Romney: Bain under investigation for tax avoidance

“New York’s attorney general is investigating whether executives at Bain Capital, the private equity firm founded by Republican presidential nominee Mitt Romney, improperly avoided paying $200 million in federal income taxes, according to a report by The New York Times,” per the Boston Globe. “More than a dozen firms are under investigation by the attorney general, Eric T. Schneiderman, who has subpoenaed documents that would show whether some fund management fees were converted to fund investments. Profits on investments are taxed at a much lower rate than management fees, which count as earned income.”

The Wall Street Journal editorial page, via Political Wire: "The immediate media consensus, especially on the political right, seems to be that Mitt Romney 'did what he had to do' in his GOP convention speech Thursday. He repaired an image battered by Obama attack ads, showed he appreciates women, defended Bain Capital and criticized President Obama more in sorrow than in anger. On to the White House! Well, maybe. Mr. Romney's speech did hit all of those essential points, but the one thing it didn't do constitutes a major political gamble. Neither he nor the entire GOP convention made a case for his economic policy agenda. He and Paul Ryan promised to help the middle class, but they never explained other than in passing how they would do it.”

About 30 million tuned into Romney’s speech, down from 39 million who watched McCain’s four years ago, per Nielsen (via Political Wire).

The Romney campaign put out a 2:34 wrap video of its convention.

Paul Ryan’s in trouble with the fact again – this time over claiming that he ran a sub-three-hour marathon. “Under three, high twos. I had a two hour and fifty-something,” he told conservative radio host Hugh Hewitt. That drew skepticism from the running community and Ryan had to admit that was false. He said in a statement, per the New York Times: “The race was more than 20 years ago, but my brother Tobin — who ran Boston last year — reminds me that he is the owner of the fastest marathon in the family and has never himself ran a sub-three. If I were to do any rounding, it would certainly be to four hours, not three. He gave me a good ribbing over this at dinner tonight.”

Well, well, well. More than a dozen firms, including Bain Capital, under investigation by Schneiderman; good for him. No wonder Mr. Mitt Romney refuses to release his tax returns. The "ammunition" Mrs. Romney spoke about could well be Bain Capital; if Bain evaded taxes, it is highly likely Mitt did as well.

in your manner of reasoning if someone in your family does drugs then you are also guilty. Foolish ! Romney's tax returns have been vetted by the IRS and there wasn't a problem. In the corporate world taxes are handled by the accounting departments and CPA s. I have run a couple of corporations and had to basically trust the accountants as I did not have full knowledge of the tax laws. That was the reason I paid them. If they made a mistake I paid the penalty and they lost their jobs. Other than that I had really no involvement in the filings.

no doubt you're right Jody. Those who have nothing to hide, dont hide anything. Romney is just another con man trying to con the American people. I watch his body lanquage when he speaks and I think "he is not telling me the truth". He twists the facts to meet his agenda of the moment. His positions on things that matter change with who he is talking to. Bain capital is not in business to help people. They are in business to extract money from those around them. Romney did an excellent job of doing so, then hid that money in offshore accounts, and this is who the GOP wants to put in office? Romney and Ryan can go to ****.

Don't let these Vultures get away with murder - outsourcing and killing jobs, and evading taxes, killing social programs that need every cent of taxes.

Tax evasion...huh...no wonder social security and medicare are out of money....I can't believe those guilty actually use the crisis to argue for 'End Medicare as we know it.'

Vageorge, if there is no problem with Romney's taxes, then why doesn't he release them, as other candidates, including his own father, have done? His dad released 12 years of returns when he ran for president. Because Romney refuses to release even one full year (part of 2011 is missing), it looks like he's hiding something. Even conservatives are calling for him to release them. If he has nothing to hide, it's an unnecessary distraction to his campaign. The possible tax issues with Bain just add to this narrative. And Romney was retained as CEO, drawing a salary, until 2002, another fact he tried to hide.

You know what really pisses me off?

