Justice Department won't pursue case against Holder

 

Updated 4:!6 p.m. - As expected, the Justice has informed Congress that the U.S. attorney will not prosecute Attorney General Eric Holder for contempt, despite Thursday's House vote.

"The longstanding position of the Department of Justice has been and remains that we will not prosecute an executive branch official under the contempt of Congress statute for withholding subpoenaed documents pursuant to a presidential assertion of executive privilege," says Deputy Attorney General James Cole in a letter to the House speaker, John Boehner.

The letter notes that during the Reagan administration, DOJ took the position that the contempt statute could not constitutionally be applied to an official who asserts the president's claim of executive privilege. That policy was first articulated in a memo written by Ted Olson when he was at DOJ in 1984. 

Cole writes that the position has been asserted several times since then, most recently during the Bush administration in 2008.

He concludes by saying that the Justice Department has determined that Holder's response to the House committee subpoena "does not constitute a crime" and the Department will not refer the matter to a grand jury "or take any other action to prosecute the attorney general."

Holder had a chance to clear his name, but instead he chose the cowards way out. All this does is add fuel to the fire that he is guilty of lying to congress and every one else in the country. If Odumba had any brains he would get rid of Holder , but if he did that Holder might decide to tell the whole truth.

The Attorney General is the supervisor of the man deciding whether to move against the AG; every subordinate knows not to agree to investigate or move against the boss.     I am very disappointed in this decision. While the Ideologues crow on both sides everyone seems to be forgetting something.

    Unlike Watergate, the Lewinsky Scandal, FileGate, and anything else that has happened in the recent past of this country there is a fundamental difference between 'this' scandal and the others. That difference is 300 dead innocent Mexican Citizens, that we know of, and at least one American Border Patrol Agent.

    That's a huge difference and an entirely different line to cross. Scores of people literally died because of this program, perpetrated by our government. You cannot and do not ignore this. But in our hyper partisan world it appears that human life has a negligible value over whatever letter comes after your name, be it D or R.

    So our government purposefully allows guns to cross into Mexico to the drug lords and you do not think anyone should investigate why on earth we would do this?     The decision to not prosecute Holder isn't particularly surprising, given that, in his capacity as attorney general, Holder leads the U.S. Justice Department.

    I find this line interesting. Just a few months ago you would never find it here. MSNBC continues to surprise me. They never printed anything negative about Obama or his administration before. Wonder if they feel the Change coming too.

    What I don't understand is the following, Holder has been in front of congress multiple times for this investigation and has not answered the question and has given false or misleading answers that he would later send letter to answer.

    If he was a normal citizen would he still be walking freely in the USA? As a democrat I want the truth to the questions and let the pieces fall where they may. And if that means the it Holder or anybody else did anything wrong they should be held accountable.

    The ATF & DOJ did not sell the guns & walk them to Mexico - a LEGAL gun dealer in Arizona sold them LEGALLY to a buyer in Arizona who resold them . . all LEGAL in Arizona. The ATF was following these transactions to try to locate drug dealers/etc. How can ATF or DOJ prosecute something that is not a crime under Arizona or US law? Either laws have to be passed to control the sale & resale of guns or people have to accept these transactions.

    This is the most intelligent thing I've seen posted on these boards in a while. Most of these other political "scandals & controversies" referred to above were simply embarrasing. They didn't cause anyone to die due to wrong decision making. But this program, under Holder's watch (& possibly under the prior administration's watch so they shouldn't get a pass either), caused the death of at least one U.S. law enforement officer and scores of Mexican citizens. Those are facts. Anyone and everyone who had anything to do with this program, regardless of whether they were in this admin. or the prior admin. should be investigated and prosecuted. To hell with all of the D & R politics...what is right is right. All documentation should be turned over for investigation.

    The only incidence that rises to this level of seriousness that comes to my mind would have been the Iran/Contra controversy. Weapon sales were involved in that situation as well. What happened? People within the Reagan administration WERE prosecuted. It should be the same here.

