VIDEO: First Read Minute: Court ruling's impact on 2012 race unclear

How the Supreme Court's ruling on the health law will play in the 2012 presidential election is unclear, but the White House and the Obama campaign have to be breathing a sigh of relief.

I’m Domenico Montanaro with your First Read Minute, and Mark this morning breaking news that the Supreme Court by a 5-4 decision – it seems like everything’s 5-4 nowadays – upheld the health care law. Big news. What’s your take?

MARK MURRAY: Well, Domenico, we just don’t know what the politics are. This could go in many different ways for the 2012 presidential election. But here’s what we do know – that this preserves a key Democratic Party/President Obama policy achievement. This is something that goes down in the history books. No one knows the politics. We might not even know the policy on how this would actually work in the long run [if there would be challenges in Congress, etc.] But Democrats, who paid a huge price for this health-care reform in 2009 and 2010, get to keep that achievement.

MONTANARO: Yeah, and Republican messaging has been really consistent on this. I think they were prepared either way for what it would be. We’ve seen the conservative base already be fired up. The Romney campaign says that they’ve raised about $200,000 so far since the announcement in just a couple hours. But the fact remains, if this law had been struck down, it would have been a major body blow to the president. The fact that it was upheld is something that-- the White House has to exhale a big sigh of relief.

MURRAY: And Domenico, as you and I were talking about, as Republicans like Mitt Romney end up saying they want full repeal, one question they need to answer is how do you actually achieve that -- even with a Republican in the White House and a Republican majority in the U.S. Senate?

MONTANARO: And more than that, what would Mitt Romney do specifically to repeal it that would be different-- or to replace it that would be different than what he did in Massachusetts? So, I think that’s a big question that Romney’s going to have to eventually answer. Still, this election, all about the economy.

MURRAY: That’s right.

Wasn't it NitWitMitt and the rest of the repugs saying earlier this week that when the courts strike down the bill it will be the devastation of Obama?

Well, now the shoe is on the other foot. This is the first in many defeats for Mitt and the repugs that will happen this year. They will suffer devastating defeats in the debates and then the big defeat in November!

NOW, MSNBC posts a story on the lives and fortunes Healthcare Reform will save, for a number of sick Americans.

NOW we get stories of people being turned down for insurance due to pre-existing conditions, or people unable to afford private insurance who are self-employed, or children who were facing a lifetime cap on their insurance after surviving childhoods in which they were hospitalized for serious conditions. All issues addressed by the Affordable Care Act, aka ObamaCares and now, RobertsCaresToo.

Before the ruling, the media behaved as if it would be struck down, so it only reported on death panels and the Republicans violent reaction to the Act. It allowed Republican politicians to go unchallenged when they would rant and rave on Sunday Shows about the Act being unconstitutional. NOW will the public learn the facts? Will the media start to INFORM the public? Or will it still obey the billionaires that buy the advertising. Now, don't make the Koch brothers mad, boys!.

I'm with you Phine, finally paying off my 20% of a 3 level spine fusion from 2010. This may not be perfect (single payer would be perfect) but it sure is a good start. Plus it lets us watch the right pull their undies out of that wedgie position which is so very much fun, almost as much as watching them get in that position in the first place.

    Looks like we will have to wait for 2014 to see how many $$$ the federal government will have to pay out in subsidies for those still not being able to afford insurance.

      This is really the big story here. Another gawd dang 5-4 decision, albeit holding up ACA, but really weak. First off by the narrow split, in which it would have been better to see Justice Kennedy making this a 6-3 vote.

      And aside from questioning motives (ideology versus constitutional law), Roberts was not willing to put his legacy on the line for the damage he knows would have been caused if any part of the ACA was struck down. And further to the point of cowardice, he just has to make the jab about this being yet another tax increase and how voters need to elect Republicans if they don't like it. WTF?

      Roberts is right, but not about election and taxes, rather about elections and appointments to the SCOTUS. From the time the Supreme Court made the mistake of ruling in favor of Bush over Gore (we all know now Gore won Florida and the election was rigged by Katherine Harris under Jeb Bush), the chain of events have been Dubya making two appointments -- Roberts and Alito, which has determined all the rulings since such as the recent striking down of Montana’s Corrupt Practices Act (1912).

      Alito is in there with Scalia -- Both have broken with historic rules of conduct. Alito openly saying "not true" to the president in an address to the nation, and Scalia attacking the president by name in his writings. As with the rest of the coming election, the choice is clear:

      The election will not be a referendum on ACA, rather it will be about possible appointments to the Supreme Court and absolute necessity to balance the courts with additional justices who are moderate leaning to the Left. After Citizen's United, imaging what Mitt "corporations are people too" Romney would do, it is the most disturbing thought of any of the GOP/TP candidates that ran this cycle.