I as responsible American citizen have done my legal and financial obligation to my country by filing paying my taxes on time. Now Romney has the gall to file an extension for 2011,its not like he is doing them himself having to fill out hundreds of pages for tax loopholes and write offs, we don’t even know if he did his 2009 or 2008 taxes there not listed on his web site as being done. Why is it that Rmoney is not even responsible enough to file his taxes on time? A person with this
irresponsible nature should not be running our country. Doing your taxes on time is the most basic responsibility of every American.

Financial Disclosures ??? Nothing about him paying his taxes, but no financial disclosure
from 2008 and 2009. What happened in 2008 and 2009? Are these the years he
applied for amnesty because he committed fraud or did not pay any taxes? I’ll
guess the American public will never get full disclosure from Mitt.

            Tax EVASION is one of those thing for which there is NO statute of limitations. All tax returns are signed by a company CEO, President, or the sole shareholder. Since Myth Robme was all of that for many years, he is responsible for the company's actions.

That is what the CPA s are paid to do and they make mistakes at times also. Criminal charges only occur if the CEO knowingly directs the preparation of false returns.

            How many whether Democrat or Republican have had to pay the IRS after an audit? Many have I know I have and there was no intent involved.

            Now why does obama refuse to reveal any of his history yet demands that Romney show all?

            vageorge: so, you are saying that as CEO, President, Founder and sole shareholder, Myth Robme would not be responsible for the tax returns he signs and swears to under penalties of perjury ? (I assume as CEO/President he would sign, although the VP/Treasurer or someone else might sign)

            None-the-less, I find it extremely difficult to believe that a person who has manipulated his personal finances so that he pays less than 15% federal income tax on millions of dollars of income would not be aware of the finances of the company he founded and controlled for years, the same company from which his personal wealth was (and still is) mainly funded.

            The lies continue. Only when you lie on your tax returns, they call it tax evasion.

            Do you know the difference between tax avoidance and tax evasion ?

            Tax avoidance gets you a 15-20% tax rate.

            Tax evasion will get you 15-20 years.

However, every Presidential candidate in modern history has released at least 5 years of tax returns. Mitt's father released 12 years.

            A tax problem is newsworthy when a person or company EVADES taxes so what is the point of this article other than the usual media smear.

            Everyone who reads this article tries to pay as little in taxes as possible, taking advantage of LEGAL deductions. The problem, according to the article, is that the income may have been misclassified, leading to illegal tax savings. Romney is not just anybody--he is running for president of the United States. He is asking for our trust. He has told us that he has paid what he owes in taxes (though he has shown us very little evidence of that). The rest of us average joes pay a higher percentage on what we earn than he does (according to the one return he has bothered to show us), which is irksome, but if he also used illegal methods to avoid paying what he owes (in his personal life and/or in his company), then we deserve to know about it.

            I, for one, am looking forward to this week's convention like a breath of fresh air. I also can't wait for the debates. I want to hear Romney try to dodge questions about his record at Bain, as governor, as head of the Olympics, etc. I want to hear him try to answer--specifically--about his plans for economy, his foreign policy (he completely avoided this during is nomination speech), health care (also avoided), etc. He is the king of avoiding any specific answer on anything. HE is the empty seat in the room.

              NBC and other media sources should show some decency in their reporting. Romney left Bain years ago and was not the only honcho while he was there. This would be like you were at a bank and it was robbed a year later. Why would you be guilty? Romney's tax returns have been vetted by the IRS and nothing was out of order. Now if the NBC reporters want to support obama let them vote in November but should only report the facts as there are many that still trust the media to be truthful.               In fact I do possess morals. I do not lie in any way. I have the knowledge that the IRS has vetted Romney's tax returns as a result of association with many in DC. Unlike the Democrat rhetoric that you spew I do my research. One point I would like to make is that I am not a Republican but I do support Romney in this campaign as all faith in obama is lost . As an Independent I choose which candidates I feel will do the best job for our country.               Tax avoidance has always been legal. Last night my wife wanted a Dairy Queen Blizzard while I got a half gallon of ice cream at the grocery store for the same price. Her dessert was taxed 9.8%, but mine was taxed only 2.2%, so I legally avoided paying 7.6% in sales tax.                   Lies and smears. The tax probe is being conducted out of the New York Attorney General's Taxpayer Protection Bureau, which was set up in early 2011. The agency was established "to root out fraud and return money illegally stolen from New York taxpayers at no additional cost to the state," according to the AG's website. The attorney general’s office does not have the power to enforce federal tax laws.

