voter intimidation and that eligible voters who have registered in good faith over the past six months are in fact able to vote on November 6; let's also hope that vote tabulation itself is performed honestly and accurately by both the election commissions and private corporations to whom this essential role is being entrusted.

In any case, it will be interesting to watch as election night unfolds.

We LOVE President Obama.

I consider myself to be a moderate-liberal, and I take objection to this. I voted for Obama for 2012, but only because the sleezeball combination of Romney/Ryan makes me want to puke. Well, that and the "Party of God" known as the GOP.

Obama has a LOT to answer for in regards to Civil Liberties, among other things. Perhaps a second term would be better, perhaps not. However, after seeing the real facts behind Bain as well as how evasive both Romney and Ryan are when asked for specifics, I can't trust them any more than I trust Obama - therefore my vote goes to the evil I know, rather than the evil I don't.

I imagine the same might be said for a large number of Democrats as well, though obviously to a lesser or greater degree depending on the individual.

The bitter vile and vitrol spewed by both sides serves as a turn off to many - something that the parties ought to consider, but never will. The GOP is in a death spiral and trying to take the entire country with it, and the Dems can't seem to get a clear, consistent message.

    I agree we need cooperation, but with Obama it is a one way street. A week after being elected, he held a meeting with republicans, and when they gave him some of their thoughts and ideas, he hit them with his now famous, "Elections have consequences," speech, and his "take a seat in the back of the bus" rhetoric. So much for bipartisanship. It is up to the PRESIDENT to set the tone. Romney would meet frequently with democrats and give them a seat at the table. How do I know that? Because that's how he's governed in Massachusetts, where he had democrat majorities but still was able to get meaningful legislation done. Obama screams that everything has to be his way, and then when you don't like it, he accuses YOU of being an obstructionist. His act has worn thin with so many Americans.

      It seems this storm will hurt both candidates--the President cannot get to Colorado and Romney can't break through the storm coverage. Remember too that any suppressed turnout as a result of the storm benefits Romney.

      I expect the results of the storm to be a 'wash', that is, negligible in helping either candidate.

      The personal attacks of the previous posters are inane...perhaps the Republican panic button has been pushed?

          It really isn't so hard to research something before posting. In the event of an electoral tie, the House chooses the President, and the Senate chooses the VP. Until January 3, the Republicans control the House, and the Democrats control the Senate, therefore it's safe to say that the Republicans would choose Romney.

                                  Pauletta Vaughn - Rachel Maddow put the video up last night as well. She also played quite possibly the last ads for the campaigns with Romney's ending with the lie about the "Italian" jeep maker sending jobs to China.

                                  Everyone knows, and I'm positive that those in Detroit know as well, that the parts of all vehicles are manufactured among many different countries. ABC reports that 78% of Jeep parts are made in America. I own a Wrangler. It's an emblem of American culture. It's not going anywhere. But I also know that a lot of it's electronics are from European countries and Canada. Romney is just an outright liar. I wish more people would be more rational instead falling for such trash talk.

                                  The Obama administration saved the American auto industry. I proudly own an American vehicle. At least better than half. I wonder what cars Romney drives and what countries they were manufactured in? The Cayman Islands? Germany?

                                    jason -- interesting that you do not care about rasmussen polling. yes rasmussen does appear on fox regularly, a good question may be why the left leaning media do not ask him to appear. a review of the accuracy of the 2008 polling showed this:

                                    Costas Panagopoulos of Fordham University, surveying 23 polling organizations, prepared a list showing which organizations were most accurate in their final poll before the 2008 election.

                                    Two — Rasmussen Reports and the Pew Research Center — got the result dead right, Panagopoulos says. Of the other 21, 17 over-estimated support for Barack Obama, while just four said John McCain would receive a larger percentage of the vote than he actually did.

                                    The big media organizations almost universally failed to give readers a final accurate prediction, with Newsweek coming in dead last, just behind polls for CBS/New York Times; Reuters/C-Span/Zogby and Gallup.

                                    Polls carried out for Fox, NBC, ABC, the Washington Post, and Wall Street Journal were also all in the bottom half of Panagopoulos’ study.

                                    Like I said before if Rasmussen was so accurate then why was his numbers off so bad in 2008. He predicted Mccain was going to win OH, FL, VA. You know why his numbers was off because they aint no Poll out there that is going to tell you how many VOTERS are going to show up and vote on election day. Heavy turn out wsa why Rasmussen Poll was not accurate.

                                              I seriously doubt any voters will be denied a chance to vote, even if they have to resort to manual ballots and make-shift polling places. Serious voters will find a way. Unfortunately for Obama, most of his base are not self-motivators.

                                                Most serious voters who want Obama gone, conservatives and angry independents, have already voted. Most of remaining voters are the 47%. They're not that excited about Obama to start with. Having to salvage belongings and seek alternative shelter won't help the 47% turnout.

                                                    If Rasmussen Poll was so accurate then what happen in 2008. Rasmussen didn't have Obama leading in most swing states, he had Mccain leading in OH, FL, VA and Tied in PA. What happen, Obama won all 4, I repeat, all 4 states and won them Huge.
