Ill. court issues stay; Rahm back on the ballot


The Illinois Supreme Court has just issued a stay of the appeals court's order knocking Rahm Emanuel off the ballot and directing the Chicago Board of Election Commissioners to restore his name to the ballot.

This is a strong indication that the court will accept the case and, perhaps, of which way the justices are leaning.

*** UPDATE *** NBC's Pete Williams has more:

Less than 24 hours after an Illinois appeals court bumped Rahm Emanuel off the ballot for Chicago's election for mayor, the state's supreme court put that ruling on hold and ordered the city to include his name on any ballots being printed.

"The Board of Elections is directed that if any ballots are printed while this Court is considering this case, the ballots should include the name of petitioner Rahm Emanuel as a candidate for Mayor of the City of Chicago," the Supreme Court said in a one-page, unsigned order.

The court said it acted after receiving legal briefs from Emanuel and from his legal opponents who claimed he was unqualified because he did not meet residency requirements of state law. Today's order left unresolved whether the state's high court would take up the entire case on a speeded-up basis, but the order gave Emanuel the rapid relief he was seeking -- to keep his name on the ballot.

*** UPDATE TWO***  NBC Chicago's Mary Ann Ahern reports that the court will hear Emanuel's appeal.

Uhhh....the Supreme Court interprets the law, @Arwen, so, given their apparent decision to take the appeal, according to the law its unclear (or perhaps perfectly clear and the state court of appeals screwed it up in their decision).

Wow! He's in, he's out, he's in, he's..... Enough already.

This is a great example of how flimsy gov't has become. Perhaps, an indicator why Illinois is on the verge of bankruptcy???? The courts are obligated to look at matters and make a decision without gray according to the written law. This wreaks of politics from the bench. As I've not seen the case, I'm not sure which court is injecting political views, but one of them is.

      Hopefully, the Illinois SC will declare the residency requirement itself illegal because it shouldn't appear that the court is bending the law for one specific candidate. The legal playing ground is supposed to be level.

            Give me a break! Emanuel was Chief of Staff for the President of the United States. Some would say he was serving his country by serving the President. He has lived in Chicago all of his adult life. Unlike the job of Congressman, which is not a 24/7 job, being Chief of Staff of The White House is potentially an always on call job. When the only way a candidate can win, is to get another otherwise qualified and likely to win candidate thrown off the ballot, that really stinks. First Braun ordered Bill Clinton to stay out of Chicago or Black America would disown him, now its get Emanuel thrown off the ballot. The State Supreme Court acted properly and Emanuel will be the next Mayor of Chicago. Good news for the citizens of Chicago, Emanuel will do much to benefit the city. Much more than Braun would do...

            I agree. So if a guy is called to serve in the army by the U.S. government and is gone for two years - in Illinois could not run for Mayor?????

              I believe he was offered a job by POTUS not requested. Chief of Staff is a job. In the military, you are not requested or offered a job, you are ordered to move. Besides, if you are in the military and you reside in a state for one day, I will guarantee you will pay income taxes to that state. You don't have to be a resident to pay income taxes to a state. New Hampshire residents pay Massachusetts Income taxes if they work in Mass.

                Sorry Soupy you are incorrect. I have served 23 years in the military and have always kept my home states residency. Voted, paid taxes, kept my Drivers License, car registration ect. Never paid the state income tax of where I was stationed.

                    I am tired of politicians being categorized the same way as the military as far as 'servants' go. They are not the same and should stop being viewed as one in the same. This is just another example of politicians / celebrities etc. being above the law and getting to play by a different set of rules as the rest of us.

                    Obama doesn't have to be naturally born and Rahm doesn't need to live in Chicago. Rules are for all you losers out there. Just remember when your arrested in the future for speaking your mind our keeping a firearm that the arresting officers "don't need no stinking badges".

                      It's funny how Obama critics blame him on everything connected or not connected to him, yet, when anyone mentions how the bank and automobile bailouts, the failed economy, or the high unemployment were because of failed Bush policy it's "there you go again".  Got to hand it to misinformation.

                            How ironic. We have a president who may or may not meet citizenship requirements for his office and Chicago might have a mayor who didn't meet the requirements for his office either.

                            If he were serving in the military overseas for 2 years I'd expect that he would be eligible for being on the ballot. Since he was serving our country away at the White House, at the request of the President, he should still be eligible.

                                 This is so stupid !  Why and the hell did the Illinois supreme court put his name back on ?????   The law is the law !!  It states as plain as can be.....you HAVE to "live" for 1 year in the city of Chicago !!! Live, meaning YOU have to occupy the home that resides in the city of Chicago !! Not just own it, not just rent it out, not just intend to come back to it someday....but actually "live" in it !!!  Emanuel should have read the damn rules before he quit his cush job at the white house...

Give him a year and you along with California will be mooching money from all the other states because you can't pay your bills.                                               First off the person's name is Robin not "Rob". Secondly lots of tax money is taken from New York, Cali, Vermont and spread around the country. It has been like that from the very beginning of the fed income tax. The color the state votes for has nothing to do with the distribution. This should make the libs happy as they always want to take, tax and spend. Thirdly I didn't speak, I wrote a response.
