Hatch to vote against Kagan

Utah Sen. Orrin Hatch (R) -- who was one of a handful of GOP senators who voted for Elena Kagan's nomination as solicitor general -- says he is opposing her nomination for the Supreme Court.

Do note that he also voted against Sonia Sotomayor. Also note that Hatch is up for re-election in 2012, and he probably noticed what happened to fellow GOP Sen. Bob Bennett, who lost his party's nomination in May.

Here's Hatch's statement:

"I have carefully examined Solicitor General Elena Kagan's record, actively participated in the entire Judiciary Committee hearing, and considered the views of supporters and opponents from Utah and across the country. Qualifications for judicial service include both legal experience and, more importantly, the appropriate judicial philosophy. The law must control the judge; the judge must not control the law. I have concluded that, based on evidence rather than blind faith, General Kagan regrettably does not meet this standard and that, therefore, I cannot support her appointment.

"Supreme Court Justices who, like General Kagan, had no prior judicial experience did have an average of 21 years in private legal practice. General Kagan has two. The fact that her experience is instead academic and political only magnifies my emphasis on judicial philosophy as the most important qualification for judicial service.

"Over nearly 25 years, General Kagan has endorsed, and praised those who endorse, an activist judicial philosophy. I was surprised when she encouraged us at the hearing simply to discard or ignore certain parts of her record. I am unable to do that. I also cannot ignore disturbing situations in which it appears that her personal or political views drove her legal views. She promoted the Clinton administration's extreme position on abortion, including the barbaric practice of partial-birth abortion.

As Dean of Harvard Law School, she blocked the access by military recruiters that federal law requires. And she took legal positions on important issues such as freedom of speech that could undermine the liberties of all Americans.

*** UPDATE *** Per NBC's Kelly O'Donnell, the Senate Judiciary Committee plans to vote on Elena Kagan's nomination for the Supreme Court on Tuesday July 13th at 10am.

Actually, If you knew anything about history, Hitler would be proud of Obama and the Democrats. Consider:

Hitler's political party - National Socialist German Workers Party. The operative words socialist and workers party. Is the GOP more associated with socialism (statism, collectivism- "share the wealth") or the Democrats? Do the unions follow "lock step" to the GOP, or the Democrats? Why are all the unions protesting Tea Party events?

Political/Social Issues - The Nazis were for national health care, they even had plans for government mandates for organic and other healthy diet controls. The Nazis were for gun control. The Nazis were for abortion. The Nazis marginalized church and religion, banned nativity scenes, etc. They heavily taxed all inheritance. They were anti-family, anti-individual - you know, kinda like "It takes a village" stuff.

Hitler was one of the greatest and most inspiring orators of all time that campaigned on....... change.

Which American party and which leader shares the above? Who would Hitler be proud of?

Those that talk without brain can go on say that whatever comes of that little head. simple and short, you loss and Obama and democrats won. Like Bush and Republicans, his nominee must be conform. Again for those of you that still dreaming, the democrats will not lose the control in any of the houses. America wasn't of year fear mongers and hates minded. Come November , the shock will be on those like you.

          i watched the hearings with an open mind..i didnt particulary care about the way she babbled and danced around the questions..some of the senators were irritated with it...but what did it for me ..she flat said she would make adjustments to the constitution if need be..that i cant go for..we already have four of them in the justice with the same belief..there fore the 5/4 vote on guns

              Evidently, MaCain, Hatch and other republicans did not know what the law was at the time that she was at Havard. Which goes to show they don't know what is going on in the world and who is doing what. All these guys need to step down and get out of politics. They have already made a million dollars of the the American people. It is alright for the American people pay their salaries and do what they want; but when it comes to helping the American people, the GOP are not down with it at all. They are all for themselves. Fact: the GOP and their supporters are to blame for the destruction of America and the American people. It is them who want to the American people to be beholden to them. When will the American people see these guys for what they really are, dopes.

                Hatch would vote against his liberal mother. This is a Senator that voted for the moron, Thomas.

                If you look a Graham's political past you will find that he is just another turncoat. When the South went insane, he went with the flow. Phil Graham did the same thing. Shelby is also a turncoat when the wind blew. Spectre did it twice. They all stink GOP.