    What is the big deal? This border agent had a dangerous job and he knew that...I think it was a good idea...What idea would you have to catch them????? I think they should continue this operation...We need to catch them somehow...It isn't much different than undercover agents using drugs and selling them to dealers and then arresting them...Sometimes agents die,which is regrettable...What is more regrettable is this agent probably had nothing to do with the operation...And the GOP released all of the information they have from the operation,I thought this was the party crying about leaks of sensitive information......It was okay I guess when bush was doing this while breaking every agreement in the Geneva convention also at the same time in gitmo??????

    Apparently AG Holder didn't care, nor other Government Officials. They never got a call from anyone, with condolences/or apologies.

    This is what was at the Heart of the Fast and Furious Program--he was killed by the Government's irresponsibility of letting 20,000 US guns go to the Drug Cartel. No tracking of the weapons.

    The first known ATF "gunwalking" operation to Mexican drug cartels, named Operation Wide Receiver, began in early 2006 and ran into late 2007. In March he was hired as a confidential informant working with the ATF's Tucson office, part of their Phoenix, Arizona field division. With the use of surveillance equipment, ATF agents monitored additional sales by Detty to straw purchasers. With assurance from ATF "that Mexican officials would be conducting surveillance or interdictions when guns got to the other side of the border", Detty would sell a total of about 450 guns during the operation.[25] These included AR-15s, semi-automatic AK-pattern rifles, and Colt .38s.     At the time, under the Bush administration Department of Justice (DOJ), no arrests or indictments were made.     It is so clear and obvious this has been a witch hunt to get back at Holder for interfering with the crimes of voter surpression by so many state governors, all Republicans, that know they will lose the 2012 election big time for their terrible record in congress and in the halls of state capitals.

    For you guys that buy the crap about massive voter ftaud, do your home work unless you are afraid what you will find. The actual fraudulent voting is so tiny as to be almost non existant. This is the same kind of lies as "Iraq has weapons of mass destructions" or, "Iraqi oil will pay for the war".

    If the Republicans in congress wanted to know about the weapons deal, why didn't they ask any of those that began the operation during the Bush administration? Even then it was a well intentioned plan that didn't work.     1. You have no sense of history or how things work. You've never learned that every time this stuff has been tried, it has ended BADLY. All your information comes from the box in your living room. In other words, you're just ignorant to the world around you and support this guy because it's the fashionable thing to do.

    2. You know in your heart that this clown is causing huge, irreparable damage to the country, but don't care. You are greedy and you know you can have free stuff; education, food stamps, health care, mortgage and debts forgiven, maybe a government job doing nothing. The fact that the future of the country will be mortgaged to the Chinese or that someone else will have to pay for this, is of little concern.

    3. You are as corrupt and evil, arrogant and smug as your hero, the Dear Leader. You believe in Socialism and that big government can do everything better than the private sector. You hate America, the principles it was founded on, and you care nothing for the blood, hard work and sacrifice that made America great. You view the Constitution as an outdated relic to be ignored and tossed aside or "interpreted" to mean whatever you want it to say. You are a progressive who favors tearing down the nation and rebuilding it as some kind of Utopia where everyone is cared for.

    Regardless which one you are, the fact that there are so many of you, causes me to be pessimistic about the future of this Nation. I have met great men, heroes who parachuted into Normandy, flew B-17s over Germany, fought the Chinese in Korea and the radical Muslims in crapholes around the world.       ATF agents were TRYING to put a stop to guns going to Mexico because of lax NRA gun laws in Arizona.

      When ATF agents documented guns going to Mexico, and tried to get the prosecters to make arrest warrants the prosecuters told them it was not against the law in Arizona to do this.

      The gun list documented by ATF showed two guns that ended up near the murder scene of the killed agent.

      Arizona laws protect the gun runner who bought the guns legally and allowed them to go to Mexico.

      Blame the NRA, that's why the NRA is making up stories against ATF and the president. NRA is guilty. It is a big business selling guns to anybody.

      Issa knows this story but is not trying to solve a murder, he is going for other records that don't apply to this case. Trying to find something on Holder or anyone like repubs did to Clinton.

        So who is going to be 'taxed' because of Obamacare?

        The answer, according to Obama, is about 30 million people from the Middle Class who do not currently have health insurance but will be required to buy it now. It's not the 'poor' because they qualify for free Medicaid - at taxpayer expense. It's not the 'rich' because they already have insurance - so who's left? The Middle Class. Show me where I'm wrong - if you can.

