But she largely sided with arguments in a lawsuit by the Obama administration that the law, rather than closely hewing to existing federal statutes, as its supporters have claimed, interferes with longstanding federal authority over immigration and could lead to harassment of citizens and legal immigrants.”
Here’s how the Arizona Republic played the news: “Reactions Wednesday were predictably polarized. From Maricopa County Supervisor Mary Rose Wilcox, speaking to a gathering of Hispanic activists at her Phoenix restaurant: ‘We hope this decision will be a wake-up call across America that there is only one immigration law.’ From Republican state Sen. Against the wishes of many in his party he pushed for a temporary guest worker program. Now in my opinion it wasn't true reform because it allowed big business to continue to pay people at practically slave wages and didn't address immigration reform as I would like. It was at best a bare bone attempt at solving one part of immigration reform.
I'm biting my lip here, never have agreed on anything Bush did but on this he tried; once McCain Kennedy bill was drafted he accepted it and supported it. I think Bolton is correct. The Arizona Law "could lead" to the harassment of citizens and legal immigrants. On the other hand those supporting the Arizona Law promise that the new law will not lead to the harassment of citrizens and legal immigrants. I suppose it would depend on how zealous individual police officers pursued enforcement of the law.
I do think there is a lack of honesty and truth regarding this issue. As this law originated out of people's anger and frustration with the numbers crossing the border illegally into the U.S. from Mexico, and fear of a spillover of the crime and drug wars increasing around these same border towns, those supporting the law want Hispanics to show proof they have the legal right and authority to be in the U.S. The law therefore is directed towards Hispanics. Why not just come out and tell it like it is.
On the other side, those who do not support this law also know that there is a major problem with illegal immigration from Mexico and that the situation regarding crime and drug wars just across the border is a serious issue. And although disagreeing with the law and fighting against the same because they feel it is meant to profile or harass a certain race of people, they too have to be honest and up-front with the fact that yes, it is a certain race of people that make up the vast majority of illegal immigrants coming across the border, and something needs to be done.
Both sides are getting so hung up on this arguement that the law is or is not discriminatory that they are losing sight of the real issue. How to effectively stop illegal immigration along the border.
CA - I too think that Judge Bolton was correct in her injunction. I also think that your assessment is correct as well. The major problem is crime (maily drug wars) and illegal immigration. However, the AZ does not have power - nor the right - to 'ignore' the tenets of the Constitution so they can solve their problem.
The proponents of the law are complaining that 'illegal is illegal, and they broke the law'; it is an argument that I can support. However, when we have to give up our rights as Americans to combat that problem, then it SHOULD raise a red flag. It did with me. It is amazing to me that many people are so willing to trade their rights as Americans for 'security', whatever that is. There is no 'security' because the root of the problem has not been addressed. Until the root cause has been addressed, then there will ALWAYS be a problem.
I see that Russell Pence has decided he will fight; that's his right as an American citizen and a legislator. I have read that Russell decided to pen this law when his son, an AZ deputy, got shot by an illegal immigrant. I can sympathise with Russell, as no one wants to see their children shot, no matter what the reason is. However, by not channeling that anger and frustration into something POSITIVE, he has lost a very important opportunity to make that horrific act by an illegal immigrant REALLY resonate with the American people. I think that even the most liberal among us would have agreed with Russell of he did not put this out with a partisan lens.
So, this is not over. People are armingthemselves to the teeth and are threatening President Obama, and NOT even looking at the root cause of the problem (which are employers that attract illegal immigrants and the insatiable appetite for Mexican drugs). Everyone is all in a tizzy because they feel that they are being invaded by Mexico.
The funny thing is that when a REAL despot comes to power - using the same 'laws' that strips Americans of their rights, as this law proports, as a catalyst for their power - these SAME people will welcome him/her with open arms. When the jig is up, and the despot shows his real face, then it will be too late.

I know I'm not breaking any news to you but after 911, Congress pushed through the Patriot Act. Many seemed ok with Bush's warrantless wire tapping program and ignoring of the FISA - foreign intelligence survelliance act. Many people didn't seem concerned that citizens could be wire tapped or monitored based on 3rd party associations.

I'm a legal American citizen and I must show my ID when:
1. Pulled over by the police.
2. Making purchases on my department store credit card.
3. When I show up for a doctor's appointment.
4. When filling out a credit card or loan application.
5. When applying for or renewing a driver's license or passport.
6. When applying for any kind of insurance.
7. When filling out college applications.
8. When donating blood.
9. When obtaining certain prescription drugs.
10. When making some debit purchases, especially if I'm out of state.
11. When collecting a boarding pass for airline or train travel.
I'm sure there are more instances, but the point is that we citizens of the USA are required to prove who we are nearly every day!

