In a victory for the Obama administration, a federal appeals court panel has lifted an injunction on the use of federal money to pay for research using embryonic stem cells.
Since 1996, Congress has banned the use of federal funds for research in which embryos were destroyed. President Obama acted to expand the use of stem cells by permitting the federal government to support research only on the stem cells themselves -- not the actual gathering of the cells from embryos, a policy which the administration said was entirely consistent with the law. But last year, a federal judge in Washington ruled that because embryos must be destroyed to get those cells, the congressional limitation bans using federal money on anything done with the cells later.
Today, by a 2-1 vote, the appeals court threw that injunction out, finding that the congressional research limitation is ambiguous. The federal government, it said, "seems reasonably to have concluded" that although the congressional ban blocks funding for the destructive act of deriving a stem cell from an embryo, it does not prohibit funding a research project in which such a cell will be used.
The government allows research using only stem cells derived from embryos that were created by in vitro fertilization for reproductive purposes and would otherwise be destroyed.
Last year's injunction threatened about 200 research projects that relied on federal money already granted. Because these grants were renewed every year, many of the researchers said they'd have to stop when the money ran out.
The National Institutes of Health is expected to comment on today's ruling later in the day.

Much of the medical research is directed towards diseases for which the profit motive is not clear and there is no incentive for private investments in the cures. There is also a patent issue. Can a stem cell solution to a medical problem be patented? If not, private money is not going to fund the research.

Does a private company have an incentive to identify a treatment or cure for a rare disease or a cure that involves an inexpensive stem cell procedure? I'll answer for you. NO.

You know it's possible to cure arthritis in dogs through stem cell therapy, but noone cares if research is done from canine embryos. It's sad that veterinary medicine has surpassed human medicine by a long ways on this front.

I've never understood the thinking of those who are opposed to having embryos destroyed to seek life-changing and possibly life-giving medical technology yet did not object to having them destroyed for no purpose. My understanding is that they can only use cells from embryos that would other wise be destroyed. (in-vitro embryos). Are embryos regularly destroyed during the in-vitro process? Like the Kate plus Eight thing. She just happened to keep all of them right? Doesn't this often happen during fertility treatment and the unwanted ones are destroyed? And if so, why have I not heard any controversy surrounding this?
Anyways, great news. You know, I've been under the impression for many years that it was Ronald Reagan that stopped the research on stem cells. Looking at the 1996 date I may have to go back and research that. But nonetheless it does remain to be a problem with conservatives. And I know a lot of research had been done on Alzheimer's with stem cells, which Ronald Reagan had quite a cased of.

They believe that all stem cells are harvested from aborted babies...threy're not. Parents are now having the embrionic stem stells frozen...just in case. This is going to become part of the abortion issue and not a scientific issue.

I am not at all religious and I am pretty liberal, but to think it is ok to promote stem cell research from aborted babies-bad. It is a little too much even for me. I guess this a heartening decision for science study. However, one thing about this debate always sticks in my mind. A woman caller on our local right wing propaganda station made a very interesting point concerning stem cell discussions during the first term of the Bush Administration, which at the time halted further research. Her statement, and I quote, "Thank God for President Bush to save all them stems." That about covers it. What else is there to say?

Why is the federal government funding the research to begin with, why not let private companies/corporations pay for the research? One of the major problems with the government is they fund to many programs, both research and social. We could reduce or eliminate a lot of programs and most people wouldn't even know they were gone.
Because if private companies funded it, it would be for profit. Costs would skyrocket and companies would withhold information on proprietary grounds.
Because all research derived from Federally funded programs, even if that's not where they get all of their funding, must make ALL of there research and results publicly available, thus preventing the whole licensing crap that private companies would do.
The Federal Government, any government, has a vested interest in funding basic scientific research - if all research was tied up in private corporations, you'd never have the Edison's, etc. of the future.
Can you imagine the uproar if there was a profit being made during the destruction of these embryos?

This win gives America an equal chance to compete with other countries in the medical field. Some day you may need this research to cure yourself. It is a better investment than Nuclear Power, which does get billions.
It says the research can only be done on cells taken from an embryo derived from in-vitro that would otherwise be destroyed. It also says this does not fund the collection of of cells because it would result in the death of the embryo. But if they can only work from embryos that would otherwise be destroyed, then why couldn't funds be used to collect from them?
The Democrats have been in charge for going on five years and the Republicans for six years before that. The problem is Congress no longer understands the difference between governing and popularity contests.
Congress needs to do two things. First, they need to get out of the education business. Most of the states will require teaching of science and keeping religion out of the classroom. Parents will move their families wherever they need, to get the best education for their children. Employers will hire people trained in science. If there are any school systems where creationism is taught, employers will shun students from that area of the country.
Second, Congress needs to trash the 74,000 pages of tax-code and end the manipulation of the American people caused by that tax-code. Americans will regain respect for the American system as each day they will go to sleep with less stress since they know their taxes are paid up-to-date as they go about their daily lives buying and selling and paying sales tax on the end-user transactions.
With the federal government out of education and out of confiscation for the reward for our labor, we can locally decide to support stem-cell activities and facilities.
The fact is that a potential fountain of youth might exist one day through stem-cell research. Before that happens we need to have the best educated children. Those children should not be hampered by a national education policy that even mentions a concern about a religious policy.
Bush was an idiot that needed major breakthroughs in stem-cell therapy for his future treatment. Unfortunately for him and millions more of his age it is too late for major breakthroughs. Well, perhaps I am being too hasty. After all, scientists have already had success with reversing (REVERSING) the age of rats. Maybe Bush can get into that research program?
When will this stem cell issue end? Embryonic stem cells have the potential to benefit all society. Democrats, Republicans, liberals and conservatives can all benefit from further research. What person in their right mind would oppose a chance to heel the sick and alleviate human suffering? We must use all available means to further medical research, not impede it.