        Now consider the 'real life' issue. Obama says that these 30 million people will now be required to purchase health insurance, and they are typically those in the lower Middle Class income class that are struggling to make ends meet. If a family of 4 is struggling on an income of $30,000 per year (about $2,000 per month after payroll taxes) and must now spend $10,000 per year on medical insurance (estimated cost for a family of 4), where's it going to come from? They simply cannot afford it, so now they will have to go without insurance AND be fined (about $400 in the first year, and about $2,800 in the third year).

        The ironic part is that the people who will be fined (taxed) will be the very same group that voted overwhelmingly for Obama in 2008 - I guess that's what some might call 'retribution'.

        By the way – the cost of Obamacare has now ballooned to $1.76 Trillion over 10 years (and rising), according to the non-partisan Congressional Budget Office (CBO) – the link is below;

As you will notice, the baseline assumptions, and they always will be assumptions, will have the Federal deficit reduced to 53% of Gross Domestic Product in the future, if current law is sustained, from a high of 76% today. That is progress, with the HealthCare expense. Stop looking at the short sided story, and become a real conservative who looks long term, and is not reactionary with the present.

Same can be said for those without life insurance or fire or car, and risk economic catastrophe for the supposed savings.

          In our community we seem to always have a charitable fund for someone who has been stricken by accident or ill-health, and their insurance will not be enough or they had none. Can you speak of those as well as those who may pay a penalty in the same terms?

          The decision to not prosecute Holder isn't particularly surprising, given that, in his capacity as attorney general, Holder leads the U.S. Justice Department.

          I find this line interesting. Just a few months ago you would never find it here. MSNBC continues to surprise me. They never printed anything negative about Obama or his administration before. Wonder if they feel the Change coming too.

          While in some places it may seem reasonable to charge your boss with a crime, I can see how the DOJ might not be so eager to file charges against their Director. If those charges were not to pan out they'd definately be out of work, if they stuck then they'd likely be branded by partisans as well. It is DC after all.

          Not sure if you saw it, but an item was released to the press today that clearly indicates that the wiretap requests were seen and approved by the Associate Directors of the DOJ, they tell of the techniques used, that money was spent on purchasing guns for the program, and that they let the guns go without intercepting them or tracking them. Looks like some holes in the DOJ's story. A lot of knowledge is there, just let it come out. Hey Wickileaks, how about you get involved and drop some bombs on this one??

          So it's going to come down to a civil suit against Holder. The biggest problem with that is that it further divides a divided government and the truth just keeps getting supressed. I feel sorry for the family of Brian Terry.

          Okay, let's look at this like logical, rational human beings (I know that's hard for some of you, but bear with me). As pointed out, the executive priviledge claim has been used by many presidents of both parties, and has been upheld each time. However, every time it's used, the other side of the aisle rants and raves while the side that used it tries to play everything off as partisan character assassination; the same thing going on here. Regardless, the laws on executive priviledge are clear; Holder doesn't have to turn over the documents, and he doesn't have to say why.

          As for the "corruption" accusations and the conspiracy theorists; the ATF *wanted* to arrest the straw-purchasers the whole time, but kept getting rebuffed by the prosecutors in the state. That's right, Arizona state prosecutors told the ATF that even though they knew that the guns were straw purchases that were going to Mexico, there was nothing that could be done because they were perfectly legal under Arizona law. There is no conspiracy here to hide any sort of anti-gun agenda. If anything, there was a conspiracy on the right to ensure that the program failed so they could blame it on Obama, but I don't even think that's particularly likely.

            They didn't wait over 18 mos to claim Executive Privilege. One has to ask, why Pres Obama has waited 18mos? Is it political? Or is he actually hiding something? Who knows, since they are stonewalling.

            As for Bush, no one died before he claimed Executive Privilege. The reason he claimed Exe Priv, again right away, is that he did not want Rove or Cheney to go before the Committee which is public. He made arrangements for them to meet with them, swear them in under oath and question them in private in the Oval office. He wasn't trying to protect information, just how the information was received since some of the info was classified. Most libs wouldn't agree, but Bush is as honest as they come and unlike pres before him, he didn't issue a pardon for the individual who was found to be the one that leaked the information.

