How soon will the Obama Justice Department be able to defend the legal challenges to Obamacare before the Supreme Court?

I assume they're eager to defend those challenges?

Why wouldn't they be eager?

Thank you First Read, Domenico Montanaro for the recap. The polls simply reflect the confusion people have based on the negativity from conservatives and that's evident because so many believe the bill has been repealed. The irony is those who think it's been repealed and believe they have escaped the GOP predicted Armageddon are reaping the rewards of the parts which have been implemented. How sad it is that instead of checking the facts for themselves, they simply base their opinion on what some legislator told them.

I'm going to watch this later when I'm on a computer with sound. Last night Brian Williams made some snarky reference to the HCR anniversary, without informing the viewing public of any of these facts. Kudos to First Read for trying to inject facts into the debate.

    That begs the BIGGER question, as to whether or not Thomas will recuse himself?

    Seventy-four House Democrats, led by New York Rep. Anthony Weiner, sent a letter to Justice Clarence Thomas Wednesday calling on him to sit out deliberations on the Affordable Care Act because of his wife's ties to a lobbying group that opposes the health care law.

    "The appearance of a conflict of interest merits recusal under federal law," the letter said. "From what we have already seen, the line between your impartiality and you and your wife's financial stake in the overturn of healthcare reform is blurred."

    Justice Thomas' wife, Virginia Thomas, founded the conservative group Liberty Central, but stepped down in December amid controversy over a memo under her name calling for the repeal of the "unconstitutional law."

    The group, which later took down the memo from its site, blamed staff error and said it "assiduously avoids" taking positions on the constitutionality of issues.

    Under federal law, justices have to recuse themselves from cases where they feel a conflict of interest may arise, or if their spouses have a financial stake in the case, but the decision ultimately rests with each justice.

    Justice Thomas, who has been on the Supreme Court since 1991, came under heavy criticism last month after reports emerged that he omitted his wife's place of employment in his financial disclosure forms.

    The most obvious recusal would be Supreme Court Justice Elena Kagan.

    As Judicial Watch has noted, there may be a conflict of interest regarding former U.S. Solicitor General Kagan.

    From my own personal experience, the Nasty Redhead never really puts anyone on "ignore". She just threatens it in the delusional belief that anyone would actually care. I too have been threatened and later , when it became clear it was a pretend" ignore", asked her to really put me back on real "ignore". No such luck.

    This is one more bit of proof that my theory of Liberalism is correct: It is a mental illness that only gets worse as time goes on (thus the term "progressives").

    Don't you find it interesting that the large number of Representatives, Senators and Government cabinet members also can't file taxes, even when guys like Charlie Rangel write the laws and Geithner, well, just what does Tim do these days? Now how do these guys rate on your impartial scale?

      When money equals speech, only the rich will have a voice which can be heard and sustained above the din of noise created by the less monied. Money equals AMPLIFIED speech, it should exist, ONLY, in a regulated environment. AMPLIFIED speech is not the same thing as free speech.

      What is truly sad is that so many think the law has already been repealed. I put the blame for this ignorance squarelyon the shoulders of the media, they have done an awful job in this whole debate over health care, with talk of death panels and other such nonsense. Sadly, unless your family is helped by this legislation, you will never find out how it benefits the average American if you rely on the pundits.

        Applying this example, lets say health care costs increase by about 12.3% in 2003 for N. Californians. Some years less, some years more.

        Lets start out with a $1,000 premium. If you increase the cost of the health care premiums by 12.3% every year the premiums would look something like this:

        Year 1 $1000
        Year 2 $1123
        Year 3 $1261.13
        Year 4 $1416.25
        Year 5 $1590.45
        Year 6 $1786.07
        Year 7 $2005.75

        So,....you have the cost of health care premiums DOUBLING every seven years.

        I'm from Detroit. Let's apply that to cars shall we? Say ya' buy a Dodge Stratus for $23,000. Applying the health care price increase formula you will pay $46,000 for the same Dodge Stratus in only 7 years. In another 7 years you would be paying $92,000 for the same car, and in another 7 years after that same car will cost you a mind numbing $184,000!!

        See why health care captured the attention of the party of action? The party of grownups? The party of let's-roll-up-our-sleeves-and-get-this-done?

        Health care costs are borne by employers in this country. How are our companies supposed to compete? Employee compensation (blue and white collar) only amounts for about 10% of the cost of a car. The rest is overhead, raw materials, and yes, HEALTH CARE. All of Detroit's competitors have socialized medicine which frees up their capital to put back into their product development. The U.S. also picks up the cost of their defense for them. South Korea and Japan both benefit from U.S. bases in their region; 38,000 U.S. troops in S. Korea alone.

        The reason why auto Unions in this country get an exemption on ObamaCare is that we fund our OWN health care system called VEBA. Look it up. That's something Glen Beck doesn't have the stones to tell you. My Union gave up a lot to negotiate for it.

        Somebody had to do something about health care in this country because the republic party sure as He!! wasn't going to do anything to address the issue.

        My union, which operates its own non-profit health care plan, urged me to contact my elected representatives because Obamacare imposed a 40% excise tax on so-called "Cadillac" health care plans...and my union had negotiated away wage increases in lieu of improved health coverage.

        That was beautiful...trying to restrain the rate-of-increase of health care costs by forcing ordinary middle class workers, union and non-union, to endure higher co-pays and out-of-pocket expenses. What could be more cynical and cruel?

