Ill. court issues stay; Rahm back on the ballot


The Illinois Supreme Court has just issued a stay of the appeals court's order knocking Rahm Emanuel off the ballot and directing the Chicago Board of Election Commissioners to restore his name to the ballot.

This is a strong indication that the court will accept the case and, perhaps, of which way the justices are leaning.

*** UPDATE *** NBC's Pete Williams has more:

Less than 24 hours after an Illinois appeals court bumped Rahm Emanuel off the ballot for Chicago's election for mayor, the state's supreme court put that ruling on hold and ordered the city to include his name on any ballots being printed.

"The Board of Elections is directed that if any ballots are printed while this Court is considering this case, the ballots should include the name of petitioner Rahm Emanuel as a candidate for Mayor of the City of Chicago," the Supreme Court said in a one-page, unsigned order.

The court said it acted after receiving legal briefs from Emanuel and from his legal opponents who claimed he was unqualified because he did not meet residency requirements of state law. Today's order left unresolved whether the state's high court would take up the entire case on a speeded-up basis, but the order gave Emanuel the rapid relief he was seeking -- to keep his name on the ballot.

*** UPDATE TWO***  NBC Chicago's Mary Ann Ahern reports that the court will hear Emanuel's appeal.

First you have no indication that President Obama is even remotely associated with this. So your assertion of corruption is simply baseless. More importantly, isn't it American and Democratic to let those that desire to serve be allowed to serve? Would you say that an individual who has served his country at the request of the President, does not also deserve to continue his desire to serve in the city he came from and represented in Congress BEFORE he was asked to serve?

What would be pro-American here?

Just a few inane questons.

-1-Has the Gentleman nade an official change of residence;ie: Has he claimed residence in the 'Federa; Enclave' also known as th 'District of Columbia'.

-2- Is there some Statute that indicates tha once he choses to serve as requested by the President of these United States; he cedes all rights to claim Illinois as his home state.

-3- Were the same standards applied to the Honorable RFK and the Honorable Secretary of State when they opted to try for the position of Senator from the State of New York.

-4-I am an Independent Washingtonian by choice, with all the 'Second Class Citizenship Priveliges,, that my status implies; and I doubt that Mr. Emmanuel, as astute as he is, would swap his esteemed citizenship in the land of "Father Lincoln" for anything other that to provide NATIONAL SERVICE AT THE REQUEST OF THE PRESIDENT OF THE UNITED STATES if it meant giving up his Illinois Roots.

He will serve Illinois with distinction.

    I guess that when you are the buddy of the POTUS and you cry hard enough, you get what you want. Glad I don't live in Chicago. But then again, even if I did, I wouldn't be voting for him.

    Did you really expect anything different considering the IL Supreme Court has 4 democrats and 3 republicans, of which at least 2 were appointed by Rahm's pal's? Simply nieve!

    Chicago is a quintessentially American City. Chicago gave the United States some pretty important "stuff", on all sides of any political worldview--from culture, to progress--with or without corruption-- like Chicago has a monopoly on that.

        When will people learn......this is Rahms election, bought and paid for. Come on does anyone still believe the "voters" decide. He bought the mayor position and he is going to get it and silly things like law, rules or votes will not prevent him from getting what he paid for.

              Good for Chicago! This is Rahm Emmanuel, the king of the emperors. Equal rights for none, special priveleges for a few. That's what I like about Chicago. They have been so corrupt for so long that they stopped trying to hide it a hundred years ago. New York and L.A. should take notice.

                He should be on the ballot. Keeping him off of the ballot, is more shadey, than putting him on the ballot. He has lived in Chicago forever and only left to serve in the White House. Presumably performing a national service (depending on your political outlook). His job in the White House was potentially a 24/7 job unlike his previous job as a congressman.

                  Good for R. Emanuel!  I guess that "dirty politics" (i.e., NOT allowing this Chicagoan to appear on the Chicago ballot)...might be dead in this city?  Maybe (OMGosh) even...anti-Semitism?  What's next?  You go, Rahm!