          Additionally the constitution has evolved to limit the creative expansion of the branches or states over the individual. This ruling lays the foundation to enable the government to do what it deems to the individual. the Constitution protects liberty as that which is UNDEFINED as powers of the government. This ruling says government power is undefined because they can allow "opt out taxation". So is the willingness to pay a tax the same a freedom of choices...?

            I am talking about the legal rationale that Justice Roberts and the other 4 used to get to that ruling. That adding a tax alternative empowers government to take any action its political rules see fit, because "elections have consequences" ... seriously?!?

            i am concerned that supreme court rulings creates precedence that is used to justify other laws the court never had to consider - like requiring the entire country to buy a hybrid car so the US will stop freeloading off the global warming reduction efforts of other countries.. seems plausible now. buy a hybrid car or pay a extra tax.

              the act to which you refer was a payroll taxing authority from the federal gov to ship owners who crossed state lines.

              ship owners collected a TAX that the federal gov used to pay for healthcare. The ship owners were not required to buy health insurance, and only those ships who operated across state lines fell under this jurisdiction. International and local shipping did not.. jesus man do you just make this sh1t up as you go.

              the later act required ship owners to pay for hospital stays or medicines if the ship was of a certain size and did not have a medicine chest on board. that is more work place rules and labor standards than healthcare mandates.

              Please tell me that's not what you justify as "rationale is it"

                Actually, it was a mandate. There were two subsequent mandates, one on firearms, and one, again on the seamen, making them spend 20 cents to get hospital insurance.

                it was a mandate if the ship did not have a medicine chest on board. If they did they were exempt from the insurance requirement. There are millions of workplace laws that require the employer to do certain things if they do not remedy certain workplace conditions.

                but i don't care, The law is dumb and will fail due to economics not politics, people who cannot afford it still can't afford it regardless of how many IRS credits you get (can pay bills with IRS credits)

                what i do care about is the lasting effects of the NEW RATIONALE that the Supreme invented. that's the real damage in this ruling.

                  If you remember, his AG argued that it was legal under the commerce clause, that is why he failed so miserably.

                  I think the reaction here is some proof that we aren't exactly sure how the politics will play out -- as it relates the presidential election. It could fire up or deflate conservatives. It could fire up liberals or make them complacent. We're just not sure yet.

                  For the election is an important distinction, too, I think. This is clearly a positive for the president's legacy, because the reverse would have been a disaster for it.

                  In fairness to those who predicted the the law would get deemed unconstitutional, most experts seemed to be leaning that way. And InTrade...which usually has a good track record at predicting things political (after all, people are putting their money where their mouth is) was running at 74% chance of unconstitutional.

                  Be happy to but if you read the law or the court ruling you would know that while the IRS will bill you if you cannot prove you have health insurance they cannot force payment like they do with income taxes and the cannot attach any fine or penalties for non-payment.

                  I would have to say it's going to be a HUGE win for the President. Especially now that the media will report the benefits of the legislation (which they could have for 18 months, if they weren't so busy reporting on the political catfight).

                  Why is it a huge win? First, the President gets the leadership bump from the Court's affirmation of legality and legitimacy. Second, every time the Teapublican nominee mentions the A.C.A., it gets reflected right back to the Massachusetts policy, which is almost a duplicate. Thirdly, the independents in the electorate see the President has won and are going to put this issue to bed as a "W" for the President.

                  All in all, there is nothing but positive results from this decision for; most importantly, the American people and secondly, the President.

                  Thanks for your comments. My $0.02 is that it is simply human nature to be more motivated when you are angry about something. I see this ruling as a short term fund-raising plus for Romney / GOP. As for the long-term electoral issue, I agree that it's a bit tougher to see. I think it will motivate the Tea Party portion of the GOP to rally around Romney a bit more. The question for the President and the Dems will be, can they motivate their base equally with the prospect of "protecting" ACA? Time will certainly tell. The economy is still going to be the primary driver here. Thanks as always for chiming in! :-)

                  Seems that the penalty for not getting insurance in 2014 is like $94 going up incrementally over time to what, less than $700? That the IRS will not be asked to pursue violators? (from nbcpolitical unit reporting today).

                  There still is no incentive for many to get health insurance with such a low bar penalty. As for preexisting conditions I am sure that the insurance companies already have a work around based on some type of time qualifier. Diagnosed last week, run out and buy insurance tomorrow?

                  Somehow I get the feeling that obamacare will be a disappointment for many after 2013/2014.

                  For those whose employers pay all or part of your coverage remember to smile and thank obama next january when you get your W-2's and box 12 now lists their contribution as part of your new taxable earned income. And you all thought obama looked after the poor and middle class....

                  FrankH - the far right just doesn't get it. I have a friend who went into surgery that was to last 2 hours to remove a growth in her inner ear. They knew, from the MRI, the growth had gone into her head but when they got in found it was worse than presented. After 11 hours of surgery she came out with no hearing in one ear, equilibrium shot, sagging side of her face and trouble speaking. It has taken months of therapy to walk properly and speak coherently.

