NBC asks Romney campaign to remove network material from ad

NBC News today is requesting that the Romney campaign remove NBC material from an ad that went up yesterday in Florida attacking Newt Gingrich for 1990s-era House ethics charges.

The ad prominently features then-NBC Nightly News anchor Tom Brokaw reporting in 1997 on the ethics charges at the top of the Nightly News broadcast that evening, Politico reported this morning.

"The NBC Legal Department has written a letter to the campaign asking for the removal of all NBC News material from their campaign ads," said Lauren Kapp, NBC senior vice president for marketing and communications, in a statement. Kapp added, "Similar requests have gone out to other campaigns that have inappropriately used Nightly News, Meet the Press, Today and MSNBC material."

Brokaw also released a statement voicing his personal concerns.

"I am extremely uncomfortable with the extended use of my personal image in this political ad," he said. "I do no want my role as a journalist compromised for political gain by any campaign."

Glad to see NBC standing up for its integrity. The problem is--by the time the ad is taken down, the damage has been done and the election will have happened.

Hard to see if NBC can win this, litigating will take months ... the horse has left the barn ... if they do, however, it will send a lot of super-pacs running back to the editing room.

I think I remember CNN asking the Romney campaign to remove their logo and some other stuff from a campaign ad. So this is not new for Romney.

Funny that all the agencies / programs do the exact same thing to shape their story and narrative ... the late-nite comedians .... the Sunday talk shows .....

I saw this yesterday on.......MSNBC and wondered. Yet I have seen them run ads for some Fox shows over the past year or so.

Think you might be right SF, its more a warning to prevent more coming as the election season heats up.

bob---I want President Obama to win re-election without resorting to this kind of ad and I expect that he will. What the late night comedians and Sunday talk shows do is up to them but I hope they respect what is left of the integrity of the process.

Actually, we haven't sen the depths of what this election is going to bring to the table. Swift boating or that hit piece that Dan Rather did (caused his firing) were a walk in the park compared to what is coming.

Interesting, I wonder if NBC has any real leg to stand on for doing this? They aired the content, and it seems that the ads have adequatetly credited the source. How is what the ad creators did any different than anyone of us posting links to support an argument?

As for brokaw, to bad, it comes with the occupation.

For someone who believes in business he doesn't mind committing copyright infringement. christieg this was a news spot from 1997 which was true at the time but 2 years later the IRS cleared Newt of the charges. It was like reporting someone was arrested. Arrested doesn't mean convicted.

Brokaw in particular has every right to have his image withdrawn from the ads. If they want to use this material, the proper procedure in all cases is to request permission of NBC and Brokaw to do so. This stuff is all proprietary and they cannot use it without permission. NBC's broadcasts are not public domain material. It seems pretty cut and dried to me.

NBC and Brokaw don't want to be seen as making an endorsement, and some might assume they were taking sides. There is still a thing called copyright law.

They also likely don't want things twisted oct used out of context.

I am sure Romney will do the right thing here.

(FYI I am a democrat and certainly would never support Gingrich and unlikely Romney--though there is a slight chance there))

All they have to do is put up what ever they want in print, but they should never use film footage. For example the POTUS's campaign can put in print newt's and perry's quotes about mittens being a "vulture capitalist" but not film footage of them personally saying it.

Tom Brokaw is a fine man, but let's not pretend he isn't a liberal to the core.

Just on Friday, his reporting on NBC News amounted to a love letter to the liberal Democratic Governor of the bankrupt failed liberal state of California, Jerry Brown, who of course is hyping to raise more taxes to support his boondoggle high speed train to nowhere..

Dont expect NBC reporting positively on successful popular GOP Governors like Chris Christie or Bob McDonnell, they will get the snarky treatment from NBC, as usual.

As to Christie, even Sarah Palin said he had made "rookie mistake" attacking Newt and "got his shorts in a wad" or something like that... He isn't favored by all conservatives. Plus he said Romney had won Iowa after he had threatened voters and then Romney didn't win Iowa. Then Christie was very definitive about S Carolina, and again, nothing. A true statesman doesn't just shoot his mouth off like that. Just saying.

I agree about the Greatest Generation---Tom Brokaw really did a great service to us all by highlighting those stories. I don't think of that as conservative or liberal but rather as patriotic. I really hope that we could all agree on something as basic as that.

The Greatest Generation, what a great read!, Brokaw does have a libertarian streak in him, but half the libertarian position democrats should love, the other half they hate.

