Ill. court issues stay; Rahm back on the ballot


The Illinois Supreme Court has just issued a stay of the appeals court's order knocking Rahm Emanuel off the ballot and directing the Chicago Board of Election Commissioners to restore his name to the ballot.

This is a strong indication that the court will accept the case and, perhaps, of which way the justices are leaning.

*** UPDATE *** NBC's Pete Williams has more:

Less than 24 hours after an Illinois appeals court bumped Rahm Emanuel off the ballot for Chicago's election for mayor, the state's supreme court put that ruling on hold and ordered the city to include his name on any ballots being printed.

"The Board of Elections is directed that if any ballots are printed while this Court is considering this case, the ballots should include the name of petitioner Rahm Emanuel as a candidate for Mayor of the City of Chicago," the Supreme Court said in a one-page, unsigned order.

The court said it acted after receiving legal briefs from Emanuel and from his legal opponents who claimed he was unqualified because he did not meet residency requirements of state law. Today's order left unresolved whether the state's high court would take up the entire case on a speeded-up basis, but the order gave Emanuel the rapid relief he was seeking -- to keep his name on the ballot.

*** UPDATE TWO***  NBC Chicago's Mary Ann Ahern reports that the court will hear Emanuel's appeal.

          The man keeps a house, pays property taxes and votes in Chicago he is a resident. Military personnel doesn't keep residence in their state but can vote form that state. That is the right thing to do. Emanuel is serving the government.

              Mayor daley is retiring because of his wife, she has been fighting cancer for 10 years and who knows how much time she has left.

              Mayor Richard Daley is Not His Father. Mayor Daley has cleaned up chicago in alot of ways. the public housing is goan, Hoods on the west and south sides are going through renovation, crime is down (believe it or not) property tax remain low, city services have been privitized.

              He leave the City in much better shape then he found it.

                  Why is this issue even in the courts? The Illinois constitution clearly states that one does not lose residency if they leave the state to do the nation's business! He rented out his home and went to Washington to serve in THE WHITE HOUSE. Do we really need a pack of lawyers to understand this? Chicago politics, I guess.

                    Joe - the state statute has nothing to do with the statutes/rules for residency of the city of Chicago. "Reside" does not mean to own or rent property - period.

                        Illinois is the most corrupt state in the union, and most of their governors end up in jail. According to news reports, Illinois ranks second worst in terms of debt, but the residents of Illinois rewarded their crooks by returning Quinn and company to office. A few weeks later, Quinn showed his appreciation by increasing the state income tax by 66%. Obama, Quinn, Blogo, and Daley, what a bunch of left-wing crooks.

                        Well, apparently it isn't so much a law as it is a guideline. :-(

                        I wanna be a judge. Basically, you can just overturn any law you want to, unless some other politician ... err, judge ... above you overturns your decision. So much for the rule of law ...

                          So, who didn't see this one coming? The wind is not the only thing blowing in Chicago. Money, power, and loyalty to the Democratic party will be the deciding factor in the question of Rham's residency, not the equal application of law that should be considered.

                          Illinois is Obama's adopted home state, so I'm sure word came down from the Obama Crime Syndicate to put Rahm-bo's name back on the ballot or suffer the consequences...

                              The Illinois Supreme Court just issued a "stay", requiring if any ballots are printed, the ballots must have his name on them....this isn't over yet...., and a full decision hasn't been reached yet. I'm sure the lawyers on both sides are working fast..looking ahead in the future....to the possibility of an appeal after the election, or the possibility that this case will go to the U.S. Supreme Court.

                                The corruption in Illinois is only matched by the stupidity of the population. They continue to vote for politicians who hold them back and give them welfare checks......free money. Rham is one and the same. Maybe someday we can split Illinois in two. Cook county and the rest of the state, which is how we voted by the way. Carry one county and win the state (Governor Quinn) Daley is the new Chief of Staff, hhmmm. Only the names were changed to protect the ..........president. Speaking of the President, and the legality of being...........birthers will get even more justification due to Rahms breaking of the rules......it all stinks to high heaven.

                                What we are witnessing first hand on the national stage is just how truly corrupt politics, and judges, are in Chicago and Ill. They are in fact literally a political mafia. I have no doubt that there have been unspeakable things done to folks that got in their way. What I don't understand is the ignorance of the population and their propensity to keep putting corrupt people in office and just go on down the way. If they are an indication, regular folks can see how we will all end up under the thumb of a dictator one day.

                                  You have just made a great point, don't blame cook county for being the most populated county in Illinois. brady could have gotten some votes in cook county, but he did not campainging there, same for mark Kirk, we have had many US republicans senators and they all came to cook county to get votes. but what did mark Kirk do, he tried to supress the vote in cook county. I'm am so glad he is not a democrat, you republicans will love him in the senate. LOL LOL

                                        If anyone is wondering how Rahm got back on the ballot to be Chicago's Mayor, it's called friends in high places. President Obummer ( oops, my bad!)
