Justice Department sues AZ sheriff

In an atmosphere of tension between the federal government and Arizona, the Justice Department today dialed it up some more, filing a lawsuit against Maricopa County Sheriff Joe Arpaio -- accusing him, the county, and his office with failing to cooperate with a civil rights investigation of his office.

The Justice Department has been investigating allegations that the sheriff's office has engaged in discrimination against Hispanics. As a recipient of federal funds, the sheriff's office is required to cooperate with such investigations.

But today, the Justice Department said it's been trying to get the sheriff's cooperation for more than a year without success. That makes his department "an extreme outlier," given that no other local law enforcement organization has refused to cooperate with a civil rights investigation in the last 30 years, the government says.

"The actions of the sheriff's office are unprecedented. It is unfortunate that the department was forced to resort to litigation to gain access to public documents and facilities," says Thomas Perez, the assistant attorney general for the Civil Rights Division.

*** UPDATE *** Arpaio responded to the lawsuit during a news conference in Phoenix, alleging that it amounted to harassment, the AP reports. "I think they know we have not been racial profiling, so what's the next step — camouflage the situation, go to the courts, and make it look like I'm not cooperating," he said.

    The only inmates that are housed in "tent city" are inmates in good health verified by a complete physical exam, low custody needs, and are there for misdemeanors only. The "bill of fare" does consist of "Chokes") baloney sandwiches of USDA surplus food, white surplus bread, mayo and mustard if desired, and a piece of fruit. They also get vitamin supplements and potassium tabs to keep up their strength and electrolytes. If an inmate is hungry after devouring his/her "choke," he/she may have another "Choke" if they have completely consumed ALL of the previous choke. Most of the inmates "get a kick," out of living in "Tent City" and taking care of animals at the animal shelter and working on chasing cracks in the asphalt with cold patch. Of course they have chains on during the day so that they won't run away. The inmates with high blood pressure, arthritis, etc are housed in the Maricopa County Jail.

    I don't doubt that Sheriff Arpaio may have "gone too far" in some regards and we will just have to see what the investigation determines. He is the sheriff and knows how far he can go and knows the possible consequences for violating the law.

    I do not think that the DOJ is concerned that much about "Tent City" but there are other concerns about Sheriff Joe that were sufficient enough to bind him over to an investigation and forensic audit. I personally do not think that the AZ Immigration Law will work out because of the labor contractors that supply labor in the hot sun that Americans just are not going to do. Moreover, a good part of Maricopa County consists of retirement living communities such as Trilogy that require lots of people doing hard work in the heat for low wages, no benefits, and no health ins. That kind of means that "they just might subcontract illegal aliens."

    Republicans "mouth off" a lot about illegal aliens, however, will they ever complain about a fellow Republican exloiting the illegal aliens, who in turn exploit the taxpayers with all of the ancillary costs of illegal immigration.

    I think not! The Republicans are very two faced when it comes to protecting the rich.

          To all of you who loudly whine about the lack of federal government enforcing immigratgion laws, let's get the facts straight. The Custom and Boarder Protection budget went from $6BB in 2004 to $11.6BB in 2010. The Immigration and Customs' budget went from $3.7BB to $5.7BB over the same period. Even under the Obama administration, deporation is at an all time high, increasing from 115,000 in 2000 to 388,000 in 2009. The federal government now requires all federal contractors to use E (electronic) verification for employees. So while the problem is obvious and growing, please do not babble on about how the feds are doing nothing.

                    Aside from this sheriff blocking a federal investigation, i feel that the government should definitely lock down the borders for the next ten years and give all illegals ninety day to "get out of dodge"---I have been harassed by illegals/non American Spanish people for years in the building where i live and i am severely disabled---Why are these people given preference over American citizens with Federal Section 8 Housing Vouchers here in New York City in the South Bronx?

                          Arpaio got into office mainly by promising cost savings, not cruelty. To date he's cost more in actual judgements on civil rights abuses. His cruelty-based scheme also doesn't work: recidivism is the same or worse than other types of prisons (based on a study he himself commissioned to investigate and support his approach). So though it appeals to the darker side of humanity, this approach is just wrong. The proper way of handling prisoners is through advanced psychiatric care, rehabilitation, and doing everything possible to ensure they can be productive members of society WHEN they return to the street.

                          Abusing prisoners, whether torturing suspects or taking out frustration on monsters, is wrong. By detaining another human being you're elevated to a higher expectation of responsibility and conduct. Their punishment is incarceration (the deprivation of liberty), not constant humiliation, violence, and fear.

                              It's amazing how people want criminals to pay for their crime but at the same they want rights for criminals. It doesn't work that way people. No wonder our society is so messed up. People have forgotten what's right and what's wrong. What's sinful and what's a disease. Totally different story but I had to add that last comment.

                              Inmates should not have the right to watch tv or play basketball or do weights. The person that they hurt or killed can't do that anymore so why should they. Have classes on how to teach them to be good human beings in society.

                                OK, so he wants to enforce the law. But, the law is not conducive
                                to the Latino Vote. So, now we have the current US Federal Govt
                                Administration actually threatening him because he wants to
                                protect the country from illegal entry. Looks like the change needs
