Dems file complaint over Romney handing out free subs

 

A generous gesture? Or an attempt to buy votes?

Wisconsin Democrats are charging the latter, saying that Mitt Romney and his campaign broke Wisconsin law by handing out free sandwiches during a campaign event at Cousins Subs in Waukesha.

Wisconsin law, the state Democratic Party says, prohibits a campaign by offering anything over $1 in value to voters to get them to the polls or to refrain from voting.

Yet after handing out subs with House Budget Committee Chairman Paul Ryan, Romney says:

"I want to thank you for voting. Get your friends to go vote; get some friends to go with you. That's how you can legally vote multiple times. So bring your friends out to the polling place, get out and vote. And if you want another sandwich, there are more back there."

The Romney campaign responded with this statement from spokesman Rick Gorka: "President Obama and his allies keep wading in to the Republican primary, whether voting for Mitt Romney's opponents or absurdly claiming we can't provide refreshments for volunteers. If President Obama focused half his time worrying about the economy as he does obsessing over Mitt Romney, Americans would be a lot better off."

Yet from our observations -- and from the video that the Wisconsin Democratic Party provided -- most of the people who received subs from Romney and Ryan were voters, not volunteers.

Let me tell you what isn't lame- and, you'd think the "professional politics reporters" on this site would be all over it-

In, yet another, historic, unprecedented move, the Fifth Circuit has sent a demand to Eric Holder for a "no less than three page, double spaced" justification for Obama's questioning the Court's Constitutional right to rule on legislation.

This was in response to Obama's remarks yesterday.

Obama responded immediately- by backing off his previous remarks.

Too late. This administration is going to be in the highly embarassing position of having to retreat from the fully indefensibly remarks of the most egotistical idiot to ever hold the office of presidency.

And, like the tree in the forest, it will never be heard here.

Did Obama go to any of his classes at Harvard? No wonder why he won't releases his grades.

Fifth Circuit Court

They ordered the DOJ to submit a three-page letter stating its position on judicial review by noon on Thursday, even though the Department’s lawyer conceded that Marbury v. Madison is good law and even though Obama himself never went so far yesterday as to say that the Supreme Court lacks the power to overturn laws.

He said overturning Obamacare specifically would be “unprecedented,” but no true-blue Warren-Court-loving lefty would ever seriously impugn judicial review. And the Fifth Circuit knows it.

What they’re doing here is humiliating him as a way of getting him to stop the demagoguery, with the letter acting as the equivalent of a kid writing on the blackboard as punishment after class. “I will not question Marbury v. Madison, I will not question Marbury v. Madison, I will not question…” Rest assured, a liberal court will pay President Romney back for this somehow at some point. And in fact, O might use the letter as a political opportunity. Now that there’s bound to be intense media interest in it, he could explain in it why (a) yes, of course he accepts judicial review, unlike that darned Newt Gingrich who wants to haul judges before Congress, and (b) it would nonetheless be kinda sorta “unprecedented” to use judicial review on his pet health-care legislation.

Uh, Dennis? He betrayed his ignorance of the role of the courts.

That's something for any president to be humiliated about. If he knew anything at all about the Constitution, he'd know that it is most certainly within the purview of the Courtnto decide whether or not laws were Constitutional- or not.

That they are a co-equal branch of the government.

That the Founders set up a system whereby politicians- and that includes the president- were precluded from influencing their decisions.

So, I'm understanding where the Fifth Circuit is coming from- because we seem to have a man in office who does not understand the role of the courts anymore than he understands the Constitution.

Want proof?

Well, for starters, there's the Libyan "kinetic military action", which violated the War Powers Act.

Then there were the two- count 'em, two- unanimous decisions that came down against his administration from this court. That's right, the one where he appointed two of the justices sitting thereon. One was against the EPA, the other, against the EEOC and in favor of a Lutheran school.

My, my.

He does seem to have quite a lot to learn about the Constitution and the role of the Courts.