            Reagan, on Contra and like today I think it was just as wrong. But he invoked it right away. He should have had everyone testify, release the documents and get it over with. In the end the truth came out just as it will on this. In the end 14 persons were charged with criminal offenses and eleven persons were convicted. But in the mean time they all wasted a lot of time & money.

            There really isn't much difference between this and Contra. Anyone with any sense can see that there is a cover up if they have been watching the testimony for the past two years. For God Sake, people died from this operation. Are lives worth that little to those that think this is a witch hunt?

                  Problems with phoney republican "dog and poney shows" represented as legitimate investigations are always the same. The lead conductor is always a criminal, and that goddamn party always has plenty of dogs, (mostly the more ugly breeds) but they never are able to obtain and hold a like number of ponies. Additionally, they most always end up getting kicked in their heads by an ill tempered pony, or severely bitten in their asses by some knowing dog, both, the results of angry animals who feel ill used. Damn fools! Looks like they would finally learn better.

Our wonderful congress passed a law restricting the Ecexutive Branch from supporting the armed revolution to take it back, which they eventually did, and implemented and uneasy democracy, which has now stabilized the country and region from the Marxists. And by the way, Ollie was investigated and prosecuted for violating a questionable law passed by our then leftist congress, the Democrats, who are anything but democratic. After all, it they who are trying to restrict any speech other than thier own, pass laws that that the majority of people in the US don't want (Obamacare), gut the second amendment (take away your gun rights), constantly challenge the first amendment religous freedom, take away your dominion over your property (most EPA rulings), take away your freedom of choice (support laws forcing you to join unions), don't think killing babies in the womb is murder (or even objectionable), thinks it their right to take your money becuase they think you have too much, and the list goes on, and on, and on.

So, if they can produce PROOF that this is in any way, shape or for, is actually Bush's fault, why not release it? After all, that would be the "transparent" thing to do.

                              Why can't you see that this move was purely political in nature. If the report is correct then this ploy has been used by both Democrat and Republican administrations. It appears that when such move has been made then the response has been the same no matter which party has been in "power". I am certain that Issa was aware of what DOJ's response would be before he pushed the issue. It would be much better for our country if more people would look at issue critically rather than emotionally before making a decision.                                       When will the day come in America that there will be a common goal, between all Americans? The foundations of this country are based on a moral code that is no longer in place. The idea that a handout is better or a free lunch is what your government can give is no longer valid. The government is and was designed to offer our nation FREEDOM. Our government was not based on what it can do for us, but what we can do for it. We the people should ALL vote in this next and ever election and we should bring forth candidates that have the moral purity and a righteousness that is beyond reproach. We should all elect people that know and understand how a business (government) should be ran and get our financial instability and debt in order and become a debt free nation. People that will make laws that are based on the needs of the people with their input and best interest at heart. If they fail to do so, they are voted out. Corruption in our government and big business should be tracked down, rooted out, and all held accountable. We should be ONE nation under God and we have not been this for a long time. We have believed that our government was doing the "right" things for us for too many years, it is not about what party did it, each and everyone of us should accept personal responsibility for where we are and each one of us needs to stand up, in one voice and unite together to take our country back!!!                                             If the Civil Judge finds Holder in contempt and if Holder is convicted of a crime, he loses his license to practice law. Not even a pardon will save that if he's convicted of a crime before the pardon is invoked.

It's not the criminal prosecution that's important, simultaneous with this the house passed H.Res706, which authorized House General Counsel to challenge the Pressidents assertion of Executive privellidge in federal court, just like in the Nixon case.... In every sting from time to time you lose something like money or equipment and some times it works great and you lose nothing. Bush Administration. Among other things, they uncovered that no illegal gun walking was involved and the ATF gave no guns to any Mexican criminals. That false assumption is a FOX NEWS MYTH. Now, the issue will go civilly (per the Terry Family) before a judge in a lawsuit. The controversy is about the refusal of the administration to hand over documents the Republicans are fishing for.

