Graham joins panel's Dems to approve Kagan

Republican Sen. Lindsey Graham of South Carolina on Tuesday voted in favor of the nomination of Supreme Court nominee Elena Kagan, making him the only GOP member of the Senate Judiciary Committee to back Obama’s pick for the high court.

The panel, made up of 12 Democrats and seven Republicans, approved Kagan’s nomination by a vote of 13-6. Every Democrat on the panel supported her, while every Republican other than Graham opposed her. The nomination will go to a full Senate vote within the next few weeks.

"At the end of the day, after the hearing, it was not a hard decision for me to make," Graham said in announcing his decision. "I thought she did a very good job and she will serve this nation honorably. And it would not have been someone I would have chosen, but the person who did choose, President Obama, I think chose wisely."

Graham repeatedly noted areas of ideological disagreement between himself and the nominee, emphasizing that she is "a liberal."

But, he said Kagan had met the Constitutional requirements to warrant his support. "Is the person qualified? Is it a person of good character? Are they someone that understands the difference between being a judge and a politician?" he said. "Quite frankly, I think she's passed all those tests."

Graham also addressed one of the main GOP arguments against her nomination: Kagan's decision as Harvard Law School dean to prohibit military recruiters from using a campus career center on the basis that the "Don't Ask, Don't Tell" policy barring openly gay men and women from serving in the military violated the school's anti-discrimination rules.

"If I believed that she had animosity in her heart about those who wear the uniform, I could easily vote no," Graham said. "I don't believe that."

He was the only Republican member of the committee to support nominee Sonia Sotomayor in 2009.

Minutes before Graham’s statement of support, his office released a letter from Kagan to the South Carolina lawmaker praising her friend and former law school classmate Miguel Estrada. Estrada’s nomination to the federal bench by President George W. Bush was blocked by Democrats in the Senate in 2003.

The senior Republican on the committee, Sen. Jeff Sessions, R-Ala., formally announced his opposition to Kagan’s nomination in a USA Today op-ed earlier Tuesday.

“Throughout her career, Ms. Kagan has placed her politics above the law," Sessions wrote. “She has never been a judge, never tried a case before a jury and has practiced law for only three years. She is the least experienced nominee in the last half-century.”

*** UPDATE *** President Obama hailed the committee's vote in a written statement:

Elena Kagan is one of this country's leading legal minds, and has shown throughout this process that, if confirmed, she would be a fair and impartial Supreme Court Justice who understands how decisions made by the Court affect the lives of everyday Americans. Today's vote by the Senate Judiciary Committee is a bipartisan affirmation of her strong performance during her confirmation hearings. I want to thank the Judiciary Committee for giving her a thorough, timely and respectful hearing, and I look forward to the full Senate taking up and voting on this nomination before the August recess.

Looks like "Flimsy" Graham strikes again!

 This is his comment… his justification? "This president chose someone who is qualified, who has the experience and knowledge to serve on this court ... and understands the difference between being a liberal judge and a politician."

Once the legal genius associated with Clarence Thomas was skimmed from the judicial pool, it's left pretty slim pickings. The Dean of the Harvard Law School will have to do. At least she won't have to pick-up Scalia's dry cleaning.

                He is supposed to represent the majority of his constituents, his personal opinion should not enter the equation. When did these politicians all lose the focus of their function?                           FACT: Republican ideology has been devoid of rational, sane thought for some time now so it is no surprise that they become flustered when their arguments fall flat and they are forced to defend their nonsense. This is clearly illustrated by the comments of Christopher, Brianb and Stormer above. They and their Republican friends are like bulls who equate the "D", or all things Democratic, to seeing red. Anything/anyone wearing the "R" brand no matter how ignorant is a wonderful Godsend! I'll bet anything that if Elena Kagan was a Republican, she'd be branded as the second coming of Cardozo or Brandeis on the Court.                                             I don't know why I read political blogs anymore, because they just make me angry. People, Obama is a Democrat. Wouldn't it make perfect sense that he would appoint a Supreme Court justice with the same views as him? Isn't that what George Bush did? Did he appoint liberals? No, he appointed conservatives. So, how can you condemn one man for choosing someone that holds the same views as himself and praise the other man for doing exactly the same thing? From Wikpedia: "Most Presidents nominate candidates who broadly share their ideological views, although a justice's decisions may end up being contrary to what the nominating President anticipated. Because the Constitution does not set any qualifications for service as a justice, the President may nominate anyone to serve. However, that person must receive Senate confirmation." Clearly this is just common sense, not some liberal conspiracy to take the country down.

