In an atmosphere of tension between the federal government and Arizona, the Justice Department today dialed it up some more, filing a lawsuit against Maricopa County Sheriff Joe Arpaio -- accusing him, the county, and his office with failing to cooperate with a civil rights investigation of his office.
The Justice Department has been investigating allegations that the sheriff's office has engaged in discrimination against Hispanics. As a recipient of federal funds, the sheriff's office is required to cooperate with such investigations.
But today, the Justice Department said it's been trying to get the sheriff's cooperation for more than a year without success. That makes his department "an extreme outlier," given that no other local law enforcement organization has refused to cooperate with a civil rights investigation in the last 30 years, the government says.
"The actions of the sheriff's office are unprecedented. It is unfortunate that the department was forced to resort to litigation to gain access to public documents and facilities," says Thomas Perez, the assistant attorney general for the Civil Rights Division.
*** UPDATE *** Arpaio responded to the lawsuit during a news conference in Phoenix, alleging that it amounted to harassment, the AP reports. "I think they know we have not been racial profiling, so what's the next step — camouflage the situation, go to the courts, and make it look like I'm not cooperating," he said.


It's about time that the meanest sheriff in the country, Joe Arpalo, face the consequences of his actions. Maybe they will put him in PINK garments and have him stay with the criminals he has arrested. That stubborn ol coot has no regard for the law.

I suspect that he and his team have two choices, cooperate with another frivolous lawsuit, or go after criminals. I would guess that they chose to go after criminals and because the don't all drop what ever it is they are doing and bow down to the Buttheads in Washington, they are doing exactly what the letter of the law says they do.

Joe Arpaio is an Arizona Sheriff that was voted in office by the people. If Arizonians don't want him doing the job then they can vote for someone else to replace him.
I served in the Army. I had it tough. The food wasn't that great and I endured a lot of sweat, pain and suffering. I had to work in the snow, rain, hot, cold and even slept on the ground or cot some days. I don't think Arpaio's methods are that bad. His methods might dissuade possible criminals from committing crimes in the future. I am sure that the conditions in his jail/prison are better than most Mexican jails.
All of the footage on CNN has shown latinos, blacks and whites together. I don't think he is racist. I think he has a prejudice towards criminals which is fine with me.

Hey MDSJ - Isn't there a clause in the Constitution outlawing "cruel and unusual punishment"? Those tents get up to 130 degrees in the daytime and the baloney that he serves them to save money is old and rotten and a health hazard. Did it ever occur to you that many of the inmates are awaiting trial and will be found innocent and others will be exonerated with new DNA evidence, etc. I bet you wouldn't "personally like the fact that inmates sleep in tents, do hard labor and wear pink and eat rotting food" if you were an innocent victim. I know all of this from personal experience because I was one of them. Luckily for me the mistake was rectified after a very short time in Maricopa County.
Arpaio doesn't scare the criminals from ever commiting crimes again. He just makes them hate the law and justice system and humanity even more and they are likely to commit even more viscious crimes when they get out. Good work Joe!
So let me get this straight. Because the sherrif's office gets federal funds they are required to cooperate in this investigation. But at the same time, they are not required to enforce federal law as recipients of federal funds?
If you find yourself in an embarrassing and vastly unpopular situation(suing Arizona) the best way to attempt to legitimize yourself and attempt to gain a shred of credibility is to create an adversary, which is exactly what is being done here.

