Gingrich campaign challenges Florida's winner-take-all rules, scraping for 16 delegates

Newt Gingrich will challenge Florida's winner-take-all allocation system, spokesman R.C. Hammond said.

The campaign is asking Florida to award delegates proportionally based on the primary results. The campaign is sending a letter to the Florida Republican Party and are supposed to post it on Newt.org tonight.

Asked if Gingrich campaign would be doing this if Gingrich had won Florida, Hammond said, "Probably not."

On Tuesday, First Read explained the rules controversy. A Republican National Committee contest committee would have to take up a challenge filed by a Florida resident in August at the convention and determine whether to keep the rules as is or change them.

For context, if Florida were proportional, Gingrich would get 16 delegates, given the state has 50 delegates to allocate and he won 32% of the vote. Romney would wind up with 23, Santorum seven to eight, and Ron Paul between three and four. It would, however, lessen Romney's lead from 50 delegates in the state to seven.

On election night one of the Republican TV commentators said that because Florida violated two of the GOP “Primary Election” rules that not only would they only be allocated half the delegates (already known and accepted) but it would end up splitting them proportionally like most other primary States.

I believe Newt will win and get his share of delegates.

The Florida primary violated rule 15b(1) - holding the contest before March 6 - and 15b(2) - holding the contest as winner-take-all. However, the rules committee has already declared that this constitutes only one violation because it is all rule 15b. One violation caused them to lose 50% of their delegates. All the candidates were aware of this before the primary.

However, you are probably correct that at the convention in August the rules committee will change its mind and award Mr. Gingrich some of the delegates. Of course, a lot depends on where the candidates stand at that time.

I know. Newt is sounding more and more like liberal, ends-justify-the-means Dems everyday! The next thing you know, his legal team will be filing briefs to challenge the voting procedure or demanding multiple recounts. We can't disenfranchise all of those Newtonians who meant to vote Newt but mistakenly voted Mitt!

Gingrich is a real whiner. He also doesn't file paperwork correctly to get on ballots and then whines about it. Is this conduct befitting a president?

We seem to have a consensus. Newt is a big baby and a sore loser.

On a serious note however, if the powers that be should decide that his claim has merit, what would this do to Paul and Santorum? Both of these candidates elected to forego their campaigns in Florida because of the "winner take all" stipulation. Also, it seems to me that the difference between a "winner take all" distribution of delegates as opposed to proportional would have to have affected the behavior of the voters. Would you have stayed home and not voted if you were a Paul or Santorum supporter, or would you have voted for the lesser of two evils between the front-runners?

Nice can of worms you've opened Newt.

It's a shame that the Florida Republican Party cannot play by the rules and decide to move their primary ahead in the calender diminishing the importance of their voters influence. As part of breaking that rule the state was penalized by reducing the delegates from 99 to 50. Additionally, in 2012 the RNC decided to have proportionately allocated delegates in the early primaries and causes. If Florida decides they want to move their primary forward to when all the other states are having proportionately allocated delegates then expect the same to happen. Funny how those words can be turned back on the chairman for the mess that they created.

At least there was a razor-thin margin between Gore's votes and Bush's. That means that either of them could have one (thanks for the mystery, Supreme Court!). But Newt definitely lost Florida: I don't recall 47% to 25% close. But I have to sympathetic to Newt (even though the man is as good for the presidency as salt is to an open wound), as the reason he lost so badly was because of Romney's negative blitz. Had Romney kept the negativity to a minimum, he still would have won but probably by a slimmer margin; let's say, 4-8%. Then his campaign would have been hurt more directly, given Newt a bump. Because he was negative, Romney may have cemented his nomination, but at the expense of independents in the crucial state of Florida.

But Newt, stop being a sore loser. We all know how cranky you can get when you don't get your way. And could you please stay in the race?? The dissension in the GOP ranks that you're causing is really beneficial to Obama and the Democrats and to America as a whole.