                                            As far as Kagan not being a judge, according to Wikpedia 41 of 109 Justices have not been judges. Answers.com states 40 of 111 have had no judicial experience. In fact, William H. Rehnquist appointed Associate Justice by Nixon and later Chief Justice by Reagan was never a judge. So again, you can't condemn one party for doing something the other party has already done.

                                            Although there are no requirements, it would seem necessary that the person have the intelligence to be able to read and interpret the law. Since Kagan was paid as a professor to teach law at probably one of the most prestigious law schools in the country she's probably qualified. From what I have read she was praised by many Republicans in past years prior to this nomination for her common sense approach to interpreting the law.

                                            In my lifetime I have never seen such crazy bickering and lack of common sense between the left and the right. Perhaps it has to do with the ease of having millions of people read your blog on the internet or perhaps it's because of crazy shows like Fox"News." In any event, unless we as a country come together and learn to compromise like we were taught in elementary school this country is going to go down no matter what party is in charge.

                                                              Graham's view, which is the appropriate one, is that the role of the Senate in voting on the President's Supreme Court nominee is to decide whether the nominee is qualified. While that decision may necessarily be somewhat subjective (since Senators are human), an affirmative vote does not need to signify that the senator LIKES the President's choice. If senators only voted "yes" when they personally liked the choice, almost all nominees of Presidents whose party does not control the Senate would be defeated, thus making it nearly impossible for such a President to make his own choice, as the Constitution intends.

                                                                I have to laugh at all the libs hailing Graham as a man of principal and having his own mind. First, he is not up for re-election for at least 4 years. Second, this is a safe vote because the libtards have enough votes to confirm without him, with Rino Hags Snowe and Collins and turncoat Brown so he has the cover he needs "I'm not the only Rino to vote for it (oops I mean Kagan). Third, he knew he would be getting all of this praise from the libtards and he was right. Look at the swooning going on here from the communists plus Dear Leader could say it was a bi-partison vote. LOL. When and if (big if) Rino Lindsey votes against crap and tax or ILLEGAL IMMIGRATION or another of our Communist Leader's directives, then the libtards will be back to excoriating him.                                                                     What is astonishing is the absolute hatred conservatives have for Obama, who is really a moderate Democrat compared to past liberal and present politicians. These fanatics do not understand that Republican so-called conservative policies have resulted in the worst deficits and economic times during the last 30 years. They hate Health care Reform, which is a reform more conservative than what Nixon had on the table, they want to give big corporations and Wall Street carte blanche and then they hide when the worst financial crisis since the depression results from lack of regulations and lax enforcement, they start a totally unnecessary war (Iraq) and then blame Obama for deficit spending when their beloved Bush kept the expenditures off the books and almost tripled the National Debt in his tenure........these conservative hate mongers will be very surprised this fall....they will not win either the House or the Senate and they will stew in their juices!

When a gov't becomes over bearing, the people have the right and responsibility to remove that gov't and install a new one. That's what the American people do in elections. We did it in 2006 and 2008 and we will do it in 2010 and 2012. We gave the communists a shot for 4 years and they really screwed the pooch.                                                                                                             Couple of things that should be mentioned to you, though, about 75% of our military are very conservative, the military the ultimate meritocracy they don'r like leeches and Parasites and democratic politicians are especially despised by the military.

                                                                                                            I was in the miltary when Kennedy got plunked in Dallas amd the comment heard most often, was "hey Harvey good shot."

                                                                                                            But say they did, have you given any thought to what happens after they fired on conservatives?

                                                                                                            If it were a National Guard Unit they would have to stay mobilized, they couldn't just go home, did you think about thatwould you want to go home by yourself after firing into a crowd of conservatives?

                                                                                                            if you were regular military, you have to stayn in the military, you would no longer be able to go home on leave by yourself and when you went on liberty you would have to go armed and in large groups.

                                                                                                            I suspect that probably a third of the conservatives in this country are combat veterans.

                                                                                                            Personally I'm a hunter I own several rifles including one of the old M1 Garands, like I carried in Viet Nam.

                                                                                                            I really think that people like you need sto spend a little more time thinking and a little less time running your mouth.

I too was in the military in 1963 and can assure you that he must have been in the Soviet military, not ours. The thinking soldier admired him greatly for facing down the Russians during the Cuban missile crisis. He was also a man who had fought in battle himself, unlike any president since. Comments like middlewes' attempt to disgrace the military but fail of course.