        Anyway, that's what MY union said...and, under pressure, Obama agreed to delay implementation of the excise tax.

        Did the UAW object to the excise tax, Greg?

        Eventually, maybe he'll hand us one of the hundreds of Obamacare waivers that have been issued.

        That's what I'm hoping...

        Not sure Mixed Bag. Most of this won't hit us until 2014. I know I am blessed to be a UAW employee. Hearing the stories of other people out there and what they are forced to pay is sickening, and it underscores what a bubble I live in.

        Something had to be done about health care because it was bleeding all of us white.

        I think you are right Anna Molly. Republicans like to preach "free market", and then squelch whatever chance we might have had at an effective control on a market monopoly.

        Most insurance markets are monopolized by one carrier, and there is ample evidence of collusion between companies. Such a case allegedly is under investigation by Michigan's AG now.

          Sure Indy. In addition to the other disadvantages that hobble U.S. companies the diet of the U.S. culture doesn't help either.

          A lot of the U.S. health insurance customers consume Big Macs, chain smoke Marlboros, are sedentary, and drink Mountain Dew like it's water. This spikes the costs for health insurance companies as well. If people want to engage in elective lifestyle choices that are unhealthy, there is no disincentive (except death) for them to do so.

          Meanwhile, Japanese eat fish, rice and sea vegetables.

          Tell a Japanese person they have to change to help their country, and they'll do it. Tell an American that they have to change their diet, and that is an affrontery to their American individualism.

          I know Tea Partiers who are on foodstamps, unemployment insurance, Disability and/or Maine Care. They vote Republican because the ideology appeals to them, although they live a reality that is quite different. You can't get through to these people, I've tried. They think it's always "someone else" who is taking advantage of the system, not them, they "deserve it." Hypocrisy is rampant in today's American political landscape. I think it's amplified by conservative politicians who tell their base they are the "real American," salt of the earth, and it's always the lazy neighbor down the road who is the leech.

          I dont feel like i should be forced to have health insurance, I think everyone would like to have health insurance if they could afford it. If you need affordable health insurance search online "Wise Health Insurance" you dont want to be with out insurance any time.

          If you have a heart attack at home what are you going to do? Just sit there and say, "Well,....I haven't paid in to the system, so I guess I'll just sit here and die."?

          Hell no you won't. You are going to be on that phone dialing 911 so fast the sudden acceleration will make your nose bleed.

          Then you get "free" health care in the ER on the taxpayer's dole.

          Nothing good in this life comes easy. Nothing good in this life comes cheap. There are NO FREE LUNCHES!! A few universalisms I have learned.

            HEALTHSCARE TAX OR FINE---- It's not good to believe false prophets

            No Republican voted for the healthscare bill --- THANK YOU – whatever your political party, if you voted against the healthscare TAX/fine; Much of the current bills/ “reforms” have more socialistic mandates than carter has pills. States are getting mandated funds for a healthscare scheme. - if all goes well for the left, workers will see a healthscare tax on there paycheck – courtesy of the feds.

            Some think healthcare it is a human right/You cant just make someone sell all of his property because he/she had surgery more than once on his/her leg. If the country is broke stop cutting taxes just to win the majority. Those who are able to pay more, must pay more in that case, this would be a priority, as well as cutting down on the military sector. -

            --- Reply to above – agree, Those who are able to pay more, must pay more – although the Obamacare plan leaves no option to the people that do not want public option – some people are satisfied with the health care they are currently enrolled with. Public option apparently means all should have the same health “care” - we all must suffer equally, because the present bill/tax/fine extends an already inadequate health “care” “reform” scheme.

            Sorry, health care is not a right, it is a privilage; all the reform in the world will not get healthcare for everyone that needs actual care. - The rich can not, should not, and will not pay for all the needs of the poor – and taxing the “rich” philosophy eventually taxes the middle class – usually more than once.               Health care is a business for profit.....your point is that if you cannot afford it at some time in your life, you are rightly deserving of the suffering until death because it is that you do not have enough value to the nation to live because you are not profitable enough in what you can do to make a living. This is why the wealthy live longer and higher quality lives. Unfortunately, what is profitable is not the measure of a man's worth to society or his god. Teachers earn less than lawyers....so their lives should be of a lower quality and length? Many men and women have contributed to making this nation great.....most did not become wealthy. Was Rockefeller a better man than others? He was a person who caused many to lose all they had, but his family profited.....is this what America stands for?

              WHY are people considering a sweeping overhaul of healthcare, -that mentions little of actual reform, -it seems people forget the gov. bureaucrats, and their social programs, have never saved America money, rather they waste money – as shown by much mismanagement of stimulus, and people see more debt getting dumped on us – when will we wake up and understand there are consequences for our actions – will we wait til our Republic is so poor, that the gov. has total control of our finances, and our lives through mandated reforms. Health services needs reform, NOT healthcare, -the fact that private enterprise does not have the severe mandates offered in this healthscare scheme is why Americas healthcare is better quality than gov. controlled healthcare.

The next time a war breaks out and you need the children of those workers who do not make large sums of money to protect your investments.....send your own kids to fight. Oh yea, you can hire kids from central America....they are so damned poor they will join to stay alive and send money to their families.....come visit Camp Pendleton and see who's kids are there.....you better be able to speak Spanish.