He should be humiliated. So should anyone so ignorant.

“The point that I was making is that the Supreme Court is the final say on our Constitituon and our laws, and all of us have to respect it,” Obama said. “But it precisely because of that extraordinary power that the court has to exercise significant restraint” when considering laws passed on the basis of the Commerce Clause.

There is a possibility that the subs were less that $1. If you purchase one of the mega subs and cut them in pieces, you can actually feed a huge group of people for about .50c-.75c. I think this is more dog and pony show crap, but I have yet to even see a sub priced for under a dollar anywhere in the U.S.. Even if they sliced it into smaller pieces, the whole sub had to be purchased in the first place.

So the argument that a mega sub, which I am sure is a lot more than a buck, could be cut up, still doesn't change the fact that the whole sub had to be purchased to even cut it into smaller pieces.

This election cycle is getting more pathetic by the day.

The humorous attempts to defend what by "definition" is indeed a violation, is only surpassed by the initial outcry. Would anyone here really vote for anyone because they got, what was most likely a couple slices of meat, a ton of lettuce, limp tomato slices and too much bread?

As the erudite James Taranto astutely points out in Today's "Best of the Web Today" column in the opinion section over at wsj.com, Obama first cited the Lochner case as an example of the FDR-era Court overturning an act of Congress having to do with the Constitution's Commerce Clause. Obama's exact words, according to the OFFICIAL transcript, were "we have not seen a court overturn [pause] a [pause] law that was passed [pause] by Congress on [pause] a [pause] economic issue, like health care, that I think most people would clearly consider commerce. A law like that has not been overturned [pause] at least since Lochner, right? So we're going back to the '30s, pre-New Deal." Taranto makes the point that Lochner was decided DECADES before "the '30s," in 1905, to be exact, and involved a New York State law, enacted by the legislators in Albanay but having exactly NOTHING to do with Congress' authority to expand the Commerce Clause. A first-year law student might make such a goof. But the former president of the Harvard Law Review, who is said to have taught "constitutional law" at the University of Chicago and who OBVIOUSLY styles himself as some kind of a legal "expert"? PLEASE! His IGNORANCE is matched only by his ARROGANCE.

It is not common for appeals courts to introduce party statements from outside the courtroom and demand explanations, but that’s only because most litigants aren’t dumb enough to make statements outside the courtroom likely to impact their cases.

In the few time this happened it did not turn out well for the petitioning attorney.

I did decry the waste of a brilliant mind. Lack of self discipline will do that.

You defend it no jo, by making issue with what YOUR President said. Obama was, in fact, right, and he doesn't lose his First Amendment rights by the office he holds. In fact, compared to what some on the right have said, Gingrinch for example and wanting to shut down the 9th Circuit, this is simply much ado about nothing. There was also DeLay, who wanted a review panel when he didn't get the decision he wanted on the Shaivo case. So, which is it, politicians aren't allowed to talk about court, or does that only apply to the people you don't like.

This is simply a judge with a complex. Kind of like yours.

Two observations:

(1) If giving free food to potential voters is illegal, people who accept food stamps shouldn't be allowed to vote.

(2) If Obama is correct in saying the Supreme Court should not overturn laws that affect interstate commerce, then he is de facto agreeing with the Supreme Court decision that upheld the Fugitive Slave Law.

I've seen more intellectual arguments on playgrounds between 4 year olds, over who's turn it is on the swing, than 95% of the comments made here.

Most of the comments can be boiled down to "Your a poopy head", "Yeah, well your a poopy head", back and forth, ad infinitum...

It is also apparent that the first 50 posts are almost always the worst in this regard.

Time for MSN to develop a "silliness" filter that dumps all the personal attacks into one comment area (for those so inclined), the random rantings (for those so inclined) into another, and the rational debator into a third (for those so inclined.)

That way everyone can read and comment in the manner they wish and those individuals that want rational discussion will be able to hone in on them.