Arpaio presents a conundrum. It is hard to imagine that ethics violations are the motivating factor here when his policies and practices have been well-known for the past decade. Among many, he's lauded for his hard-line treatment of the criminals under his juridiction, and I personally count myself with the number who feels Joe's use of actual punishments upon the jailed is warranted.
I find it hard to imagine Maricopa County is as abhorred by him as the current narrative would have us believe: Joe's an elected official, and has won his position three times over with a very clear majority - even his most recent win, in 2008, put him above Dan Saban by 10 points.
This pursuit of Arizona law enforcement where it concerns the illegal immigration issue strikes me as a witch-hunt, and I am not saying that merely because it's the echoed talking-point of the hour. Take into consideration that Arpaio re-instituted the use of chain gangs in 1995; why is it that then-President Bill Clinton's Democratic administration turned a blind eye to this so-called reprehensible violation of convicts' rights?
I do not side with those who demand an immediate and unilateral uprooting of the ten million or so illegal migrants that've settled in the border states for a number of reasons - the most pertinent of which include the fact that I cannot fathom how such a massive resettlement could be paid for, as well as the logistic nightmare it presents. It strikes me as bizarre that the right wing would call for that while simultaneously railing against the stimulus plans passed in 2009 and the healthcare package.
Nor do I believe that unloading so many bodies on Latin America will earn us much in the way of favor with those nations that're our closest neighbors - to say nothing of the global backlash that'd fall upon us. I am not suggesting that we should kow-tow because of naysayers overseas, but it's a fool that doesn't recognize the amount of hegemony we can wield pursuant to our interests depends upon the cooperation of foreign leadership - themselves willed to act on individual policy by the popular opinion of their citizenry.
At all costs I am completely and thoroughly opposed to unconditional amnesty. It is anathema to suggest those who've broken our immigration laws (however compelling the humanitarian reasons for doing so) be granted a free pass for however many months or decades they've skirted the edges of our economy and resisted integration.
I am, however, in favor of conditional amnesty. It seems to me that the better option is that which tiers a path to citizenship and repayment of outstanding taxes and fines over an affordable period.
I do mean that last part - affordable. Affordable to the common man and the lower-wage worker, not Beltway insiders and the power elite of either the Republican or Democratic brand.
There is nothing that states a portion of the funds directed towards border security can't instead be used to provide for a national registry of existing migrants who've dwelt within our borders for a pre-determined period of time prior to a particular date. There's nothing that states these funds can't be used to mandate English-immersion courses in tandem with job training and placement programs. We might even be able to help cover these costs not only with tax and fine payments owed by the migrants themselves, but with fines levied on those commerical entities that willfully employed illegal labor.
These programs, so tiered, should carry particular punishments for individual refusal to comply: deportation and/or additional fines. It also should go without saying that migrants who've entered the nation past the date set for amnesty to be retroactive should be deported or suffer actionable punishment commesurate with existing law.
At the same time, the cost to legally immigrate must be scaled on the consideration of social and economic conditions in the country of origin. The disparity between the financial state of the United States and Latin American nations is absolutely staggering, and virtually no one can afford to cover the basic cost of entering our country with respect for our law.
Of course, that's just my opinion. I could be wrong.
Where Arpaio is concerned, I do firmly feel the hammer coming down on him is a result of both the Obama administration's desire for the aforementioned unconditional amnesty and as a sleight against Jan Brewer and her defiance of Washington. The federal government aims to flex its muscle and assert its authority, regardless of the long-term costs to both the border states, state rights and the nation as a whole.
Sounds like many commentors have never been subject to a federal investigation. Lucky people! Ignorance is bliss.

Interesting comment considering he regularly gets re-elected with 85-90% of the vote. The simple fact is he has been investigated several times per various politicians requests and has been found not guilty of all charges so far. Recently a county is S. Arizona has had to give control of a large portion of its southern border to the drug cartels! The sheriff there appealed to the Feds who merely sent him signs, not national guard troops as was requested. The signs are a warning to Americans to avoid that part of Arizona!

I listened to a former inmate of Sheriff Joe's prison speak. The one thing that struck me is that the prisoners have the highest RESPECT for Sheriff Joe. They don't particulary LIKE him, but they all RESPECT him. Sounds like he's doing his job to me. I guess that's what really ticks some people off. Sad.

According to the Constitution, a Sheriff is the Law, in most counties, in the US. Only the county coroner has the power to arrest him. When JFK, got shot in Dallas, the Sheriff's department led the arrest of Lee Harvey Oswald, and the investigation. The Fed about had a cat, and have hated Sheriffs ever since. To me, this is still about the 10th Amendment. States rights, vs, Federal. The Feds always threatened to pull the plug on Fed Funds, to get States to comply: Don't know that, that is really justice.

A court will decide if the DOJ lawsuit is warranted. If the DOJ's case is dismissed, I won't conclude the court has a pro-Arpaio bias. But you can bet if the judge rules in favor of the DOJ, the wingnuts will start screaming that he or she is a liberal legislating from the bench. Happens EVERY time a court makes a ruling they don't like.

Houston: My opinion is my opinion, as I stated it was. Arpaio's practices have been witnessed through both the Clinton and Bush years without so much as a batted eye from the DoJ. Being that it is difficult for me to believe that more than a decade of known practice would only now yield claims of alleged abuse compels me not to take the official claim at face value, so I must respectfully disagree.
Simultaenously, your conclusion about the end result of the ruling on the lawsuit strikes me as true. Much as I feel this lawsuit is motivated by a political agenda, whatever the result is will be manipulated to one side or the other's benefit.
So the Sheriff is being sued for enforcing the Federal Immigration Laws that the Federal government REFUSES to enforce. Somehow, I think this will just anger the law abiding people in America even more.
Side note - The new Arizona Immigration Law is WEAKER than the existing Federal Immigration Laws, which requires that all immigrants carry identification and proof of legal residence on them, and no "reasonable suspicion" is even required to question people under Federal laws.

