Rep. David Schweikert (R-AZ) has introduced legislation that would stop President Obama's recent executive action involving the children of illegal immigrants and their ability to stay in the United States.
Specifically, it prevents the Department of Homeland Security from enforcing a presidential executive action as immigration law.
"Instead of working with Congress to secure our border and reform our immigration policy, Obama sought to circumvent Congress once again," Schweikert said in a statement. "This thinly veiled political ploy is detrimental to Americans and while President Obama asks the Department of Homeland Security to 'look the other way' on immigration policy, I ask him to respect the rule of law."
It's not clear if this bill will be brought to the House floor for a vote, as House Speaker John Boehner failed today to say if he supports or opposes Obama's new policy; he instead said the new policy makes it harder to achieve long-standing immigration reform.

Illegal immigrants who serve in our military have had the possibility to be come citizens for some time now - that is nothing new. And no administration (Republican or Democrat) in the last 30 years has targeted the children who grew up here.
Obama is bragging about a new 'policy' that has already been in effect for a long time - with the exception of giving them work visas - which he is not legally authorized to do. A simple lawsuit filed in Federal Court could block that as a violation of existing immigration law.

First of all, the flow has already been stopped. Net migration rates to across the border has hit roughly zero; essentially, as many illegals that enter the country are leaving. Secondly, a large part of those 12 million are children who were forced by their parents to cross and whose home is technically the United States.
Actually, most illegals pay taxes, like sales tax and the payroll tax. In fact, illegal immigrants subsidize Social Security because they pay the taxes but don't get any benefits. Chances are, tax dollars from an illegal are gonna find their way into your SS check; don't like it??? Give it back.
Actually, in Alabama corps are rotting in the fields and businesses all over the country are barely finding enough employees thanks to tighter restrictions. Let's face it; Americans, even the unemployed and low-skilled workers are unwilling to work in the fields or in other sectors that pay a few dollars an hour. Not to mention the fact that those jobs, like farming, are excruciating and hard, making it even more uninviting.

Well, Bush tried to privatize it, for one thing. The GOP also are weakening it by advocating the ending of estate taxes and by reducing the payroll cap, hampering the program's stream of revenues.

If a Democrat controlled Congress passed a law and it was signed by a Democrat President and a Republican President said he was not going to enforce that law, you liberals would have an absolute fit and call for his impeachment. I know of no one getting rich on social security. I do however know several that have gotten rich by investing on a regular basis.

Democrats who believe that it is all right for a president to issue an executive order to break the law of the land is living in a dream world where there is no right or wrong. It is wrong to break the law. Don't like the law then change it, but to ignore the law and break the law is actually a crime for which the President should be punished. You obviously have forgotten the Oath of Office the President takes where he is supposed to preserve , protect and defend the Constitution of the United States. By issuing executive orders that ignore the law as enacted by Congress, he breaks his oath of office and is thereby fit only for removal from office. It doesn't matter which president does this, if it is the law of the land, he must support it. Obama said as much when he ran for office the first time. Now he has changed his tune. No one seems to mention that if congress did their job and passed a comprehensive immigration bill, or even the DREAM act, the President wouldn't have had to resort to an executive order.
And I notice the critics who whine about how unprecedented it is for a President to say he is not going to enforce parts of a law, seem to have forgotten that George Bush often attached executive orders to bills that he signed saying he was not going to enforce parts of the law he just signed! Just because some people want to modify them "comprehensively" or that some people want to pass the DREAM Act doesn't mean that the POTUS should arbitrarily instruct law enforcement to ignore the existing laws. It is not Congress's job to do your bidding.
Bush had an immigration reform plan and his party refused to even support that. The only reason Bush had any success was the few successful bills he could pass using the democrats. And everyone seems to have forgotten that the constitution itself doesn't allow the supreme court to strike down laws.
That, instead, was decided in Marbury vs. Madison(1803) and was made by Judicial Precedent.
There is no "flow" in the president's plan. These people are already here ~ brought by their parents, raised in this country, educated in our schools, and many have served in the armed forces of the US. This is the only country they have ever known. If there was serious concern in congress about immigration, it would have been dealt with already. This is really a matter for the courts. The constitution says that it is the congress that makes the laws, not the President. Some time ago the President himself said that he would be in violation of the constitution and his oath of office if he took action like this. Let us take the President at his word. Let's see...68% favor immigration reform. That DOESN'T mean that 68% favor giving away 800,000 free rides regardless of the reason. That means that voters want REAL immigration reform including dealing with our border problems. I have no problems with my black and Hispanic neighbors: they are here legally and work hard. Unfortunately, it is both irrational and impossible to deport the roughly 11 million illegal immigrants in the United States. The only way to solve the problem is to allow some of them (ultimately the majority of them) to stay here. After all, many of them are children who were brought here as youngsters. This isn't being compassionate; it's being rational. Some illegals, those who have recently come here, ought to be deported, but those who have been here for about 5 years or more can stay. In addition, we need to simplify the immigration system to make it easier to emigrate here legally, to increase visas for highly-skilled students, to offer citizenship to foreign college graduates with degrees in fields that will be crucial for the future, and to establish a work permit system to bring in low-skill laborers to the country. This is a mouthful and will hurt everyone, but that makes it appealing and necessary.