                  The tax strategy in question is a process known as “management fee waiver” whereby executives could take money that would have been paid to them for managing investment funds and put the money into the funds, instead. The executives could pick and choose which companies to invest in, within a given fund, and were not required to invest the value of their fees for the entire life of a fund. They could decide whether to convert fees to investments on a quarter-to-quarter basis. The benefit for the investor is recouping its fee, while the fund manager gets extra incentive to make the fund perform well but is also taxed less on this money. The risk to the fund manager is having the value of the fund diminish, and coming away with less than was put in.

                  Despite the assertions of some, the Internal Revenue Service has so far not banned such a practice, which some private equity fund managers argue is done to align their interests more with those of their investors rather than to reduce taxes.

                  The Democratic Party is making a serious mistake by not insisting that Romney should play by the same rules as all presidential candidates. His arrogance in refusing to release his tax returns speaks to his belief that he is different from other candidates and entitled to preferential treatment. This says a lot about his contempt for precedence and for the electorate. Romney’s refusal to release his tax returns indicates that he has indulged in some tax shenanigans. He is therefore choosing to be held in suspicion than to be revealed as a tax cheat. The Democratic Party has a responsibility to the electorate to insist that Romney adheres to the requirements for anyone who aspires to be president.

                            Are you sure you are not mixing things up with the party of the farting elephant?

                            Did the Republicans ever find those WMD .. or the ties to 911 .. Has any of that trickle down .. ever trickle down?

                            Does anyone believe that liar Romney that he won't try to limit abortions even to women that are rapped? He says he won't .. but there it is in his parties platform. It would be congress that would do that anyway.

                            It must be a sad day for Republicans. They may try to point a finger at Obama saying he and his party are the liars .. but .. really isn't that way now is it.

                            No one knows where Romney stands on any key issue. He changes day to day. It's bad enough that Republicans trust this man ... But how can they ask the rest of us to believe a man that is on record being on both sides of any issue.

                              They don't trust him. They trust any republican. Don't you see. They really don't care anything about getting this country back on its feet. If the GOP did, they would offer us a republican candidate we could actually consider. He would be clear on his political agenda. He would lead by example and pay his share of taxes. He would be clear on the issues that affect the american people and he would not be trying to sell us a dream. I'm open. I just want a government that works. Go ahead convince me! I am a Dem, but I am willing to listen.

                                So let me get this in perspective. Obama lapdogs (WaPo and NY Times) are reporging that Eric Holder's organization is investigating Obama's competitor for the Presidency. Given the lack of ethics shown by Obama thus far and how poor his record is this smells of total desperation.

                                The sad part is this author is completely out of their element much like Obama. They somehow have confused tax avoidance which is completely legal with tax evasion is what is illegal.

                                These desperate zealots don't realize that this election is about the economy and no distractions they manufacture will be enough to cover Obama's utter and complete failure. Worse is this election is pointing out how much harm Obama has caused and how big a hypocrit he continues to be.

                                Try again, daddy-o. Its the New York State Attorney General that is spearheading this investigation, not Holder's Justice Department.                                   I agree with you that this election is about the economy. So tell me, when is Romney going to give us exact details on his agenda for improving the economy. Oh I get it, he is keeping that as secret as his taxes.

                                    I really don't think Romney is withholding his tax returns due to paying very little tax or sending his money to offshore tax havens. Although both are 100% true.

                                    I think he won't show them due to voting in a different place then reported on his tax frorms as his residence.

                                      One question. When? What dates are they investigating Bain for not paying taxes? Was it before or after Romney left? Not one mention in this article. Before you attack, I'm a registered Democrat and not anti-Obama. I am anti misleading and sloppy reporting which happens on both sides and seems to be the norm nowadays.

Business owners like you and Romney seem to be able to blame everyone but yourselves when problems arise in your businesses, but when it comes to proclaiming how well you did and the fact you own your own business, there is no end to the crowing!