It can't be too bad, because those inmates are VOLUNTEERS to go live in tents and work in the hot sun. In fact, it's considered a privilege that has to be earned, and if they mess up, they go back to their cells. By the way, those bologna sandwiches are green, but they are NOT "old and rotten". Arizona just wants the prison experience to be something that will discourage continued lawbreaking, and most people like their approach.

SHERIFF JOE INTERRUPTS CONFIRMATION SERVICE
I think this time Sheriff Joe has gone too far. Last week, according to Arizona Episcopalian Bishop Kirk S. Smith (fan of this writer’s most recent book) Sheriff Joe, in an attempt to catch those nasty illegals, interrupted a confirmation service at the Roman Catholic Church in Guadalupe. Bishop Smith wrote
"…Thursday night I spoke to a group of about 1,500 members of the East Valley Interfaith, an ecumenical group that works with political leaders to further such causes as public safely, education, health care, and immigration reform. It was apparent from that meeting that Arizona has a major church/state crisis on its hands as it reacts to the tactics used by the County Sheriff in his crusade to catch undocumented immigrants. Last Sunday, he interrupted a confirmation service in a Roman Catholic Church in Guadalupe. Last night the Mayor of Phoenix, the Police Chief, and representatives from the Governor's office were present to hear our concerns. I shared with that group the story of my Holy Week encounter with the Sheriff's Department, and I pass it on to you:
This past Good Friday I was driving home from church services in Tucson when I received a call from the priest at one of our Spanish-speaking churches in Phoenix. Her church is located just off Thomas Road, less than a block away from where our County Sheriff had decided to set up a so-called "command center" complete with trailers, radio towers, search lights, and scores of uniformed officers in SWAT gear. This was described to the press as his home-base for a campaign to catch illegal immigrants who had committed such horrible crimes as having a crack in their windshield or a burnt out headlight. The real purpose of course was to intimidate innocent people, and in that he succeeded. Many of the members of are undocumented, and of course they were now afraid to come to Good Friday services. Insofar as I'm aware, the majority of those other suits levied against him have been civil in nature, with the majority of claims filed by Amnesty International. However, something you may be interested to know (and something even I find questionable concerning Arpaio's purposes) is that he has been the subject of more civil litigation than sheriff offices in the nation's top four metropolitan areas combined.
When this country finally gets a sheriff who has a pair and is enforcing the laws (just like his job statement says he is supposed to do) people seem to not like the fact that he is doing his job. This current society thinks that law breaking is not a big deal. That people should be able to do whatever they want whenever they want. Well, in an orderd, law-abiding society it ain't so. Criminals are just exaclty what they are - criminals. Thay do not need to be put into "rest camps" where they are treated like celebrities. They need to do hard time.
Sheriff Joe is doing his job and will continue to do his job even though he has to deal with the stupidity and lazyness of a corrupt federal government. You really think the DOJ would file a lawsuit under these circumstances if it was a simple matter of "what type of documents they want to examine"? All governmental entities that receive federal funds agree to provide ANY documentation requested by the federal government. The feds are not required to permit the local jurisdiction to limit the type of documents or to place technical impediments on the scope of the documents.
It appears to me this is just the most recent of a long line of deliberate acts by this local sheriff that constitute an abuse of his authority, intimidation, and arrogance. However "right" one might think his motives, the sheriff's methods are unlawful and he therefore needs to be disciplined accordingly.

As for Joe Arpaio - I don't see how he has done anything illegal. As for the Feds - there is not a damned thing wrong with making them specify exactly what documents they want him to produce. I'm sure, when they do so specify, he'll produce what they ask for. I live across the country from Sheriff Joe, near some of the worst crime cities in N.J., and I just wish we had someone willing to actually enforce the laws. There is way too much liberalization of our prison system. Prison is supposed to be punishment, a deterrent, and we have changed it into a country club due to "rehabilitation" of the criminal. I would dearly love to see what the percentage of convicted felons are re-incarcerated due to continuing criminal activity.

The sheriff has said not in my county or my country and has adopted polices to send the offenders back to their own country of origin to practice slavery there.

That is why this language was added to the constitution in the form of the 10th amendment "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." The legislative and judicial branches have been chipping away at this years. This amendment and the issue of states rights was one of the cause of the Civil War. When the South lost the war, good for abolishing slavery, it put a major and what seems to be an irreversible trend to ignoring and greatly limiting states rights.