I see this every payday they illegal hispanics come into the bank I work at they cash their payroll checks on their employers account they go next door to the grocery store and western union the money to Mexico. One time I said "wow a lot of hundreds" her reply was "yesterday you guys cashed a lot of hispanic payroll checks and they came over and sent the money by western union the money to Mexico." The hispanics that are here legally actually have bank accounts and deposit their money into their account.
At tax time they come in and cash their $3000-$7000 refund checks and off they go with "their" money. Most people would deposit that money not put it in their pocket.
Every few months after ICE has raided their place of employment we see a whole new group of hispanic employees except for the one that are here legally we see them month after month.
So please don't say they pay taxes such as sales and payroll.
Plus the majority of them (illegals) do not have drivers licences or auto insurance yet they drive. No problem here!
The children are innocent they did not have a choice I do not blame them. The parents knew what they were doing was illegal and they didn't give a sh!t they did it anyway. Why is it always the immigrants fault? There are a lot of sleazy employers that pay under the table, so that they can stiff the worker out of pay that they earned. They also don't want a SS number trail to show the IRS. Many illegals know the ropes, but many more don't. They are just being used and exploited. My neighbors all have legal, immigrants doing their picking. They do a good job and work cheap. Most people in my area don't want to stand, bent over, all day in 90 degree heat, to pick berries and tomatoes. if you want to do that type of work, instead of unemployment, You might be an immigrant.

