Ill. court issues stay; Rahm back on the ballot


The Illinois Supreme Court has just issued a stay of the appeals court's order knocking Rahm Emanuel off the ballot and directing the Chicago Board of Election Commissioners to restore his name to the ballot.

This is a strong indication that the court will accept the case and, perhaps, of which way the justices are leaning.

*** UPDATE *** NBC's Pete Williams has more:

Less than 24 hours after an Illinois appeals court bumped Rahm Emanuel off the ballot for Chicago's election for mayor, the state's supreme court put that ruling on hold and ordered the city to include his name on any ballots being printed.

"The Board of Elections is directed that if any ballots are printed while this Court is considering this case, the ballots should include the name of petitioner Rahm Emanuel as a candidate for Mayor of the City of Chicago," the Supreme Court said in a one-page, unsigned order.

The court said it acted after receiving legal briefs from Emanuel and from his legal opponents who claimed he was unqualified because he did not meet residency requirements of state law. Today's order left unresolved whether the state's high court would take up the entire case on a speeded-up basis, but the order gave Emanuel the rapid relief he was seeking -- to keep his name on the ballot.

*** UPDATE TWO***  NBC Chicago's Mary Ann Ahern reports that the court will hear Emanuel's appeal.

    This is Chicago/Illinois politics. Is anyone really surprised? And the people of this country voted for a Chicago politician for President and imported all his buds from the Windy City. Go figure! Maybe our schools are going downhill because the brains of the average citizen are going downhill. Too many vote not according to the ability of the candidate but according to what the candidate promises to "give" them. What ever happened to the independent pioneer spirit that made this country great? I for one don't want them to "give" me anything because it means giving them control of part of my life. I just want them to stay the h%$# out of my life and if they decide to make me give them moneyf or something they damn well should come through on the promise of what MY money was supposed to get me. We really need to stop accepting lying as just part of the politican game. How about legal penalties for politicians who are proven to have lie? After all you can go to jail for lying to the FBI, I would think lying to the whole nation to get in a position of power should be classified as fraud and punished accordingly like Madoff.

    Did people really think the Illinois Supreme Court would stand in way of the Daley machine? Be real. This was fixed months before Daley made his announcement to retire.

    Emmanuel holds about a 20% over his nearest challenger....Chicago deserves to be the hole it is when they elect thugs like Daley and/or Emmanuel.

    Why is anybody questioning his residency. Are they afraid of running against him. Another political move from the other side. Who influenced the appeals court. One of the judges had links to his opponent.

      Well I moved from one state to another, but they wouldn't let me vote in state elections, because I hadn't lived in the state for more than 6 months. Funny. They didn't make an exception for me and that was just to vote, not to run for office.

      Laws and rules don't stop Democrats from continuing their Nazi like march for and against whatever they want. They just change the rules or laws to accommodate themselves.

            It is obvious that the one who first filed against him being on the ballot wasted the courts time. If I payed taxes and voted there I am eligible to run there. I thought it was Republicants that wanted to eliminate fivolous law suits? Fine and or jail the one who first went to court wiht the issue, now that would be completely fair IMHO

                Ray - you don't understand the situation do you? I pay taxes in 4 states, can I vote in all of them? Of course not. I read he voted in DC.....hmmm. The bigger question for everyone is this; he owns a home in Chicago but rents it out. HE does not have a residence there to live in = non resident. He supposedly has a Ill. drivers license but doesn't/can't reside there because he doesn't have a personal residence to reside in (not rental property). In any other state he is guilty of falsifying his residence. I'm sure in Ill he is also but the law really means nothing there.

                  @ dansu - good points, we also have to look at the idea that if what many wish were true and all you had to do was own a home in the area for at least a year, you could have people running for office who never spent a day there.

                    In most states, you have to physically live IN the state more than six months out of the year to be considered a resident. Where you pay taxes, if any, is not the determining factor. I believe both facts would pretty much exclude Rahm from claiming Illinois residency.

                      If the voters were willing to elect a president that was not born in the US, then they should be able to vote for someone who doesn't live in their city.

                              I can't wait until a few years from now when I am fully retired and move out of state. We live in the most corrupt city, county and state. Always in some one's pocket. Rahm's ids still show Chicago as his residence. He never changed them. The others are threaten by him and know he's going to win. If it was a nobody this would not be happening.                                       Regardless of what the obviously corrupt court rules, it is the people of Chicago that must resolve this issue. Do they want hard working people with their best interest at heart to lead them or do they want corrupt political thugs to continue to drive their city into the dirt like Detroit. They will have to come out in great numbers to overrule the 200 thousand (at least) fraudulent votes that ACORN has implemented, but they could do it. My guess is that they won't because most of the people in Chicago are too frostbitten from the neck up to realize they are being played like fools.

                                        To me what they let happen in Chicago is beyond belief and I really can't understand it. I don't think anyone outside Chicag0/Ill can really understand the depth of the corruption in their politics. I would hope the good people would rise up against it but it has been so long I don't know that they have the willpower or even know the good from the bad. A democrat from Ill on TV discussing this situation (appellate ct. ruled against Emanuel) advised the commentator "my daddy always told me; never rule a democratic politician out when the Ill supreme court is in session". Guess his words were true.

                                            In a town known for dirty politics, Rahm is known as one of the dirtiest politicians out there. I still think it is pretty remarkable he has managed to mostly avoid the Blagojevich Scandal. That said, who else has the connections, money, support, and bravado to fill Daley's shoes? Like it or not, I think this is our next mayor.

                                                  Let me see this coming Emanuel goes in office a one time millionaire in a couple years he is a multimillionaire and doubles every couple of years.