    Maybe you've conveniently forgotten that it was your choice of President leading us into two unfunded wars costing trillions and the idiotic policies implemented by the republican party (Medicare Part D, trillions in tax breaks without spending cuts to offset them, etc), decimation of regulations that prevented gambling in the financial sector, etc. that led to the worst global recession in almost 80 years happening just a few months before President Obama took office. It takes a long time to fix what you republicans keep breaking, it'd go a lot faster if you'd just get out of the way for the repairs. More jobs have been created under President Obama in the last 24 months than during the entirety of the Bush presidency. We were losing 800,000 jobs per month when he left office and we're gaining 250,000 per month now. Of course, I wouldn't expect honesty from a republican when it comes right down to it.

      Everything I mentioned in my post was passed in the early years of the Bush presidency when the republicans controlled the House, the Senate, and the White House. All of them combined have already added more than 7 trillion dollars to the national debt and most of those policies continue to add to the debt to this day. Just letting the tax cuts passed originally in 2001 expire would knock about 1.5 trillion dollars off the debt in less than a decade. Getting out of Iraq and Afghanistan completely would remove another trillion dollars (and they've already cost the country more than 3 trillion dollars). Reality always seems to get in the way of republican rhetoric.

          I think the Republican Party (Mitt particularly) are jealous of President Obama's intellect and responsible manner in which he attempts to govern. Their meanness and pettiness is so jr. high. Our president is quite at ease with people whenever we see him in a public setting. He literally lights up the room. You can see on the faces in the crowds.

          I see a lot of ridicule being directed at him from the GOP, yet time after time after time it is the Republican Party who end up looking ridiculous.

          I don't think Mitt Romney reads anything. I don't believe he studies anything.

          I think he just spits out whatever his aides tell him to spit out. He could quite possibly be the most easily manipulated president in our history if he were to win. For him to sign on to Ryan's budget so easily is frightening.

          His debate with President Obama is going to be quite interesting. Standing up there alone with no one to protect him this time. Just the fact that he won't go on any Sunday shows except for Fox is an eye opener.

Having to show his college transcripts, birth certificate, school records are just lame excuses. President Obama has proven all he needs to prove to the leaders in Washington from both parties. If you do not believe these republican leaders then that only proves nothing will convince you of the truth. Believe the lies if that makes you feel like you are not a racist.           This current economic situation we are in took many years to get where we are at. You all expect President Obama to fix it overnight. That is impossible. Unlike the Republican leaders who will follow along with anything their leadership says, the Democrats have not. They have addressed the needs of the people within their districts and if their voters did not like something that the President or Congress was trying to do then they voted against it. So the super majority issue is a non-player. Democrats do not have robots that follow everything the Koch brother says.

          I am a moderate independent. I believe in having my guns but I also believe women should be able to choose what happens with their own bodies. If men can their insurance pay for Viagra and the insurance should also pay for birth control.

          You can get any poll to say anything depending on how you word the questions. Most people that disagree with the current Affordable Health Care Act wanted a single payer option in it. Instead of the Republicans trying to work with the Democrats to pass this law, they did everything in their power to try and derail it. Why, because they are hell bent on not having anything get done for the American people while President Obama is in office.

          And for why the race issue keeps coming up, this is about President Obama’s race plain and simple. There are more voters out here that believe in "Anybody but the Republican Clowns" than there for anybody but Obama. The Republican Party is no more. It should call itself the crazy party because of all the crazy mouthpieces they have.

The second time it was all over between me and the republican party, and my family has voted republican since it was the Grand New Party and Lincoln was their man. Why is it that in an area with less than 20% of the population being black that George Zimmerman called 911 seven times in 6 months to report individuals acting suspiciously (out of the 46 total calls he made to 911) and every single one of the seven calls was to report a black person? In those calls, not a single one of the people he reported were found to have done anything wrong.           Watching President Obama's speech yesterday, I was struck by the long list of accomplishments that he credited to Republican presidents of the past. When deciding whether to vote for him in the last election, I made my decision based on his determination to reach across the aisle and work with Republicans. I have never voted along any party line, but I must admit that I have voted for more Republicans than I have Democrats in my lifetime. However, in presidential races, I have voted Democrat since I voted for Clinton. I made the mistake of voting for Reagan and the right choice in voting for Bush SR. During the 8 years of the Clinton administration, I was more prosperous than any other time in my life with half the effort it takes to now barely keep my head above water.