I remember AG John Ashcroft testifying to congress regarding the 'sneak and peak' provisions of the Patriot Act. The public didn't like the idea that the gov could come into your house without a warrant while you weren't home 'just to see' if there was anything illegal going on there. Ashcroft told the press that they hadn't used that provision. Dems didn't buy it, and wanted to make political hay over the issue. So they asked him - under oath - if the DOJ had used the provision, and if it had worked to find any terrorists. He refused to answer. The dems reiterated that they asked only for general numbers, not names, dates or any other info which could compromise security, and did he think security would be compromised by providing those numbers? Ashcroft said no. They asked him if Bush had asserted executive privilege. He said no. They asked him then what reason could he give for not providing info that congress - who voted for the law and would need to vote for continuance - had a right to know. Ashcroft had no answer. Frustrated dems - and only dems, no pubs joined in here - told him they needed either the info, or a legal reason why he could not provide the info. After lengthy consultation with his lawyers, Ashcroft finally used this justification:
Anything which could hurt the president politically would hamper his efforts to win the war on terror, and thus is de facto a matter of national security.
I'm curious, for all those pubs who now yell about executive limitations, the Constitution and the separation of powers: do you still agree with Ashcroft that the political health of the President is a matter of national security? The right of Habeas Corpus - the right of a citizen to challenge unlawful detention - comes from the Magna Carta, and was an integral part of English commonlaw. The US Constitution says that Habeas Corpus shall not be suspended except 'when in cases of rebellion or invasion, the public safety may require it'. Before the Bush administration, it had only been suspended once, during the civil war and reconstruction, when half of the US rebelled against the US government over their right to own slaves.
When the Bush admin wanted to suspend Habeas, they realized that 9/11 was not sufficient 'invasion' to invoke the exception to the constitutional guarantee. So they devised a different legal justification, promulgated to the public by Dick Cheney: the Constitution only guarantees Habeas, it does not originate it. Since the Magna Carta originates it, all we have to do is declare that we don't follow the Magna Carta, and that makes the Constitutional guarantee a mute point. With this justification, Bush suspended Habeas Corpus for the second time in US history.
So I'm curious: all you pubs who yell about freedom and unbridled executive power, do you still think that the President can take away your constitutional right to challenge your detention by the government, whenever he wants and without justification? You are also familiar with the many representations which the Mexicans have made to us asking us to take effective measures to stop the traffic of wetbacks. It is true that the measure they have normally requested is that we crack down on the farmers employing the wetbacks. Practically speaking this is not possible for political reasons and, therefore, if we are going to do anything at all, it must be something else.
We recognize that the use of the military to stop the wetback traffic will almost certainly provoke incidents and that those incidents will react on our relations with Mexico. I am sorry that this is the case. Nevertheless any enforcement measures we take, or indeed any lack of enforcement measures we take, are bound to lead to incidents due to the tremendous pressure of the wetback movement. Under these circumstances and recognizing that we face a choice of evils, it seemed to me better to seize the bull by the horns, see how effective military measures could be on one section of the frontier, stimulate both sides to demand a mutually satisfactory bracero agreement and do what we can to convince the Mexican Government that our measures were at least in part due to their pressure. It was precisely to get the fairest possible opinion on the latter point that I talked to Brownell as reported in my memorandum of conversation of August 8.11. Not printed.
I would greatly appreciate a detailed expression of your views. I guess the lesson I would teach my children is that well meaning people who work hard shouldn't have their lives destroyed by the government. Again, this executive order covers people who came here as children and are doing what their supposed to be doing. It wasn't always like this... Immigration, for some ethnic groups used to be very easy... If only there was an Ellis island system now! at some point we began cracking down.
I also don't think exempting people who came here as kids for deportation and giving them work papers takes away from American josbor screws over legal immigrants. People who can afford to do it legally, who aren't being given asylum generally won't be occupying the same type of jobs...
And the illegals stealing American jobs debate is so tired... Look at Alabama... Obama has deported more Mexicans per year came over the border and Alabama adopted a tough new anti immigrant law - And now they can't find enough people wiling to work on the farms for the prices their willing to pay! The executive branch does NOT make laws, they implement and enforce them. The law says these folks gotta go. The Republicans block everything the President proposes, then they blame him for doing nothing. So the President uses his Executive Privilege and does something, but they are pissed they weren't able to block it.

He's deported more illegals than any republican or democratic administration. And this crackdown was meant to prove to the GOP that he's serious about immigration reform. Then, after Obama secures the borders better than any president to garner GOP cooperation on the dream act, they screw him over.

What is appalling is how lacking the media is in pointing the GOP hypocrisy out. The Dream Act has come up for vote 3 times during President Obama's term and each time the Republicans have refused to let it be voted upon, or voted lockstep against it. Yet they come out and rail on the President because he takes steps to move this nation forward when they play partisan politics with the important issues of this country.

This came at a time when the Repubs were almost succeeding in making Obama look as bad as possible. Now, he wants to recognize children of illegal immigrants as having grown up American. It's ridiculous that a young person who has led a decent life, going to college and working, maybe even raising a family should suddenly be deported to a country that he/she doesn't even remember. If a Repub came up with this idea, they would extol it as the right thing to do. But Obama, no it's just wrong and he's only pandering to the Latino community. To be honest, I couldn't tell a legal from an illegal. However, give the children an opportunity to contribute to society because they're going to be here whether we like it or not.