                  This was a "healthy" woman. And, overall, this was a minor situation - not life threatening. But, the hospital bills! Unbelievable!

                  No one PLANS for these things but we all need help when they happen!

                        Today is a good day, but it is kind of funny.

                        Republicans pushed the mandate in the 90's, but Democrats disagreed.
                        Governor Romney signs the mandate as Governor and was even saying the entire US should follow his leadership and pass the mandate on a national level.

                        Democrats passed the mandate and President Obama signs the bill.
                        Republicans fight tooth and nail against it.
                        Governor Romney flip flops and says the mandate is bad. (Opposite of what he said 4 years ago).

                        Without Governor Romney passing the mandate, today we would have no mandate.
                        Democrats would not be celebrating.
                        Republicans would not be giving large sums to Governor Romney if he hadn't been the original champion of the mandate.

                        The tax (fine) is estimated to affect 3% to 5% of people. Last year in Mass they collected the fine on only 1% of people.

                        If you don’t want a tax increase (fine) then just buy the insurance and stop freeloading off of the rest of us.

                              While the true results for the country (regarding Obama-Care) won't really be known for many years down the road, here's a few things that most independent voters can agree on:

                              1 - Obama-Care was passed with some serious back-room deals being given out to several states, many large labor unions, and many large businesses (not saying others haven't done similar deals, but this one certainly had more than it's fair share of secret deals), while we were repeatedly being told that Obama-Care WAS NOT a tax, and that no one making under $250K a year would pay "a dime more in taxes". Now the Supreme Court tells us that in fact it (Obama-Care) is in fact a tax and in fact that's the only way it (the new tax) can be declared constitutional, otherwise it would have be struck down.

                              When somebody tells you something that turns out to not be true, we used to call that a "lie". Seems to me that (in the perfect world) when a law is passed for reasons that turn out to be untrue, we (the voters) should get a mulligan (like a do-over from the sport of golf).

                              2 - Even though this President promised the "most open administration in history" it hardly seems like that's happened to date. Even the majority of Congress (both sides) had almost no time to study the bill, or offer amendments to correct some of the issues within the bill, before being told that had to vote on it. Nancy Pelosi (then Speaker of the House) is even quoted on camera telling her members to vote to pass the bill and read what's in it later, hardly the way most Americans want laws passed that affect millions of us.

                              3 - Most folks working in the Washington, D.C. apparently can't do basic math. One group runs around telling us that Obama-Care will (eventually) lower health care costs, another group says it will cost the country's taxpayers billions (if not trillions) in additional costs. Both can't be right, but both sides play games with math. If one side says they want to raise benefits to Seniors 10% and the other side says they want to raise benefits 4%, the first side screams that their opponents want to cut benefits to Seniors by 60% (10% down to just 4%). Unfortunately the media is also guilty of pushing this nonsense as well, probably because headlines of "Side 2 wants to CUT Senior benefits by 60%" sells more papers and magazines than a headline of "Side 2 wants to RAISE Senior benefits by 4%".

                              4 - Neither side (Democrats or Republicans) are really interested in anything else except getting re-elected, so they'll tell their side anything they want to hear to make that happen. If they really had "skin in the game" this mess (and many others) would never have happened. If Congress had to live with ALL of the same laws they pass on us (healthcare, insider trading, retirement, etc., etc) you can bet they would have stopped to read the bill before voting on it.

                              In fact, if the people passed a Constitutional amendment that required that ALL members of Congress had to live with the same laws we are forced to accept you'd see a pretty rapid return toward more civility between parties very quickly. Case in point, we're got another financial crisis coming (again) with another showdown looming (again) with the debt ceiling. Want to fix it? Make a law that NO member of the House or Senate is eligible for re-election if the debt ceiling exceeds 5% of the GDP. Then sit back and watch how fast the Congress cooperates with one another when they want to be eligible for re-election.

                              You can argue the benefits (or drawbacks) to Obama-Care until we have cars that run on water, but paying members of Congress to blindly vote on laws that affect us all (without even having read what's in the bill) is really stupid (and a waste of our tax dollars).

                              If that's what Congress is getting paid for, why not just have the 33 million viewers of American Idol just phone in their votes? It would be much more "democratic" (33 million vs. 100 Senators and 435 House members), we'd save a bunch of money (instead of paying Congress), and even if you don't agree with the outcome of any particular American Idol vote that week at least you'd be entertained for an hour or two (which is more than we got with this bill).

                                Since Obama doesn't uphold the laws of the land on immigration, and Holder does not honor the laws either, can American citizens ignore Obamacare?

                                It certainly appears this is a teachable moment. Hypocrisy and Double Standards are a big part of the DNC party platform and the Creed of unCronkite-like JournOlists working in concert to get that usurping occupier barack husein re-elected.