          Newt Gingrich's Republican revolution signaled the end of the Republican party of old. Shutting down the government to make a statement, inflexible positions on taxes, calling Democrats big government crooks while raising earmarks to an art form (the K Street Project is where he taught freshman conservative congressmen to do that), blaming the working class for all of our problems and along with the rise of conservative talk radio, moving the party so far to the right that I am amazed that they don't where hoods and burn crosses at their conventions. BTW, other than Gingrich and Bush Jr., Santorum (the most investigated member of congress in history) and the 1%er poster boy Mitt Romney are symbols of why I'll most likely vote for ANYONE but a Republican for the rest of my life.

          What this country needs more, now than ever, is the Republican party of old. Where being a moderate meant that you could accomplish more. Where conservative ideas that now a day go way to far could be tempered by saner more common sense voices. Because, as the Republican party has moved further right, the Democrats have moved closer to the center. A good example is that Presidents Clinton and Obama have been demonized as too liberal when they are no where near that.

          So much could be accomplished if the reasonable thinking people in the Republican party would not have to hide their common sense for fear of Grover Norquist and the Tea Party. If there are any sane people left on the right, (and by judging the comment in this thread, I won't hold my breath), please ignore the racist, big corporation paid for, stooges of the 1% and restore sanity to the Republican party.

          That's my point, "little buddy", where does the law say "retail"? If the law doesn't specifically say "retail value" then it's open to interpretation. I already agreed that it's the OVERHEAD is why sandwiches cost so much, but there is NO OVERHEAD when you AREN'T PAYING ANYONE (i.e. volunteer) to make it. If it's just the cost of the components of a sandwich, you can easily make one for under $1.

          Where in my statement did I say that the Romney people had to prove they were not volunteers? Regardless of any other thing, a volunteer or anyone else who is voting can not be given anything valued at more than $1 for voting according to WI law.

          The fact remains that Romney and anyone else offering free sub sandwiches to anyone voting violated existing law. If he decides to ignore this law, what other laws will he decide to overlook? He has set a precedent and we have all seen it.

          You and Romney seem like a good fit. Ignore basic information and try to spin it to look like you are right and everyone is wrong.

                Oh, and the resulting narrow 219-212 party-line victory in the House hardly qualifies as a "strong majority" in favor of the bill that Obama said it had in essentially trying to order the Supreme Court not to overturn it. One wonders what school he attended that would teach him that a bare 7-vote win out of over 430 votes cast, while sufficient to pass it into law, constitutes a "strong majority." Obviously, he was taught by someone who does't know English (or math) very well. Where did he go to school, in Indonesia or somewhere? OH, WAIT........

                This only goes to show that the very boring and misleading Romney campaign needs to give voters a sandwich to garner any interest. Maybe the turnout figures in Wisconsin won't be 10 to 15% lower than '08 - like the rest of the country. Romney really should just pay for votes. With his blanket advertising, he's averaging more than $30 for every vote. He might as well just buy votes the old fashioned way. A $6 sandwich is just a drop in the bucket.

I have never seen so much inflammatory statements, name calling, etc, and newsvine comments collapsed by the community in my whole life. Either feisty knows someone or newsvine is turning their heads.

                            Really, so what if he gave free food. Harry Reed did it when he was campaigning to be reelected-and he did it to bring people to vote for him. I love how liberals think they are the only ones who matter and can do what they want, but nobody else can. This country should be thinking about the major problems we are in and about fixing the mess the O great one has done to this country rather than worrying about a subway sandwich.
