The Illinois Supreme Court has just issued a stay of the appeals court's order knocking Rahm Emanuel off the ballot and directing the Chicago Board of Election Commissioners to restore his name to the ballot.
This is a strong indication that the court will accept the case and, perhaps, of which way the justices are leaning.

Less than 24 hours after an Illinois appeals court bumped Rahm Emanuel off the ballot for Chicago's election for mayor, the state's supreme court put that ruling on hold and ordered the city to include his name on any ballots being printed.
"The Board of Elections is directed that if any ballots are printed while this Court is considering this case, the ballots should include the name of petitioner Rahm Emanuel as a candidate for Mayor of the City of Chicago," the Supreme Court said in a one-page, unsigned order.
The court said it acted after receiving legal briefs from Emanuel and from his legal opponents who claimed he was unqualified because he did not meet residency requirements of state law. Today's order left unresolved whether the state's high court would take up the entire case on a speeded-up basis, but the order gave Emanuel the rapid relief he was seeking -- to keep his name on the ballot.

This is so stupid ! Why and the hell did the Illinois supreme court put his name back on ????? The law is the law !! It states as plain as can be.....you HAVE to "live" for 1 year in the city of Chicago !!! Live, meaning YOU have to occupy the home that resides in the city of Chicago !! Not just own it, not just rent it out, not just intend to come back to it someday....but actually "live" in it !!! Emanuel should have read the damn rules before he quit his cush job at the white house...
They changed it because the decision of the lower court was wrong, when you have to move at the discretion of the President you retain your perminent residence. ie military serve at the discresion of the Commander in Chief and retain their perminent residence.
Emanuel served two years at the pleasure of the President of the United States. A legally elected one I might add.
Maybe you think only repugnicans should be able to explore their rights by letting the courts decide.

I am not a republicrat nor a demacan I am an independent. I am the one Washington fears as I vote for what I see as the best possible candidate (which has been very difficult lately as they almost all suck). However that said Hussein (oops there I go again) is going to find out the public isn't buying into his song and dance any more. It reminds me of a joke I heard a year or so ago.

All of the people whining about him being the best choice (a statement I cannot possibly comprehend) COMPLETELY miss the point of this. A law was written and Rahm Emanuel does not qualify to run for Mayor of Chicago based on the way the law was written. PERIOD.
Do you people understand what happens when you start making legal EXCEPTIONS for people? You completely open the door for the type of corruption that can eventually lead to an oligarchy (look it up, as I'm sure most Chicago voters don't know what it means).

If you join the U.S. military and are sent overseas for a 2-3 year tour and then return to your hometown and want to run for office, are you allowed to? You didn't physically live in your state or city for 2-3 years because of job requirements.
I don't really have a "dog in this hunt" but it really seems kind of assanine to require a politician, who was a member of the White House staff and "serving his country at the discretion of the President", to have lived in his hometown for 1 year prior to running for office.
Whether you are a Repub, Tea-bagger, Dem, Lib, or whatever, the requirement should be the same for ALL persons who serve their country, regardless in what capacity!

Not surprised. Illinois Political and Judicial System is full of Criminals and circumvent the law and screw over the citizens of that state. I am just glad I do not live in that Social Communist State. I mean look at the former Senator and now President whi is not a US Citizen.

Besides,this wasn't about deciding an election. It was about deciding about residency, based upon precedent law. Nobody was ousted. No votes have been cast yet. Not even Florida... I'm sure if we looked up the Court's ruling it would make way more sense than say, the 2000 election. RRRWW you are hereby on notice that facts will clobber you every time. In my opinion, and from observing/reading from out here in the West, I'd be glad to see RE win the mayoral election. It would be heartening to see Chicago being put on the "map" to something of when it was the map... :)
