It was indeed a 5-4 decision, but with Chief Justice Roberts voting with the liberal majority.

The law was upheld on the basis of it being a tax. Is the reason it is upheld because of that obscure law that says a tax cannot be challenged until collected (which would be 2014)? Or has it been deemed that even then it will be constitutional? Yeesh...this stuff is confusing!!

I am shocked at the affirmative vote from Chief Justice Roberts. I would have bet money that his vote would have been negative. American citizens of the future will be pleased that this is the date when we entered the socially most important piece of legislation of the 20th century. I have never heard of any country that has this vitally important piece of welfare been stupid enough to rescind it. There will be many times when it will need to be tweaked,but it should survive for our future citizens.

Yesterday, Speaker Boehner said if the mandate was struck but the rest upheld, the House will immediately pass legislation to repeal what was left and if the whole ACA was upheld, they will pass legislation to repeal it. Guess Boehner forgot, the GOP House already did pass legislation to repeal it but, hey, they'll waste time repealing it again rather than work on those "jobs, jobs, jobs" they promised.

My point is I don't think any new law can point to this decision and claim that Congress had the power to enact the new law under the commerce clause. Jumbled words...Starbucks hasn't quite kicked in yet.

And it's not a tax increase if you buy insurance. But I do agree with you that this is what's wrong with the mandate. Not that the government doesn't have power to impose a tax, but rather that the people who already cannot afford to buy insurance will be forced to pay more in taxes.
Let's just hope there are teeth in the word "affordable."
That's the only thing I fear. There are no real checks in ACA on what insurance companies can charge, except the 80/20 rule, which does nothing to lower the cost of care.

Although I am pleasantly surprised by the SCOTUS decision, I will temper my enthusiasm with the knowledge that there is still a long way to go to improve US Healthcare.
Although the ACA has many excellent provisions and has been ruled constitutional, it is still a flawed piece of legislation. I hope that after President Obama wins re-election and Congress realizes they will have to deal with it for four more years they can come together in a bi-partisan way to preserve the best parts of the legislation and improve the parts that need it.
The grim fact is a large majority of Americans still do not approve of this legislation. The President and the Democratic party need to take this opportunity to do a better job of informing the public what the legislation does and doesn't do.
Democratic leaders then need to at least try to find a way to work with the Republicans to make improvements. I hope and pray that the Republicans accept the fact that the ACA is now established law and will work WITH the President.

Good Morning Dennis, How are you today? I would guess quite delighted. I have in the past seen the liberals take the Supreme Court to task for being to conservative and controlled by the Republicans.
I have never been in favor the the Supreme Court, or any other court, making law from the bench. They should either say the law is constitutional or unconstitutional as written. Chief Justice Roberts and the 4 on the left really violated the oath, in that they MADE LAW with this decision when they made the mandate a TAX even when Obama and the Democrats said it was not a TAX.
IMO, I believe we, the right, will be more fired up to get out and vote for those who will repeal this law. All the more reason to make sure the Republicans take control of the Senate and retain the House and win the WH back.
I was reading on the New York Times website this morning, a story about all the people who are counting on the Affordable Care Act to help them get health insurance, and I thought, now the media starts to cover what this means for real people.
I was on another website at 10:00am that broke in to say the mandate was struck DOWN. Immediately, I thought, "well, folks will now start to learn what we have lost, and perhaps they will support the President for at least trying to get everyone covered with health insurance, removing lifetime caps, and outlawing coverage denial for pre-existing conditions."
THEN I came to MSNBC and l learned that the mandate was actually UPHELD, and I burst into tears (well, to the extent I can, at work.) Thank you Democrats! Thank you Justice Roberts!!!!!

I actually took the time to read the opinion of Justice Roberts. I must say, I am still confused how a law is not a tax, yet it is upheld as a a tax.
For the Medicaid expansion extortion provision being struck down, I think that is a bone being thrown to the rabid anti-feds.
Bottom line on the whole thing is that if you can afford it, you have to have health insurance or pay the tax. I guess that now Congress can require the purchase of broccoli or the payment of a broccoli tax, so long as the tax is not an excessively penalty.

Having read the syllabus, here are my 2 cents --
I'm much more impressed with Chief Justice Roberts than I ever was before. He managed this case like a true chief justice, forging alliances to carve out a careful path through the tangled maze of all that litigation. I'm not entirely sure about his motivations, but his skillset is in evidence.
The part about the mandate being declared a tax is a potential bombshell for the President, provided that the Right can portray it effectively as a tax on poor people who already cannot afford insurance. As I said above, that was exactly the part about the mandate that I didn't like from the start.
I was impressed by the Medicaid part of the decision as being particularly Solomonic. The states that opposed the law on the ground that it requires Medicaid expansion will be able to avoid the ultimate penalty if they don't comply. However, that might be a significant downside in terms of what the law will actually accomplish because the states most likely to not comply are probably the ones with the highest populations of poor people, who would otherwise have had hope to be covered. Ironically, under the mandate, these same people may be placed in a position where they would also have to pay more in taxes.
So, I guess we'll have to wait and see how it all shakes out. There are many battles still to be fought, not to mention the spectre of having employers decide in droves either to lay off workers or to stop carrying coverage altogether. If that happens before the election, it could easily destroy any political uptick that the President might get from having his law upheld.
And I suspect there are some employers who might not be above doing such a thing as a political move, just as I have always believed that many companies are not hiring precisely because they do not want to make the President look good.
I think it was Albany the other day who said he believed that Roberts might vote with the 4 liberals if Kennedy did so that he could control the opinion. Kennedy surprised me by not siding with Roberts, but I think there is strong evidence within the opinion itself that this is exactly what Roberts did.

Now for the important discussion. Can the Supreme court overturn the officiating of the NBA finals. Even though they swept my Mavs, I was pulling for OKC. Durant such a class act. @listoire - I too am very surprised that SCOTUS ruled in favor of all Americans by ensuring access to medical care. Their record of ruling in favor of American citizens has been piss poor since selecting Bush as president.
Now that they have ruled, it is time to wipe away the last two years of wasted GOP/TP rhetoric and time, and move into the territory of refining the law for improvements. We need a single payer option and stronger legislation aimed at reducing rising costs.
It would be nice to see the GOP/TP step up to the plate and offer ideas and solutions to improve the law vs. tearing the law down. However, something tells me they will stay bitter and continue their NO, NO, NO mantra.

If you have Medical Insurance, you ALREADY pay for the uninsured person's healthcare - your rates absorb the costs of those who go to the emergency room, etc without insurance.
Since the ACA requires EVERYONE to get insurance or pay the fee/tax this should take at least some of the burden of healthcare off of those who have insurance.
The "tax" should be only on the uninsured, not those who are currently paying for health insurance.
Lets not forget that we pay for the uninsured through our property taxes as well.
The economy will get a big boost after today. The Television industry will be working over time to replace the television sets of all the tea people Koch republicans.
