The Justice Department says the government will appeal Monday's ruling that found a portion of the health-care law unconstitutional.
The Department believes this case should follow the ordinary course of allowing the courts of appeals to hear it first so the issues and arguments can be fully developed before the Supreme Court decides whether to consider it. As Judge Hudson noted in denying an injunction, the individual responsibility provision does not go into effect until 2014, so there is more than sufficient time for the courts to consider this case in their normal course of business.

Current ruling would make sense the day we can opt out of paying our own increased premiums when other Americans who can opt out saunter into the ER for health care that they did not pay for (which costs me $1,000 per year right now)?
The moment the health industry removes its fundamental oath to treat anyone that is sick. The day ER care becomes optional in the US (or anywhere in the world for that matter).

The ER is Optional. You can go there or stay home. Sounds like an Option to me.

I have always thought we were a FREE people. My late husbamd.a M.D., always said when the goverment trys to control are health care, we are in trouble. To be sent to what ever doctor is assigned (like medicare doctors etc.) it is the same as playing with a loaded gun. Is the American public so dumb to believe tha ALL doctors stays sober and do not pop pills. Well they do and I for one do not wish to put my life in their hands. i sure hope the courts kills the health bill. And I voter demacrate..will not make that mistake again. carol
If this law stands, it will also eliminate states requirements to carry car insurance. I don't think this was a well-considered ruling. Instead, the judge and prosecutor are embroiled in an election contribution scandal.
Nothing in ObamaCare assigns you a doctor. You can choose a limited network plan if you want, just as you can now, but you're not forced to do so, and if you do you can choose your doctor from the plan's network. In fact, ObamaCare adds options for doctor choice, requiring plans to let a woman see a gynecologist without a referral, and requiring plans to let a pediatrician be the primary care doctor for a child. Also, emergency care has to be covered even if out of network. Insurance companies are the ones imposing the limits on doctors. Also, Medicare doesn't assign you to a doctor either unless you pick a special Medicare program that does that. There are so many lies about ObamaCare that make people think it does things it doesn't do.
What is true is that the individual and small business insurance markets were in a death spiral before ObamaCare was passed, and ObamaCare will have to try to figure out how to control costs. The law doesn't automatically control costs, but it gives the Feds a seat at the table so they can try to figure it out and it imposes restrictions on insurance companies. If ObamaCare fails, insurance companies will keep raising rates until nobody but the wealthy can afford insurance and nobody with insurance can count on keeping it if you get sick. If that happens, people will flock to a single payer system within 2-5 years.

My husband is also an MD and he believes that only the govt can rein in the insurance co's abuses. Only the govt can stop the game-playing with denying claims and refusing coverage when people get sick. Medicare recipients are overall happy with their coverage, and (news flash!) it's a govt program. Doctors have an easier time getting paid by Medicare than many insurance plans! Any doctor who complains that he's not getting paid enough by Medicare needs to be grateful that all the old folks have this coverage and can come to the doctor for treatment, which they darn well couldn't do without Medicare. The govt has the power to negotiate lower costs overall but they are totally in the pockets of the ins companies and the drug and medical device companies, so they didn't mandate negotiating cost control with the providers. If we could get congressmen and Senators on both sides of the aisle to stop sleeping with the drug and insurance companies, we could get some realistic cost controls like the VA has. Folks, this is all do-able, but we gotta stop letting corruption destroy health care, and we have to educate folks about who the real villains are

By the time the people with their poorly spelled picket signs figure this out, it will be too late. Our health care system will only provide quality care to the very wealthy, who can afford the skyrocketing costs. The picketers think that they deserve great health coverage, but those without it are 'undeserving.' Well, just wait til that next round of layoffs or outsourcing destroys your job and group health coverage. Then try to get good coverage on the open market for a decent price. You're wrong. As Dean said last night, the health care reform bill doesn't need the mandate, and major parts of the reform bill have already been implemented. It supposedly would help with premium costs, but greedy insurance companies being what they are, it would be doubtful.
This judge just like members of Congress need some Algo Men, you know like the banks use on Wall Street to provide them the algorithmic projections and realistic predictions to use. The company he invested in 13 years ago as a judge may have changed. Hopefully we get a smarter judge on the next round.

It's time for some intelligence to arrive in Washington and nice to to see the President again meeting with Bill Gates and Warren Buffet again today, the smart men and Bill Gates will help them with those business intelligence algorithms if they need them, he's written his share by far and that's where the world is today.

This should immediately go to the supreme court and bypass the appeals courts. Everyone knows where this is going to end up. The administration knows that the longer they stretch this out and as long as they are permitted to continue wasting millions on the implementation of the law the more they just might have a better argument. The congress, next year, should do the right thing and just repeal the whole bill, and start over, if the administration refuses to go immediately to the supreme court. This is just a waste of time, and money.

If this thing goes before the Supremes now, the administration will not have a leg to stand on. They are hoping to get a whole lot of regulations embedded before it gets decided, so that unraveling it will cost too much to repeal it.
Now, how they are going to deal with the total lack of funding is another story. . .

In going to the Supreme Court, the conservative activist justices no doubt will support the ruling by the Republican judge from Virginia. So that will enable us the opportunity to cut out the insurance companies, the current "middle man," and move to a single-payer system. That way, all Americans can recieve affordable, quality health care as folks in most industiralized nations do today and have experienced for some time. Plus, those who worry that their health insurance premiums will continue to go up, do to folks using emergency rooms for their care, well that problem will be resolved too.
Actually, 'single payer' may also be unconstitutional. And there is absolutely no way this country can afford it right now.
Here's a novel suggestion - Why don't they pass legislation that actually goes after the root causes of high medical costs instead of treating the symptoms?
It is a hoot when the left refers to socalled republican justices as activists when they ignore the socalled democrat judges. The people of California said no to homosexual marriage and a democrat activist court says not constitutional. Now when another issue most don't want comes up, they whine a court says it is not constitutional.

we dont want health insurance we want health care , i voted for obama but didn't vote for this. he tries to compare health insurance to auto insurance. first of all driving a car is a privelage not a right. just ask the dmv. your life is a right. you cant mandate me to pay for insurance then when i go to the doctor still have to pay out of pocket. because of high deductibles.
What is the cause of the high price of health care? Last year I spent 25 hours in the hospital for neck surgery and my insurance was billed $12,000 for misc. room expenses. Somebody came in and measured my goesins and goeouts. How much do lawyers make off of health care, not to mentionmedications, we have our own responsibilities to take care of ourselves. We are not Canada with their ideal health care and we can all see how well the Europeans are doing. According to my daughter that lives in The Netherlands if you are on National health care if you get pregnant you get pre-natal care and a mid-wife, mid-wifes are not authorized to administer pain meds. If you go to the dentist and want novocain it comes out of your pocket. So if we get health care as good as the rest of the world ladies hold your knees together and everybody brush and floss a lot.
We now pay for the uninsured and destitute by having $12,000 misc. room expenses billed to insurance companies that jack up their rates to compensate for inflated billings to cover those people. The same goes for the medications $2.50 for an aspirin. You know in some hospitals you get a menu, the hospitals are more than happy to bill your insurance more and if your insurance runs out they will send the bill to you. Don't forget that hospitals have attorneys to pay for so that when you are getting that deep space nine colon exam, part of that goes to a lawyer, seems fitting in a sad way. It would be nice to have one thing to fix and make it better but it don't work that way
What they won't say, is if they don't get to keep the mandatory payment clause in, they can't afford the bill for the "uninsured".
