In an atmosphere of tension between the federal government and Arizona, the Justice Department today dialed it up some more, filing a lawsuit against Maricopa County Sheriff Joe Arpaio -- accusing him, the county, and his office with failing to cooperate with a civil rights investigation of his office.
The Justice Department has been investigating allegations that the sheriff's office has engaged in discrimination against Hispanics. As a recipient of federal funds, the sheriff's office is required to cooperate with such investigations.
But today, the Justice Department said it's been trying to get the sheriff's cooperation for more than a year without success. That makes his department "an extreme outlier," given that no other local law enforcement organization has refused to cooperate with a civil rights investigation in the last 30 years, the government says.
"The actions of the sheriff's office are unprecedented. It is unfortunate that the department was forced to resort to litigation to gain access to public documents and facilities," says Thomas Perez, the assistant attorney general for the Civil Rights Division.
*** UPDATE *** Arpaio responded to the lawsuit during a news conference in Phoenix, alleging that it amounted to harassment, the AP reports. "I think they know we have not been racial profiling, so what's the next step — camouflage the situation, go to the courts, and make it look like I'm not cooperating," he said.

Sherriff Moron has an ego larger than George W Bush and some fairly decent sized cajones. There is something most definatley fishy eminating from his office but you cannot deny that his tactics work. If only he would abide by the laws of the land (same goes for Jan Brew-HaHa and SB 1070) and respect his fellow man perhaps we could find some middle ground on the immigration enforcement problem and work towards a solution instead of cleaning up after the Pink Panty Wearing Sherriff!

This admdinistration sounds like it's asking for a revolution! AZ and the Sheriff are just trying to protect their State - something this arrogant, inept administration seems unable and unwilling to do! It's the government's job and they can't do it and now they're suing the people that are trying to protect their State? This is unbelievable and I don't know why the people of AZ are putting up with it. This is NOT good news for this country. I don't understand your problem with the government suing another official that is not abiding by an agreement he not only agreed to uphold, but is also TAKING federal tax dollars from and now does not wish to cooperate with the federal government.

There are plenty of white Canadians overstaying their Visas and living here in Arizona. Yet the only roundups that occur are blatantly targeted at Hispanics.

Neither one of those links supply us with any numbers on the amount of Canadians overstaying the welcome here in Arizona, let alone in the rest of the country.
I suspect the numbers are so small on that, that they don't even show up as a substantial statistic.

By the way, the United States doesn't check passports or visas when leaving the country, so there are no absolute numbers on actual overstays, since people overstaying don't want to be found. However, the Pew Research Center is non-partisan and widely considered reliable. http://pewresearch.org/

I live in Arizona, I know. Joe always makes a big public announcement ahead of time, it gets covered in all the local TV and papers. Then, when they happen, none of them ever have been done in white neighborhoods or just random, non-targeted sweeps. They're always targeted at Hispanics or against political enemies like the raid he did at Mesa City Hall.
Most Canadians are not required to have a visa to enter the USA. They can also enter at a border station with just a passport and Canadians are not required to check their passport when exiting the USA through a border station. When exiting on a plane, they just have to return their I-94 form.

The point is that there is clearly some unknown number of Canadians overstaying visas or otherwise residing illegally in Arizona that should be deported. Illegal is Illegal.

well Mary you know there are many legal options for requesting and getting information from the government, all you need do is work the system and your local representative...simple but does take effort.
Jimbo you better go back to school and brush up on your law. Every citizen has a right to withhold everything from the Federal Law Enforcement as well as State Law Enforcement. In order to view any document it either has to be a Public Record open to anyone, or consent or a subpeona has to be issued or a magistrate signed search warrant.
The issue here in maricopa county is the DOJ has issued a subpeona but it does not specify WHAT records it wants. It has asked to have "carte blanche" in the county records which exceeds the legal scope and purpose of the subpeona power. A subpeona has to state exactly what records they are to produce or "ducas tecum" produce these documents.
The DOJ has no case, no complaintant, no so called victim so there is no specific record for them to seek out. Thats the crux of the problem. IF they could specify something then the county could produce it. The DOJ is on a public fishing expedition and they have exceeded their authority and its against the one man that does not cower to them.

This isn't just about sheriff Joe huntin' down them there illegals. This is about sheriff Joe violating the civil rights of those he questions, those he incorrectly confines (it's happened) and more importantly, the bogus charges he's brought against his vocal opponents. We're not talking about Pedro, the corner taco vendor, either. We're talking a county school supervisor(who was acquitted), former police chief, members of the board of supervisors, superior court judges and a former state attorney general. Sheriff Joe's been in office since 1992 and they've had almost 20 years to go after him and have failed each time. This latest round between himself and the Feds is nothing more than a PR stunt for the politically-correct libtards, criminal coddlers and minority ass-kissers back in Washington to feel good about themselves.
The Feds have failed as far as illegal immigration is concerned and Sheriff Joe has to do their job for them.
Back in 2008 under the Bush Administration, Phoenix Mayor Phil Gordon asked for a federal investigation of possible civil-rights abuses, but it never happened.
In February 2009, four key Democratic members of the U.S. House Judiciary Committee asked Attorney General Eric Holder and Homeland Security Secretary Janet Napolitano to investigate Arpaio.
The investigation was opened by DOJ in March 2009.
So what. Immigration enforcement was a political hot topic in 2008 and 2009 as well. What's your point?

The point is that the timing of the investigation is not political. Arizona has been trying to get the DOJ to do something about Arpaio at least since the Bush Administration.

DOJ did act long before SB1070 became an issue. They opened the investigation in March 2009. They have been waiting for over a year for Joe to comply and he's been stalling. Joe brought this on himself.
So he won the election. That doesn't mean hes not committing Civil Right abuses.
The DOJ is right to sue him and Maricopa County conservatives especially should support an investigation. If he's breaking the law that wouldn't be acceptable would it? If he has nothing to hide, then whats the problem?

Sheriff Joe might be all the right wing hero's list, but his passion for going after the bad guy is more than just illegals. He also actively went after those running in office against him, any one on his staff that spoke up and asked questions. He started horrible investigations on people before the elections just to stop them after he won, with no basis.
He uses tax payer money to fight his own battles and wage his own public relation campaigns. If he has nothing to hide then why not cooperate. If you are getting federal funds you have to follow the rules. He is naming his own game. This isn't the 1800's where a Sheriff can just shoot anyone he sees fit.

I don't know the Sheriff and I don't know the specifics of the case. But if there are civil rights violation allegations, he has a responsibility and a duty to cooperate with the Federal investigation. The Feds bringing suit, just means that they are done just asking for cooperation, they are taking the Sheriff before a judge to force him to cooperate. If they are asking for too much information, then that is for the courts to decide.

What kind of insanity is it for bums in DC to bury the Sheriff with paperwork answering BS questions.