For a small percent of jobs you are correct....but I personally know of someone who needed a social security card to keep his job and brought one in 3 hours later....so for the bigger picture they will be competing for jobs....they're not just picking fruit and veggies.

Can I share a very personal thought or two on immigration here?
I've recently spent quite a bit of time visiting my ailing mother in Florida - both in the assisted living home where she's been a resident the last 18 months, in the hospital she's hopefully being discharged from today, and in the rehab hospital she'll be returning to for the time being. I am often frustrated by the difficulty in understanding medical jargon when spoken with the accents so many of her doctors, nurses, and aides seem to have - not just Cuban or Mexican or Dominican (I majored in Spanish in college a million years ago), but Jamaican and Russian and Middle Eastern and Vietnamese and a host of African countries I probably couldn't even find on a map.
But here's the thing - with rare exceptions, I have never seen people treat my mother - who can be a difficult patient at best and an absolute nightmare at worst - with more respect and care and professionalism and dedication to making her last months as comfortable as possible. They speak softly and kindly to her even when she's cursing them in her dementia. They take turns coming to her room at the assisted living home to feed her cats and play with them while she's in the hospital. They wait patiently and hold her hand while she tries so painfully to swallow her pills. They calm her when she gets hysterical about thinking she's going to fall. They wash and shower her gently and change her clothes cheerfully when she can no longer get to the bathroom on her own - and I'll spare you the ugly details of what that often entails. They tuck her into bed at night and come running as soon as they can no matter how many times she pulls the call cord and then forgets what she wanted. And they keep her surroundings spotlessly clean and organized the way she likes so she can find things that she (being legally blind) can't see herself.
I'm going to assume that the doctors and nurses are probably legal immigrants - the aides may or may not be, but many of them are working two jobs to get money to further their education. They do the sort of work which would turn many of our stomachs, and they do it for all their patients, not just my Mom. Every day, without complaint.
When I'm down there, I stay at a condo time-share that my step-sister manages. She knows that some of the housekeeping staff she pays are probably illegal, but she says they're the most dependable workers she can find. They bring their children along and get their work ethic started at an early age. They keep the time-share rooms so clean you could eat off the floor, and many of them are working two jobs as well and they often live off of the left-over food the tourists are too busy to clean out of the fridge like they're supposed to when they leave.
One more thing - when I returned from my last trip, I didn't have anyone to meet me at the airport, so I took a cab, resigning myself to the usual tirade I've gotten before - from "real American" cabbies - because I live so close to the airport and the fare isn't worth them making the trip. Instead, this time my driver - whose accent was completely unidentifiable to me - not only didn't say a word other than to ask directions, but when I tried to give him an extra few dollars as a tip for being so nice, he gave it back to me and insisted it was "too much, too much".
I have no idea if any or all of these people are legal, illegal, or anything in between. And you know what? I couldn't care less. They've been nicer to me and have given me more assistance than some of my own family members have, and I would never have made it through the last few months without them.
I can only hope that their children will grow up in a kinder, more understanding, and more tolerant world than the one which so many of us have shown them.

I see that Asians are now the highest immigrants in this country. They also boast a 51% Bachelor Degree upon entering this country.

Obama has abused the Constitution and created a new section of the Immigration Nationality Act through dictator fiat rather than through legislative action of law as required by the Constitution.
If Obama had merely stated that he would order the Justice Dept to use prosecutorial discretion and not deport these people, he would have legal backing.
But Obama has gone beyond that to create a new qualification in the Law for a Green Card or Immigrant Work Visa.
That is an impeachable offense and we need to get rid of this occupier in the White House who despises the Constitution.
Perhaps though you or some other liberal can show us where Obama get's this authority

Article II, Section 1, Clause 1 of the Constitution permits the president to issue Executive Orders. It's not an impeachable offense, presidents have been doing this since 1789. Immigration falls under the purview of the federal government. Immigration reform has been on the table in congress for many years and they've continued to kick the can down the road. Not only is the president permitted to do this, I'd say it's his duty.