The Supreme Court ruled on the health plan, the Stolen Valor law (yay for free speech), life without parole sentences for juveniles, and the Arizona immigration law.                                                           Interesting that I see a lot of conservative outrage over the death of an American agent in this "operation"--someone's child of course. But where is the outrage over all of the people killed in Afghanistan and Iraq? Many Americans were also killed or injured as a result of those wars of choice. All of the people killed or maimed in these wars of choice were/are someone's children. Is there some reason that one is somehow more worthy of outrage than all of those killed/maimed? Bottom line is that if these documents implicated, IN ANY WAY, the prevoius administration in this tragic event it they would have been turned over and highlighted for reference. The MSM would have ran with it 24/7 for a week or more. Hollywood would have made a "Made for TV" movie bashing Bush and the guns rights advocates. More then double Bush's Debt in half the time. He complained about Gitmo, (still there), and No new taxes for the people making less then 250K a year (the Obamacare's new taxes (which are the largest in history) blow that promice out of the water. And that is not counting all the taxes comming back on Jan first. Including the 55% death tax. I think Liberals will have an easy choice to make.

                                                              If you are referring to Operation Wide Receiver, then you are mistaken. Wide Receiver placed tracking devices on every firearm that was sold to an ILLEGAL GUN DEALER. It was on a much smaller scale and was actually scrapped by the Bush administration once it was determined it was bad police tactics.

                                                              Fast and Furious was on a much larger scale (I think 1200 guns in total). In F&F, agents allegedly (we do not know since Holder is hiding something) gave guns to legal gun dealers and told them to sell them to shady individuals. On the surface this seems to be a similar program. The catch is that the agents that gave these firearms to these legal gun dealers were told to get rid of them to any shady individual that wanted them. No questions asked and they did not even track the illegal firearms with tracking devices.

                                                              Now the conspiracy theorists (not totally on board with them, but usually where there is smoke there is fire) think that the whole goal of the DOJ was to have the legal gun dealers sell these firearms to people that were smuggling firearms into Northern Mexico. These firearms would appear a crime scenes in Mexico, and then this would give the DOJ more justification for broader gun control.

                                                              IF this is true that is absolutely despicable.

                                                              I think Holder has a duty to disclose everything related to F&F. Instead he is more concerned that AZ is trying to enforce the law that he chooses to ignore.

Some notable differences between that program and "fast and the furious" 1.)All the guns in wide receiver had tracking devices in them so they could be recovered, and more importantly, 2)wide receiver was immediately shutdown when one of the agents suggested they could not assure justice 100% of the guns would be recovered. Both those things didn't happen in this case, In fact several agents claim they were blackballed for even suggesting the program was flawed early on.

                                                                After a while you have to recognize that the truth is that ATF tried a gun runnning sting under Bush which was stopped when there was no appreciable cooperation from the Mexican authorities. Tracking devices were used to trace the locations of weapons and arrests were made when trafficers were identified. The program was suspended because those weapons which made it to Mexico were immediately lost fromtracking due to lack of Mexican cooperation.

                                                                Holder's Fast and Furious never was intended to track or arrest gun runners. No tracking devices or other surveilance devices were used. The goal of the entire program was to make it appear that almost all of the drug cartel weapons were from U. S. suppliers - thus creating a percieved need to stomp on our Second Amendment rights.

                                                                With no effort to track or identify the straw purchasers, This fiasco had no chance of reducing violence in Mexico, but that was never a consideration any way.

                                                                        The house has passed plenty, more then 2 dozen jobs bills alone, where they just sit on Reid's desk in the senate. Pelosi's remmarks will go down in history for their "uniqueness" (to be nice). People should know what is in a bill, and should never have to pass it to find out what is in it. Pure stupidity.

                                                                        Baggy, there are not enough Tea Party people in the house to do much. They control about 1/5 of the votes, Hopefully next election they will control 75%.                                                                         Most americans care when the our government sells guns to Mexican Cartels, and does it behind the Mexican Government's back. It is one thing to work with the Mexican government, but Obama/Holder is just selling guns to Drug Lords. I can tell you the US government would not like it if say Mexico started selling guns to street gangs, or antigovernment groups in this country. The NRA promotes legal gun safty. They do not injure or attach people. I wish the EPA were as friendly to the US citizens as the NRA is. The NRA is in this because the Govenment tried to blame gun shops for selling guns to the Drug Cartel's. if Liberals were in control, only the criminals would have guns. I would even go as far to say that they would not want our military to have them either.