As far as driving a car is concerned, you do NOT have to show your driver's license to ANYONE except a Police officer who asks for it when you are pulled over, and the only reason you HAVE to do so is because that was the condition of getting the license in the first place.
What you are notgetting is that you do NOT have to do ANYTHING. If you want smokes, and do not want to show your ID, you do not get the smokes. It is NOT against the law to NOT show your ID.

Mongo, because renewing a passport is the ONLY thing on the list that requires citizenship. The rest can be done by an illegal. Furthermore, the pharmacist, teacher, airline clerk etc, does not work for the INS. A driver's license is not proof of citizenship, and I don't know about you, but I do not carry my passport and birth certificate at all times.

Before action is taken we must wiegh the costs and benefits. If it sent us into a 20 year depression with 40% plus unemployment would it still be worth it to you? That may be extreme but the point is we should understand the impacts before taking any action.
The borders must be closed, 100%. People here illegally need to be removed, period. Employers/landlords should be punished severely. We followed the rules and indeed waited a long time to gain legal entrance. We do not sympathize with law breakers and do not mind the inconvenience of showing our papers since that will help to remove those here illegally. The two bit legislators in AZ are NOT taking any of your rights if you are a naturalized citizen who came to this country legally. Since you did things the proper way, doesn't it anger you when people sneak in and your tax dollars support them? Do you think they should be given amnesty and citizenship because they commited an illegal act? I just don't get it.
My family followed the rules and we are still in the process. It's a lot of work and it is very frustrating that others are getting here illegally. Especially when we have a close family member stuck in Europe that doesn't have the convenience of being able to run across the desert to join her family.
That doesn't mean I'm going to through away pragmatism to take a principled stand. You have to weigh the costs and the benefits instead of making an emotional decision. The economic cost of simply deporting all illegals would be catastrophic and not worth it.
I like the idea of massive fines and long term wage garnishments if the fines can't be paid up front.
To be an illegal immigrant is already a Federal crime. All Arizona did was make it a state crime as well. They will not be arresting anyone on a Federal crime - possibly forwarding all info to the proper authorities but the states have the right to make and enforce their own laws as long as the laws are not CONTRARY to the Federal law - then Fed trumps state.
I want to get past all the legal arguments and ask a serious question here. Let's just pretend the administration gets it's comprehensive immigration reform, and it passes both houses and is signed into law. All people who are here are processed in whatever manner that is that law. Now everyone is now legal.
Here's my question: What then? Do you mean to tell me that NO one will still cross the border? At that point in time, all people should be caught and deported if crossing illegally, right?
My point is that comprehensive reform is never going to put a perfect and permanent fix on this problem and the government will still need to secure the border. So with that in mind, why are they refusing to shut down the border except at the normal check points. It is now their responsibility to do that now and they just wont do it. They CAN do it, it was done with quite certainty right after 9/11. the borders were shut tight and even the drug trafficing came to a screeching halt. I just don't get it.

Comprehensive Immigration Reform has to be just what it says, comprehensive. And that means in addition to determining what to do with the illegals already here at the same time and in the same Reform Bill, passing legilsation that would attend to the border security issues. Comprehensive means all issues impacting illegal immigration will have to be included in the Bill.
But securing the border is ALREADY the law. No matter what reform is passed, the border will still have to be secured, what makes you think the administration will then tackle that issue?

if you had been paying attention you would know that arrests and deportations have INCREASED under Obama and are set to increase yet again. He has been sending more Federal troops to secure the borders already, like the 6k reservists that have been authorized in AZ alone, however, Brewer has only seen fit to send less than 1/4 of them. It is not President Obama that is slacking, look to the states along the border who have not been doing enough because they get a lot of money from the businesses that profit from using the too cheap labor that the immigrants provide. Stop the jobs and they will stop coming, the Southern border is only one of the ways that they enter, so sending enough manpower to totally close it won't do the job either. You need to actually study the situation a little better and get ALL the facts!