Brokaw reminds me of a child of Kennedy Democrats, he believes but keeps his own opinions. That I can respect.

The book itself kinda reminded me of Profiles in Courage at least in it's points.

The Greatest Generation although still partisan pulled together against a common enemy and was idolized by the world for thier sacrifice and dedication. We had it again for a brief moment after 911 but sadly the forces of greed and self enrichment pullled us from that into a war fought only to enrich the politically connected.France standing shoulder to shoulder with us in Afghanistan was villified because they would not kiss the ring of Dear Leader and any other country that dared disagree with them was demonized as godless heretics.

    Tom Brokaw reported that story fairly as far as the story went. For all those who think politics and news reporting started in 2000 news men used to report the news not opinion. Romney is the one not reporting that the final disposition of the case 2 years later cleared Newt. I'd like to see Tom Brokaw's report on the news of that but Romney isn't going to pirate that for his campaign. NBC could on the other hand run it as a response to the use of his report in the ad

    I think the average person sees every reporter as being a bit to the right if the person feeling that is a Democrat, and a Bit to the Left if the person feeling that is a Republican.

    BTW Glenn Beck, Rush Limbaugh, Rachel Maddow and the like are NOT reporters. They are commentators and interviewers.

    Fox has very few reporters. they are almost all editorial. Almost all of the cable talking head shows are not reporting. Reporters don't express much in the way of opinion.

      I am a proponent of free speech Leona. I enjoy having open, honest discussions on both sides of an issue with anyone who expresses themselves and their viewpoints in a respecful, thoughtful manner.       Suffice to say, I like the U.S. capitalist system. It works for people like myself who have gotten a higher education, paid back loans, worked hard, have a business and a decent life. I would like the same for everyone....... Problem is, some people don't think they should have to work for it.

      Capitalism is when the free markets work unimpeded by govt. regulation and heavy taxation. You win some and you lose some.

      Socialism is when the GOVT's heavy hand steps in ( supposedly to "help" people) but as soon as they get involved, they have control over you. You are no longer in control of your destiny.

      A simple example: the govt. bails out a car company and then turns around and says "you must build "green" cars whether it is profitable or not.

      Another example . The Unions are bailed out by the Democrats in govt. Then the Union leaders tell all the Union worker lemmings that they must vote Democrat.

      I'd rather have my "life, liberty and the pursuit of happiness."

              None of that ever got me laid. But getting laid did not require intelligence anyway. I am sure you are indicative of that.

I would also like people to understand that what is true in the big cities is not necessarily true when your house is surrounded by corn fields. You call English as the official language racism thinking only of areas where the only languages are English/Spanish without understanding that where I grew up 14 languages were spoken in a 2 mile radius. A Texas legislator once asked me about that: " I told him english only I didn't care about, I would settle for english also."                     First of all, where did I say a major news source just told a lie??

                    I do claim that the liberal media "spins" the truth or hides it. That can involve embellishments to issues to make them sound better than they are. That can involve deleted facts to leave one with only a partial story.

                    I heard on "Morning Joe" today 2 people say 2 opposite things about Obama.

                    One person's opinion was that Obama helped improve the overall economy. Joe Scarborough then said "No one believes that."

                    So, like I said before, one man's truth is another man's "spin" .

                    Why pull a Nightly News report already aired on NBC? If it was news then, it's still relevant now. Gingrich has to account for every error or misstep in his past or present. Unless NBC lied or manipulated the news, let it air!

                      There has been increased interest in intelectual property and the prevention of piracy. While the focus has been primary on China and India but it exists in the US as well. Taking images, or sound bites without prior permission from the person or entity that owns it is the same as stealing anything else. For the Romney campaign or any other, for that matter, to use TV images or sound bites without permission can be considered stealing. They may have gotten away with it before but they may not this time around.

                            I can understand Brokaw's objection. Most ads using news anchors include several news sources - NOT just ONE source and ONE news anchor. This ad could give the perception that Brokaw is affiliated with Romney.

                            But this is just more of Romney's ad team's blinded hate - to use a Liberal news source against Gingrich.

                            This ad will hurt Romney if he doesn't remove it as requested- because Brokaw is well respected by the public, in general.

                                                Kind of highlights another problem with PACs. They knew they would get caught but did it anyway knowing that the commercial would be off the air anyway buy the time the complaints came in. There should be large FCC fines for copyright infringement by these PACs otherwise they will just keep doing it. The whole idea of PACs is so scummy that I doubt they attract people with the highest ethical standards so I don't think they will stop on their own.
