GOP prepares to file lawsuit against Holder

 

House Republicans will file a civil suit against Attorney General Eric Holder during the August recess, House Oversight Committee Chairman Darrell Issa, R-Calif., has told NBC News.

House Republicans will file suit in an effort to compel Holder to release documents associated with the failed "Fast and Furious" gun-walking operation.

"We'll be filing a civil case during the break," Issa told NBC, "We will expect a day in court before a federal judge, which we have a 100 percent chance that the judge will hold that these documents should be delivered."

House Oversight Committee Chairman Darrell Issa has told NBC News that House Republicans will file a civil suit against Attorney General Eric Holder. NBC's Pete Williams reports.

During negotiations between House Republicans and Holder in June, the White House invoked executive privilege on the documents Issa had requested for his investigation. Issa says that a federal judge should find that executive privilege does not apply to the documents he is requesting.

"The idea that you would withhold based on some executive privilege the documents related to a cover up of a crime is absurd, but that's the claim that the attorney general is hiding behind," Issa said.

The House voted on June 28th, 255-67, to hold Holder in contempt of Congress for not turning over documents related to the Fast and Furious operation. During that vote, the vast majority of Democrats walked off the floor of the House in protest of a measure they saw as a political witch hunt.

Soon after the House found Holder in contempt of Congress, the Justice Department penned a letter to House Republicans saying it would not be pursuing the case, stating that "the attorney general's response to the subpoena issued by the Committee on Oversight and Government Reform does not constitute a crime." The DOJ cited the White House invoking executive privilege as a primary reason for not proceeding.

The DOJ's response has left Republicans with few options, according to Issa, who compared the current situation with congressional attempts to retrieve the Nixon tapes during their investigation into the Watergate scandal in the 1970s.

"We're seeking a remedy and the remedy is an order to compel," Issa said. "Nixon didn't respond to Congress, he responded to federal judges, ultimately the Supreme Court, ordering that he had no such privilege to cover up the tapes. And these are no different than the Nixon tapes, we're asking for documents related to a cover up of lying to Congress."

They don't have time to provide a plan on helping the economy, but they sure did find time to try to attack the President's administration yet again. I think they know they don't have a leg to stand on, this is what you call a stall tactic in order to gain votes, and make it appear that they really give a hoot about F & F, and the boarder patrol agaent that was killed, when they did everything they could to cover up Tillman's death by friendly forces.       Talking about who doesn't have time to work on the economy look at your President. He has been in office for four years and has done nothing to help the economy. Everything he has done (mostly talk) has made matters worse. His ultimate solution? Raise taxes on everybody and we all know how that works! If Obama is guilty of a crime then Congress is right to pursue this matter. Why did Obama want to sell guns to criminals in the first place, is that going to help the economy?

            Obama and Holder want to with hold documents that could lead to the President being impeached but Obama is whining about Romney releasing tax returns? There must be a lot of stupid people in this administration. In the end it is the American people who will decide, but I as an American am really not interested in tax returns when, in realty this Administration is gun happy and kills people, and they don't want people to know.

            If you sell a gun to a known criminal and he/she kills with that weapon guess who gets charged with murder. In this case they don't want it to be the President.

            First : If holder gives up the docs he would be guilty of interfering with a pending investigation. If he doesn't he is accused of contempt of congress.

            Second: Impeachment? Based on what? It is perfectly leaglel to use ex. privelege as president.

            Third: If you are not interested in the tax returns your in the minority (check the polls).

            Fourth These guns were not sold to known criminals. They were sold legally, and then transferred to a third party. Read up on the various reports and articles on the subject

              No. Exchange Romney's tax returns for Odumbas college transcripts and all other education documents, such as all admissions applications, papers he wrote, classes he took, and financial aid he received.

              You will find that he received aid for foreign students, that he listed himself as Kenyan, and that his writings had a communist tilt to them.

              The only reason Odumba has to hide them is they would prove he is liar and that he committed fraud.

                  Why do we continue to play this game with the Mexican cartels? Pick up the phone, call the Mexican prez. Tell him he has six hours to engage across the border region with the US or on the seventh our we will engage. Kill every living creature within 100 miles of our border with Mexico and continue to eradicate anyone entering the buffer zone. Yes, innocents will die. Eggs and omelets come to mind. Close all ports to vessels leaving Mexico for the US. Eliminate air travel between Mexico and the US. Stop all oil purchase from them ~ use our own which we are exporting. We have the technology to accomplish this and never set an American boot on Mexican soil. Hell, we are bombing Pakistan on a regular basis with no troops in-country. The reason we are not engaged more forcefully in this border war with drug cartels is money. Someone, somewhere is getting handsomely paid to continue the status quo. The first person in the US who objects to this proposal ~ shoot the sumbich. He's probably the one getting paid.

This does feel like a political hunt and just feels like hot air coming out of them. Go do something more productive! In the past both Democratic and Republican presidents have ALWAYS cited or used presidential confidentiality.                           Talk about Romney hiding things, this Obama adminstration is the worst. The Republicans have a better than half of a chance in winning both the white house and command of the Senate.