The reasons for the opposition to central government is that states were differentiated and it was impossible to communicate across the entire country in a reasonable period of time. Today, I in Seattle have much more in common with people in Austin, TX; New York City; LA; Chicago; etc. than I do with people in central and eastern Washington. The notion of states' rights in the age of instant communication works AGAINST representative government.
Unfortunately the Federal Govt has had to enforce the civil rights that are granted to ALL AMERICAN CITIZENS by the Constitution because sometimes the states refuse to do so. Remember Gov George Wallace and Alabama? Don't you believe in civil rights for all American Citizens?

From Article 1, Section 8 "To establish an uniform Rule of Naturalization" doesn't mean the federal government is the only one empowered to enforce the law. If Arizona wrote a law that was not in agreement with Congresses "...uniform Rule of Naturalization" the feds may have had a legitimate complaint. In fact the judge didn't strike down the law itself but only the provisions on how to enforce the law and that based only on the fear of race based profiling. Please make sure you know what you are talking about before you spout off statements like "thenther"

There is no specific clause in the Constitution granting control of immigration to Congress, but the SCOTUS has always favored federal control, because of factors like the naturalization clause and the very fact of US sovereignty gives the fed the power to exclude, and foreign affairs. The Chinese Exclusion Case is a good place to start. Chae Chan Ping v. United States, 130 U.S. 581. You should be able to type that into Google Scholar and get the text just make sure you choose legal opinions first.
Actually, the Founding Fathers were trying to strengthen the central government having realized the weaknesses within the Articles of Confederation, especially regarding the regulation of commerce. They were smart enough to realize that there shouldn't be too much power concentrated with one man or group, thus the 3 branches with checks and balances. The 14th amendment further prevented any one state from trampling individuals rights that were part of the Bill of Rights, by requiring that all of the states would also be required to provide those same rights. Beyond that, yes, anything not specified for or against in the Constitution or it's amendments were reserved for the states or the people. I believe that since congress is granted the power to establish a uniform rule of naturalization that this gives the congress the right to make laws that govern that rule since naturalization applies to all that are not naturalized or "citizens". That would seem to imply immigrants or other non-citizens to me. This power to establish a rule of naturalization is not granted to the states.
I think the sheriff is doing a bang up job. Oh yes, the feds need to keep their noses out of the States` business. If you do not like the treatment then do not commit the crime. As far as I am concerned I think ALL sheriff`s departments should follow in sheriff Arpaio`s foot steps. The prison system should also follow his lead. Bring back the prison farms and chain gangs. There are many new articles describing Arizona's losing battle protecting its border with Mexico, and the inability of the AZ counties to protect its citizens in those areas. Gov. Brewer asked for the National guard a couple months ago and the Feds replied with 15 signs warning American citizens to stay away from those areas of Arizona that can't be protected by Federal, State, or County law enforcement. There is a You Tube clip on this called 'Brewer to Obama - signs are not enough'.
Recenty Obama ordered about 500 National Guardsmen to help protect the border, Arizona was promised over 2500 by the Feds, this was until the Feds decided to join with Mexico to sue Arizona. And this was before the DOJ (this article) decided to sue Sheriff Arpaio..... given this information whose side is Obama really on? They are also pushing for an investigation into ICE and the way it trains it agents as they feel that ICE is unfairly targeting hispanics as well. However, this investigation did start back in March 2009. So it can't be said it is a response to Sherrif Joes support of SB1070. However, I do think the DOJ is going to push as hard as possible to convict him of event the smallest crime.
The thing about this case, however, is the DOJ has yet to express to anyone at least one instance when the Sheriffs office violated civil rights. They only say they want to review its training of offers as they are traind under ICE as set forth in an agreement the Sheriff's Department has with Homeland Security. So, if ICE and Homeland Security are training Sheriff Joe's department in the enforcement of federal immigration laws, and his department is following that training, where do you think DOJ should be investigating?

Sheriff Joe is exactly that, an Elected Sheriff of Maricopa County Arizona. Primarily his jursdiction is solely maricopa County so if you do not reside there he does not effect you. As a state Law enforcement officer he enforces the laws that the state of Arizona enacts. He dont make them, he does not have to support or like them his responsibility is strictly to enforce them, period.
He is fair and will enforce the law equally, just ask the policemen that get arrested for criminal actions just like regular citizens. He seems to be doing something right because he keeps geting re-elected by landslides and he does keep operating costs down for the county which tax payers like.
So as they say, if you dont reside in the county or state, you really dont have a dog in this hunt do you.
