In Virginia ballot appeal, Perry loses again

A federal appeals court has rejected Rick Perry's request for an emergency order to put his name on the primary election ballot in Virginia.

Following the reasoning of the federal judge who rejected Perry's request last week, a three-judge panel of the Fourth Circuit Court of Appeals in Richmond said Perry "had every opportunity to challenge the various Virginia ballot requirements at a time when the challenge would not have created the disruption that this last-minute lawsuit has."

The Supreme Court, today's ruling says, has repeatedly urged that judges not "upend the orderly progression of state electoral processes at the eleventh hour."

Allowing Perry to pursue his complaint now, about the process for gathering signatures on petitions to qualify for the ballot "would not be fair to the states or to other candidates who did comply with the prescribed process in a timely manner, and it would throw the presidential nominating process into added turmoil," the court said.

"I am pleased with the Fourth Circuit ruling and that Virginia's orderly election process will be able to move forward," said Virginia’s attorney general, Ken Cuccinelli, who defended the state’s balloting system in court.

NBC's Carrie Dann has the response from Perry campaign spokesman Ray Sullivan:

"We are proud to fight for the rights of Virginia voters to be able to make a meaningful decision and cast their ballots for the candidate of their choice. This appellate ruling only affirms the trial court's assertion that the state's process of printing ballots should not be disrupted. An orderly ballot access process is important, but of little significance if viable candidates are unconstitutionally kept off the ballot. The trial judge's holding that the statute is unconstitutional is not disturbed. Gov. Perry is weighing options for appeal."

Now if only CNN would stick to their rules about who is eligible for debates. Seriously, signatures are another important way to vet candidates, second only to individual campaign contributions. Perry has neither--only one zillionaire.

Oh and cheers for executions (though apparently he's not tough on crime when it comes to kids urinating on dead people). Maybe we should use debate audiences as a way to eliminate candidates as well. Paul is out for the cheers to let the uninsured person die, Santorum is out for the boos against the gay Iraq vet, and now Gingrich is out for cheers in support of his class warfare.

This is not the only thing that "Scary Perry" has lost America! He has lost all ability to think rationally, and has lost all ability to intellectually research material given to him. "Scary Perry" has lost all ability to understand Foreign Policy, the US Constitution, the Civi Rights Act Of 1964, and the simple fact that the South lost the Civil War. Rick's team of Texas lobbyists and GOP operatives have been used to manipulating the opinions of Texas voters for a decade. In a state ranked last in education, it has worked well. Many Texans spout the Rush Limbaugh hate vitriol the GOP misleads them with daily. You know the one"OBamas a socialist, 51% of Americans don't pay taxes, creationism is valid science, lets rewrite our history books and exclude anyone who isn't a religious right figurehead, the Civil war was over states rights not slavery blah blah blah.

Rick will stay for much longer because he has a hefty bankroll of Texas fundamentalist capitalists behind him. The evangelicals went with Santorum, who doesn't have a viable candidacy either. Mr perry has proved that it is ambition and luck that takes someone up the conservative ladder in politics, not intellect, education or American values enshrined in the Constitution. Adios Rick, game is really over, you just don't want to admit it because this way, you get to spout your message of hatred for a while longer on the national stage before being banished back to Austin, where the constitutents are willing to buy into your weird politics.