I'd have the US Rangers, 3rd Army, remove forcibly all illegals. The Mexican governments is known to SHOOT those crossing their southern border, no questions asked.
It is estimated that 10,000 illegals enter every day. Most just want to live a better life. I can understand that. However, you cannot break the law just because you want a better life. Thieves steal from others to gain money to live a better life.
The problem becomes.. what do you do about it. It is obvious that the Federal Government refuses to protect the border for a variety of reasons. The reasons do not concern me, their refusal to do their job, does. Again... what should be done about it.
Going in front of a Federal judge to question Federal ineptitude is a waste of time. Sort of like going to IRS court thinking you are going to get a fair shake with an IRS problem. It will not happen. Why Arizona showed up for the court date is simply amusing. So, going in front of a Federal lackey judge in this matter is a waste of time. I knew how this federal judge would rule before they walked in the building.
So, there are only two ways of handling this.
1) Mobilize the border citizens, arm them, and enforce the border themselves. I am not a big fan of this. Shooting them as they climb the fence in a have gun will travel manner, does nothing but make us as bad as Mexico. Not in favor of this idea.
2) Secede. If the Union refuses to protect it's members, and forbid them to protect themselves... the Union must be dissolved. Arizona should get together with other states that are suffering from problems either created by the Union or incompetence by the Union, and secede.
I see no other alternative. Ten thousand a day invade this country. Yes, I chose the word INVADE. These people are economic soldiers taking jobs in a country with already high unemployment. These economic soldiers are aided by the Mexican government. The Mexican government had published pamphlets teaching their citizens how to invade the United States.
These economic soldiers are taking a terrible toll on our school, medical, and court systems. I am not trying to be the bad guy here... but it is obvious that these invaders are taking our kindness for weakness. I think that seccession is a bit harsh. I think that ALL options are to be explored/used before that ultimate option of seccession is used. I will agree with you that not all options have been explored or even enacted.

From what I am seeing, governing is really difficult. It is easy when you are on the outside looking in, but when YOU are 'the man', things change.

If the Federal Government allowed each state to govern themselves, seccesion would not be necessary, nor desireable. We are the United States... each state individual, but united in common causes. We have ceaced being that, and we are all becoming serfs of the federal government.
The Federal Government has 3 jobs... ONLY 3.
1) Provide for the common defense. First word PROVIDE!!! The boarders are the lines of defense.
2) Insure domestic tranquility. First word INSURE!! Stop seccesions, riots assist local law enforement.
3) Promote health and welfare. First word PROMOTE!! Not insure... not provide. Promote!! That means, hey fatboy.. stop eating McDonalds every day. Get off the couch and get some exercise, but it is your life. You have the freedom to die at 41 years old of a heart attack if you so choose.
The Federal Government is doing things it should not be.. and not doing things it should. As a result, it is screwing up everything. Allowing this invasion by the Feds violates number 1. Mandating healthcare violates number 3. Not going thru with the procecutions of the new black panthers violates number 2.
The ineptitude of the Feds goes farther that just boarder. I do not like the idea of seccesion either. But I darn sure do not like the power grab the government has been doing the last 20 or so years. The government does not want citizens... they want peasants. I am no ones peasant.
The illegal alien annexation is like "Ripley's believe it or not?" You either trust the US government who persistently voices lies or uses reverse psychology on the public. To begin--how many foreign nationals have settled illegally in Arizona and America?

First thing that Americans must do is keep up a voice barrage on Democrats and Republicans for a-- PERMANENT E-VERIFY. This would have now been the law of the land, if Sen. He should be the first removed from office, as he and cohorts of Liberal-Dems is a strong representative to force through another economic damaging Billion dollar--AMNESTY. Another Amnesty would give illegal alien workers. Access to our Social Security and devastate taxpayer’s pensions, especially to senior citizens who have worked all their lives. An agreement the Bush administration was reached with Mexico on Social Security benefits that would allow illegal aliens granted amnesty in the future to claim credit for the time they worked illegally.
We must train the politicians already in Washington, that the Arizona law represents the American people’s defense, against 30 years of unequivocal failure to seal the border and deportation. What Obama hopes to do with unarmed military in small numbers sitting at desk, is amazingly stupid and misguided as any hopes of stopping the potential deaths is political suicide; a serious danger to National Security. Why defend foreign nations with soldiers and money, when our government for decades refuses to defend this country? The tea Party and millions of well-informed Americans see that this is a way to appease the corrupt authorities in Mexico. Every US patriotic citizen and legal resident must demand from their confused lawmakers at state and federal level in demanding E-Verify permanently. This will gradually remove illegal aliens by auditing workplaces (old and new workers--temporarily or permanent jobs) and bring to justice employers who are flouting the law and put them in prison. WE AS THE VOTERS OF AMERICA CAN DO THIS, RIDDING OURSELVES OF SENATORS LIKE REID, McCAIN, PELOSI, SCHUMER, GRAHAM, FEINSTEIN PUSHING FOR AMNESTY AND THE DREAM ACT.
